  1. I no longer have children under the age of 18 from my divorce but when I did I chose to disclose/include my va money in the child support calculations, but that was MY choice. I don't think I would have been required to by law. I did have an attorney, and I told him that I wanted that to be used. I always say getting an attorney sooner rather than later is a good idea, and if you have one child and she has the other.........you need to get support, visitation, etc. all set up. She must have income I am assuming as well or she wouldn't have just left.......that comes into play. Seek legal advice, protect yourself and your children.
  2. If you have one child and she has the other, why aren't you filing for support for the child you have? You need to get an attorney!!
  3. Nope, you will have to go to a va clinic or hospital and go to release of information and ask them to print them out for you.....some will and some won't. I have to get mine printed out, even my doctors can't see those cp exams. Something to do with Gainesville cp location. That is a VA cp location, fyi ;) and don't trust a single person who gives you an exam there, no one!

I think men have a much high success rate with SMC K as they can get viagra prescribed, women there is no medication, we can complain and have it noted about the sexual side effects of our meds and very few of us get SMC K for the impact the meds do to our sex lives. Another kick in the ass from uncle sam for female vets. Good thing we are used to it after all these years lol.
  5. I am IU PT for one SC, but it is okay I was merely curious about the new law I hadn't seen the important part first read through..........

The entire SMC S rule was already confusing honestly........If one was IU PT then awarded an additional rating of another service connection 60% and another of 10%......Many state that is enough for SMC S, others say you have to be 100% schedular then another 60% individual rating on top of that.......I can never seem to find a straight answer, and I sure as heck can't find one from my vso and the va sure as heck won't get you a straight answer either. I don't understand half of what this case law is saying honestly, I think you need to know the cases it is referring to in order to understand exactly what it is saying, maybe you can explain this in a nutshell? Oh, I think I understand now.........it is saying that you have to have a combined on top of your 100% of 60, it has to be using VA math, not regular math. I thought that was a given.
  7. topamax is one of those meds that some people just can't tolerate at higher doses, I would ask her to keep you on the 25 mg pills at let you increase at 25 mg increases until you as you tolerate. That is just me, I could never tolerate 200mg in my lifetime, some people take 300mg and are fine.
  8. I was initially denied IU, I did not appeal. I used new and material evidence to send for the RO to "relook" at my claim. I had my psychiatrist and my neurologist both write letters for me. I also used that social security had awarded me disability. Those won me IU PT, within months, instead of years of waiting on appeals and becoming homeless living on less than poverty income with 3 children. I would highly suggest looking into all your options before filing an appeal. Have you filed for SSDI? Will any of your doctors write letters on your behalf? Best of luck.
  9. It is called dopamax for a reason, I have been on it for over 10 years, like most things risk/benefit are things you have to weigh. For me, its pros outweigh its cons and I only take 100 mg, which i started at 25 mg and still take 25 mg 4 times a day so that it doesn't mess me up even after 10 years. I highly suggest you start very slowly on this medication 25 mg and go up very slowly. I am highly sensitive to most medications and this is no exception. The va does have 25 mg in their formulary :) It will make you dopey if you are taking too much too fast or give you pins and needles type feelings in your hands and feet. Also, it will really mess with your appetite, as in you will have none.....that is one of the worst side effects for me. Talk to you doctor or pharmacist if it is causing you bad cognitive issues immediately. That is not something you need to add to your list.
  10. I don't think I would have issue with it if I had signed something, and was in such a program. I am not in either of those situations so it tends to piss me off honestly. I have never been on narcotics, so don't understand their reasoning, they must just do it to everyone here.
  11. At least they are telling you, lol, they never even let me know they were drug testing me. The only thing I am on is benzos and fiorcet without codeine and (no illegal drug history) and i get drug tested at least 2 times a year or whenever they send me to get lab work done for anything else. I have been on those for over a decade and found out my pcp was doing the drug testing in the last few years. I was offended honestly but what can you do, we are less than pond scum, less than welfare recipients and honestly it is not because they are worried about us.......it is more of a cover their a$$es type deal. NOT all VA clinics do this. The day I no longer have to step foot in any VA clinic again will be a glorious one, not sure that will ever happen but at least the day I don't have to depend on them for all my care ;)
  12. I wouldn't worry about it really, you sent them the information they need. Most folks who get dropped from SSDI are those who havent' seen a doctor in years, arent on any meds etc. Those of us who live the life of chronic issues and are PT by the VA (which we all know is hard as heck to receive) they don't tend to mess with too much but they have their rules and they do send those letters out. I still worry too, it is in our nature. Even being PT I still don't trust the VA won't mess with me, I think those of us who even fought awhile with the VA or SS tend to not trust that we are going to be treated fair. That and well let's face it, for me, I have serious trust with most authority figures ;)

Go to my letters on ebenefites and generate letters it will either say you are being paid at the 100% rate or not, there may also be an option for checking that you are permanently and totally disabled because of your disabilities (that means that you are PT) you would also be able to print commissary letter,etc. if you are IU PT. The easiest way to find out though is to generate your own letter where you get to pick and choose what it includes like percentage of disability, amount you get paid, etc. and THAT will let you know if you got your IU ;) Best of LUCK!!
  15. I don't think you understand how this all works, you don't get the tax credits if you don't buy the insurance on the marketplace. Of course, if you buy insurance through your employer or are self employed etc. those things are taken off your taxable income, it becomes quite complicated. My husband is self employed and we hire a professional to advise us. If her boss will give her an amount of money toward insurance, that isn't a tax credit that is income according to the government and will be taxed as such. I would advise you to talk to a cpa about this, not h and r block, an actual CPA. Use champva and buy a dental plan through the VA for your family if your wife doesn't have one through work that is better or less expensive. We have taxable income every year, we actually pay taxes on part of my SSDI because my husband works, we itemize we hire a CPA because things are complicated ;) EVERYONE has different circumstances but when you are in a situation that you have already stated you are having a hard time keeping your home, do not add another bill you don't need. You should not need another health insurance other than champva. If your wife is working then I would go see a financial planner/advisor and figure out the best option financially.
  16. I actually had a ounce of empathy for you until you had the audacity to go "THERE" about MST. You have no idea how hard it is to prove and be awarded ptsd due to mst let alone 100% IF you think someone "got around" doesn't mean anything about whether they were sexually assaulted and who assaulted them and when you actually don't know unless you saw their claim, and all of the notes in their medical/VA records, etc. You have zero right to accuse any man or woman of falsely claiming mst.
  17. Did SSDI just send you the letter asking about appointments etc? If that is what they sent you answer the questions and include a copy of your VA letter awarding you PT. I did that with my review letter that just asked a few questions and I received another letter in the mail not long after that they were not going to review me at this time. Not sure if it was the many appointments or the PT letter but either way, they never really did anything and continued my SSDI. I am 45.
  18. 4A, the choices should be as follows: a yes or no box and then these choices, which the examiner chooses one which is over the last several months. Less than once every 2 months once in 2 months once every month more frequently than once per month Those are the only choices in that block, I would be writing a statement that there is something wrong there. THAT is a key in how they rate you.........which one of those they choose with the other things being as they have written will be what %%% you receive. There is something not right. You fit all the criteria and they aren't choosing a frequency, maybe they are using a newer or older DBQ?
  19. Honestly, I am going to say they are going to rate you at 0% for your migraines. If you have documentation from your VA neurologist or another provider that you have meet the criteria of more often than once every two month or whatever the next level is on their migraine rating chart (pretty sure that is what it is)...........

Oh, and the tax credit works like this..........it goes against the premium you would pay for the plan so my daughter is a destitute college student really and pays $5 for a gold plan on the marketplace because she receives a hefty tax credit. She doesn't actually get that money, it is applied toward her premium and when she files her taxes at the end of the year........if she makes a lot more money that she said she did, then she would have less of a credit and owe uncle sam. So, like Bronco stated you aren't actually receiving the $$ in your pocket it goes toward a premium for a plan on the marketplace, which you honestly don't need if you have champva.
  21. I only dealt with the marketplace with my daughter when she turned 23 and lost Champva.........in college and we live in a state that didn't expand medicaid. She was hospitalized 10 days after her 23rd birthday for a severe chronic health condition. Yep, had to bs her way onto the marketplace by saying all her scholarships and financial aid were income. Trust me, champva is far better and she has the best plan on the marketplace, I ensured that ;)
  22. I had a QTC examiner write that..........when I was on preventative meds, meds to take at onset, and shots 5-8 times a month plus being bed ridden 7-10 days a month, still am. Thankfully that was all documented by my VA neurologist and I had no problem disputing the BS that the examiner wrote.
