They have to figure out how much goes to your attorney first and then they give you your portion I would send an iris message and ask what is the hold up, if it’s a large amount of retro it could take a bit unless you have a hardship flagged on your claim then it might be the only way to get a retro quicker then normal.

What’s is the problem?

Speaking with the VA yesterday I ask the woman if she thought I should attach the C and P titled Aid and Attendance C and P with my new claim for aid and attendance I already attached my 21-2680 filled out by my doctor. She responded why would the VA send you to a C and P for aid and attendance how would an examiner know your needs. And that’s when it hit me they wouldn’t and the examiner lied to my face at the exam then who also said a 21-2680 wasn’t needed, wrong again I was when I got my denial two months ago. This isn’t a question but rather a statement to future SMC filers listen to us vets on here on Hadit first. Never assume a examiner is looking out for you... just me venting as I wait prolly another few months to get a third answer to my SMC claim, ask your doctor who does your care

Thanks for responding the application my doctor filled out doesn’t ask or suggest what level of SMC I’m asking for so how do I request the highest level of SMC do I need to ask in a Statement of support for my claim? I’m assuming that’s my only option at this point.i can upload it today with my wife into ebenefits if so.

I just know how the VA judgement calls have gone in the past had to be corrected by the BVA soo I guess I will hope and wait...

Left and right leg means you should be have a bilateral computation if those are the only two things it’s means nothing really but if you have other disabilities included it does...

Make sure your receiving a bilateral factor rating since it’s both your legs.

Finally officially applied and the CG manager said it would take 30-60 days for a decision?Really my Poly trauma manager laughed when I suggested I also send a copy to the address on the application see who gets done first.

I thought aid and attendance was any other SMC not considered the housebound at the S rate. But I have just applied for both at the same time two days ago so I am already getting SMC S. So I guess you may know before me?

This is alittle old to respond to but what the heck I’ll try. So my doctor put yes I need medication manage, yes I can prepare my own meals but only if their cold can’t be trusted with the stove and oven ( now a fire hazard left oven top on for a week and well long story short My wife cooks the hot stuff) no pun intended, and when asks what I do in a day in a day, he says tries to take care of his children which is effected by my TBI OCD and ADHD. He said tries but didn’t explain in detail other then I try not that I’m very successful but I do my best to get them into daycare most of the time until my wife gets back from her part time job. Is trying to care for my two young children and preparing cold meals and straight up no for aid and attendance and also with the need for medication management due to my TBI and ADHD exacerbated by the TBI? The doctor also stated I can drive anytime I want as long as my wife is with me so being able to drive myself with my wife may hurt me? If it’s a no I’m ok with that there’s nothing left to appeal about, I also just filed for CG for my wife so I don’t need or want both, I just wanted one or the other anything if I’m eligible.

So I spoke with my primary doctor who I spoke to about filling one of these 21-2680 since my psychiatrist pretty much had no idea what he was filling out spent a night doing it. Which had quite a few errors on it but I submitted it in anyways for a quick denial last month. My primary doctor fixed the errors spent a week filling it out for me to submit. Now that this is a new application using the 21-2680 in the past two months, how does that look when they make a decision he’s my primary doctor who has been caring for me only since 2016, and the psychiatrist since mid 2017 or does it even matter both are VA employees ? Well not sure how it will go I can prepare my meals part Yes only if cold meals not trusted with oven or stove is correct but is cold meals really preparing your meals? Most things need to be cooked, and the driving is accurate I can drive anytime no restrictions when driving with my wife she takes care of the GPS so I won’t be mad about this denial at least the application is accurate. And as they did with me making me 90% P and T but saying it was IU with no examinations made me frustrated I didn’t appeal I filed an increase due to the time it takes to grant an appeal I wasn’t concerned about gettting retro. It’s when they made me scheduler and then scheduled me for exams is when I appealed my rating should be P and T. Magically going to 90% IU to 100% Scheduler doesn’t mean it’s no longer permanent or in your case beware if your 80% IU in the future turns into 100% scheduler make sure it gets rated as it was when your IU. Not sure how many others have had this happened but I went to the RO with my Spouse and week later had a correction to my SOC with them stated P and T...

WTF just filled out the application never saw it until tonight soo it says send it to Georgia which may take awhile to implement or expedite it by hand delivery to my hospital. No she doesn't I was told that me being well enough to drive five minutes to my doctors appointments makes me not eligible it’s saved for more worse of vets of TBIs. I’m working on my SMC L claim currently with my primary doctor who is filling it out and I’ll have it next week. My other doctor who filled out the 21-2680 my psychiatrist filled out was outdated and on it says it expired in May 2018 at the top my psychiatrist told me he didn’t know what he was doing and just copied from my C and P they. Sent me too the prior month for aid and attendance. Annoyed I went to the VA.gov got the current and walked it to my primary doctor who said he knew how to fill it out. If I had one or the other I would be comfortable again either the SMC L or the caregiver for my wife? I have been told time after time if I drive on my own I don’t rate caregiver when i asked the program manager at the VA hospital, so never applied at the hospital had anyone had anything to to say about that not sure exactly what the criteria is, she gave my wife a relaxation CD to listen too and that’s all.

That’s what me and the spouse have been discussing she has a partime job making just under 29k a year so not horrible for a part time worker. But definitely stressful living just nobody has an accident and with me it’s not wondering if it’s a mater of when...

Looking at moving to SC mortgage went up again starting on the Jan first it goes to 2398 for our 4 bedroom home.... and that’s with a VA loan

Being a Delaware resident I have been finding it extremely hard to afford childcare while I go to my appointments now they want to send me for 12 hours a week if so their is no way to afford daycare in this area with my va disability and SSdI as my budget even with my wife working PT. So I reached out to the VA they said they can’t help and reached out to the whoever since I’m a Poly trauma patient there can’t remeber think it was the chaplain. But they said they have no idea So I’m forced to bring two kids two to three times a week to these appointments trying to avoid them being sick they said reach out to the state social services. I just received notice I was denied services even after wrote in a letter he needed me to be in treatment 12 hours a week and needed childcare part time. The denial stated nothing about my doctor special need said our income was too much my VA disability was used against me as my income and they should no deductions like my mortgage I can fight this see how long it takes could take months, but by the time I done with the fight it could be a year and then my oldest will be in public school. Does this sound right using my disability as income for state benefits? It’s very aggravating barely getting by paying a mortgage and being told I make to much, as if being disabled doesn’t have medical costs with it which aren’t even taken into account not even food was counted as being a need for. The family of four just utilities and the mortgage, good thing I go to church with my stated districts representative...

Usually if you see an exam request it’s after they Review your file and you are waiting a call to schedule one. But in this case you had been to one already and awaiting it to register which can take up to ten days after the exam is submitted back to the rarer, and it will take at the least the minimum 10 days.But I would tell you to call the 1800 and see what the stall is, they’ll actually see and tell you if it just awaiting a signature for return tbut now you would have to wait to Monday. Sorry I didn’t answer sooner. But your close to an answer and if you want a better answer request a copy of your exam from where ever it was done at by going to the records of release at your local Va hospital or if you have a VsO or attorney he maybe able to snag a copy from the computer system...

So I just noticed today on the top of the 21-2680 they sent me in the mail and had my doctor fill out this past October at the top says not valid past May 2018. I was didn’t think much of it since they sent me to a C and P befor sending me the form that was pointless since my primary doctor had to fill out the applicationanyeays. So I went to va.gov and downloaded the new application says valid until 2021 gotta love snail mail.... so I sent in the new application to my primary doctor who is filling it out on Monday.
