  1. I have had my claim in since just this Dec 12 went into as an FDC six days later preparation for a decision and that’s were it been for a month now. Why is it SMC claims like mine always will get denied at the RO and dragged out to have to win at the BVA? I’ve looked up past BVA cases exactly like my situation almost to a T and all were granted in favor for the veteran. They always state requires medication management due to my memory issues and can drive anywhere as long as my spouse.” Not all conditions enumerated need to be met.” Turco V Brown 9 vet App 222,224) 1996 Why is it when the claim is still at the early stages when submitting evidence you can’t site past BVA cases to help strengthen your current claim?

  3. My wife wants to know if she is able to pick up my medications otherwise I’ll be short for the weekend and cannot get to the VA myself tomorrow? I never really thought about it seems legit but I’d rather ask instead of her waiting to be told know. She’s a ChampVA recipient but it’s for me so I never asked before?
  4. Yes sir I hear you it’s just that she has a military ID since I’m Permanent and total. Well I at least had to ask the place in SC just wish he would said oh yeah she can hop on..

Well just heard back from my Poly trauma director she said it’s a no go for the caregiver because the doctor says I can prepare cold meals for my children and watch them while my wife is at a part time job and can drive anywhere as long as my spouse is with me. Guess I can still hope for aid and attendance but that’s prolly a denial too but maybe not...
  6. Just wondering if anyone on here is granted caregiver benefits and also SMC L aid and attendance. I have a claim for both not sure if it’s possible?
  7. Anytime you file a new claim with no dx paperwork you will be scheduled for a C and P exam and it’s there you will see if you are diagnosed for the VA. I was never dx when I filed in 2016 and they told me I did have it along with other stuff... also when they do send him to an exam make sure it’s a qualified psychiatrist who can do the ptsd exam.
  8. Had home visit and interview completed apparently she’s backlogged another team is helping her today for my determination tomorrow.....so she says lol she said the same story last week to my wife
  9. So just to wrap my head around these FDC anyone with a similiar claim and their results. I have one thing I filed for SMC based on my doctors 21-2680 he filled out and I submitted in with the claim on 1/12/2018 filed 1/12/2018 intial review 1/14/2019 Prep for a decision 1/18/2018 and no no movement after 30 days the RO and the phone say it’s in the decision phase but we all know anyday that could change....
  10. Can’t really give a guess as we all have had this if we won are appeal or claim. It’s the step to process your attorney cut of your retro it took my claim at the time 10 days but I had a hardship flagged on my claim so I cannot guess your time. You can try calling the the 1800 to see what’s the hold up or even go as far as going to your RO and asking in person either one will get you a more accurate guess.
  11. Well I’ll get my answer tomorrow from the Caregiver program about my application and my aid and attendance claim is still in preparation for a decision filed way before I submitted my claim for the caregiver...
  12. As far as my appeals concerned I had more info were my appeal was in the process then in ebenefits... they should be the same on both but not always the case.

  14. My issue was I got tired off fighting with the Va saying My ptsd and tbi should be separate. I lost this battle instead the va hospital sees 100% ptsd and the VA disablity says it’s my residuals of a tbi with ptsd. I get mad at the hospital when my records don’t even show my sTBI but I’m p and t so not sure I cant complain and have no idea what I’d be fighting for
  15. Yes I am most due to my cognitive impairment and having no short term memory with lapses and blackouts all being evaluated by the VA. I’m 100 p and t based on the residuals alone and my secondary migraines are at 50 with lightheadedness and dizziness at 30% also I find out to day if I was accepted into the caregiver program as I have been in my Vas polytrauma program for 2 years...which isn’t a requirement but it helps to have all my treatment records for the director to look at...
  16. Not sure how fast these claims actually move does it Actually move quicker? I only have a claim in for aid and attendance with a Exam and the 21-2680 filled out by my VA doctor.
  17. So I imagine the DRO would be a good speedy method for an EED claim but if the retro is a large amount won’t they still just deny it? Just asking bc that sounds like a good way to appeal EED
  18. But why is it when the VA says we will call you on Friday with our answer you start to laugh in your head. Wait that’s what they told me and my wife so my wife calls at the end of the day and leaves a VM, to see if we had any news. The coordinator was nice and said to both of us we should most definitely should be getting help I just hate when they tell you a date and always miss it every time it’s sad but expected....

  20. So I am asking about Space A travel details? I was told that it’s only for the disabled veteran and not his spouse or dependents? Seems odd to say to a disabled vet yes you can fly away but only by yourself and not your spouse.
  21. Same here I wish we’re able to figure out the algorithm they use. So to know what’s going to bounce claims backwards after months of preparation for a decision...
  22. The woman in charge of the program has been relocated to another program, and magically the program starts working for the hospital again...
