  2. Scott, I would go ahead and file the Form 9 to keep the claim alive, but I would also file a NOD for the most current rating of 50% and ask for an increased rating. If your rep says that he has already completed a NOD for the current decision, I would contact the VA or look on ebenefits to see if it is listed. The RO will look at New and Material evidence that you submit but you need to include that evidence with the NOD of the 50% rating. What is the highest rating for the condition that you are claiming and do you meet those requirements? Is there something that the RO did not consider in the evidence they used to come up with a 50% rating. You have to be able to prove that your condition meets that higher rating. JMO Shyne-I

  6. Hello afrn, It seems as though you may be able to file a CUE claim which is a Clear and Unmistakable Error on the part of the VA. What my concern is, the VA just not too long ago started accepting Depression as secondary to Fibromyalgia because it use to be considered a part of the fibro as you stated. You stated that you applied for an increase and a new claim for migraines, did you at that time, claim depression? It would be good to see your decision letter to see how it is worded. I am assuming that they gave you the depression at 70% because the most you can be rated for Fibromyalgia is 40%, so in order to increase your rating they gave you a rating for depression. Do you have a C&P exam for depression when you filed for the increase? We could help you more if you good post your decision with the Reasons and Basis for the Decision. Make sure that you leave out your personal information. I'm sure that someone else will chime in once you post that information. Shyne-I
  7. I've always dialed 800 827-1000. I didn't know about this number. Waco is treacherous. They claimed to not have received evidence that I submitted that would have swayed my case to my side. They denied my claim and closed it so quickly after I submitted my IMO that it made my head spin. I had to request that it be reconsidered based on new and material evidence and now they want to drag their feet again!! Shyne-I
  8. How did you get the 800 rep to transfer you directly to the RO? And do they do that often? Shyne-I
  9. I whole heartedly agree with you Sierra!! Waco makes you wanna go down there and slap someone until they get it(no anger issues here, IJS). Shyne-I
  10. Sierra is correct!! I applied for SSDI and was denied the first 2 times then I got a lawyer. My lawyer was with Morgan & Weisbrod and she was very thorough. I hearing Judge sayed that he thought he had enough to make a decision but may need to send me to a SS doctor and my lawyer got pissed off. She told him that she wanted to put on record that she disagreed with his assumption that I needed to see a SS doctor because my Rheumatologist said that I was disabled and provided substantial medical records and evidence to that fact; my Neurologist said that I was disabled and provided substantial evidence to the fact; and my Pyschologist said that I was severely limited by my disorder and she felt that it substantially affected my ability to work! She was like, what would a SS doctor find in a 45 minute appointment, that my regularly treating physicians haven't found over the years. The judge had made a decision within 10 days and it moved really fast from there!! My hearing was on August 6, 2013 and my Retro money was deposited on September 6, 2013. Good luck Navy, but unless you are retirement age....you are in for a fight!! I know how you feel...I was wanting either one of them to come thru. I thought if I got one, I wouldn't worry about the other one so bad but that was only for a little while. It relieved some of my financial stress but the VA owes me and I want my due! P.S. My lawyer and hearing was in Dallas. JMHO, Shyne-I

  17. Hi Lance, Have you checked your AB8 letter on Ebenefits? You can even look at Benefit Explorer to see if there has been a change or increase in your rating. It sounds very promising based on the comment made by the 800 representative. Good Luck!! Shyne-I
  18. 63Sierra....Oh how I wish that was all it took!! I have had the same symptoms continually from time of service thru these 19 years; and continuity of symptomology has been the cruxes of my claim but it's the "VA-ness" that has led me to have to obtain an IMO and all other sorts of medical research to support my claim for Fibromyalgia!!
