Pulmonary Fibrosis Sced At Ao!
I wont be around much here for next few days or week- too much to do regarding my AO claim-and other VAola stuff- But in accessing some citations from the CAVC -the BVA decisions are a good place to find what you need-I just found this extraordinary BVA decision. As I have said before many times ( yet had few actual decisions to support my statements) the VA will SC anything to AO exposure -regardless if not on the presumptive list-if the veteran or widow -as in this case- can obtain ample medical evidence of AO etiology. "The Board finds that the preponderance of the medical evidence indicates that the veteran's terminal pulmonary fibrosis was at least as …

Appeal Remand
I was denied service connection due to exposure to AO. I appealed, went to Washington, DC for a hearing at the VA. I finally received a response today. The case has been remanded to the RO. I assume this is good news. I also assume my records will be returned to the RO and I should only wait for a decision. Any info would be appreciated. Also does the RO normally reverse their denial? Thanks

Haas Update
This is from Sue Belanger- NY AO vets advocate- "The brief filed by the DVA September 12 is on the NVLSP website. On June 30, 2008, The American Legion, Military Order of the Purple Heart, and United Spinal Association file an Amici Curiae Brief in support of Commander Haas’ petition for rehearing (view brief here.) The VA filed its opposition to the petition for rehearing on September 12, 2008. (view opposition here.) It will likely be several weeks before the Federal Circuit rules on the petition for rehearing. When it does, we will update this webpage accordingly." I am not sure what webpage she means but of course NVLSP will have the latest on their site. S…

Ao Korea 1968
Berta, I received a letter today from the VFW Service Office in St Petersburg, Fl stating that the VFW and the Dept of VA determined that i am sc for my time in Korea and my exposure to AO. They futher state i am 60%. I called the RO to check on the status of my claim this morning and they said it was at the Rating Board and that a decision had not been made at this time. How does the VFW get this info? Is there any retroactive date other than the date in which the claim was filed for AO for Viet Nam and Korea vets? Not trying to be greedy but when they wait 30 years to admit that AO was used in Korea...... Sure appreciate your help Dick

Update For Svr
There has been a change! Kurt -the recent AO Thailand awarded veteran- is interviewing Steve for this show! Both of these men have considerable info on AO outside of Vietnam and can provide the links to where this info can be found. I noticed that the BVA awards of AO comp to vets who served outside of Nam- excluding Korean vets who do fall into the AO regs- were awarded due to detailed documentation of how the vet was exposed. Also the vets with awards used documentation from DOD etc- and any other source to prove that AO was where they were. Vets have to understand that -the BVA could award a AO vet who proved he was exposed to AO -lets say on the Pipel…

Wed 9-17th Ao Korea And Other Places
Dick I just got the heads up for this show at Stardust Radio Wed nught 6:30 EDT at http://www.stardustent.com/ I couldnt find Cpt Stewarts email addy at the Korea War Project site but I posted a message to find him-to be potential guest- I will post the media release next week for this show and call ins are toll free at 1-877-213-4329 Although the AO Equity Act is to cover ALL veterans exposed to AO with presumptives- we have no idea if this bill will pass and still vets who served oput of Vietnam or outside the date and area perimeters of the AO Korea regs might well have problems proving their claims. Are you aware of anyone who has asked any Senator or Co…

Ao Korea 1968
Berta I have not received the VCAA since completing my last c&p for my eyes a few weeks ago. The individual that e-mailed me is William Kenny at hawkvets@gmail .com and he said he works with ex Cpt Phil Stewart. Phil's who's address can be found at the Korean war project where he tries to keep everyone updated. He is attempting to prove other units and camps were sprayed after July 69. I feel i have a valid claim and i do meet the 3 requirements but i don't feel confident not knowing the dates i was on the Z. How do i go about getting a copy of my C file? I want to start gathering info for a NOD in the event i am denied. I have read many of the claims info at the BVA…

Ao Korea 1968
This is my 1st post since joining so i hope my question will come across and make sense to the reader. I was in Korea from Dec 1968 til Jan 1970 and was with the 2nd Batallion 72nd Armor 2nd ID. During that time I had duty on the DMZ though i don't remember the dates. I was also at Camp Casey for NCO school starting July 29 til Aug 29. I have completed the AOR and completed my C&P's as required. I have posted on other forums and have gotten positive answers to most of my questions. I got an e-mail from an individual who says he works with a former engineering Cpt Stewart who works through congressmen and Senators to get all the cards out on regarding AO exposure for …
