    seejeremy,

According to your post, the VA did not state your disability was permanent. If your disability is scheduled for review in five years, your disability is considered temporary with a possibility of improvement. The reason for the future review is to reevaluate your disability to determine if your disability has improved and your rating should be reduced. Scheduling a review is normal for temporary ratings and does not mean you will definitely be reduced. The review could also result in a permanent rating if the VA believes your disability will not improve in the future. The VA could also continue to keep your temporay rating the same and continue to schedule future reviews.

If you believe your service connected conditions should have been rated permanent and total, you could send a request to your RO asking to have the rating changed to P & T. A letter from your medical specialist stating they believe your service connected conditions are permanent and will not improve in the future could help your request. The specialist's letter should contain reasonable medical rationale supporting their opinion. If you are under 55, it is less likely the VA will rate you P & T unless you have some really strong evidence showing your service connected conditions have no chance of improving. JMO

Good luck to you and thank you for your service.

AskNod, you are right. Everyone works for money. I apologize for the not so nice reference to attorneys. They do good for many. I was fortunate to get through it myself.

<<<<The gist of all this, it's that you can do it yourself! Everything you need is available online .Sign up for Ebenefits online today! If you feel you need assistance, see your local VFW, American Legion, of VA Officer. Most states also have service officers that are paid by the state itself. They are usually disabled vets themselves and are there to be on your side. Stay away from the attorneys! They are in it for the money only!>>>

Always remember. Some of us are differently abled or disabled by medical/mental issues. Some, too, have no access to going online. VSOs work for the VA and are paid to represent you by VA. See below regarding attorneys and heed it well.

Congratulations but never cut off your nose to spite your face. Attorneys have their place in this business and we see evidence of it every day.. I'd give $100 dollars to see a VSO try a case up at the CAVC or the Federal Circuit. The fact is that they are precluded from doing so. Seems you need a 4 year college degree and another 3 years with a Juris Doctorate before they let you in the front door. The good news is you can defend yourself pro se there DJdan48- and it won't cost you a dime. Of course your chances of winning are pretty dismal but it will be painless financially.

Face it. Attorneys are like mechanics, doctors, electricians, plumbers etc. Everyone is in it for the money. You can't eat air and survive long. If you have paralegals working for you, they have to eat and feed their kids, too. Pray tell, who, exactly, in the world goes to work every day for free and is NOT in it for the money besides community activists? Few know that by law, attorneys have to provide free legal services to a certain number of clients every year or risk losing their license. I don't hear about mechanics being faced with the same onus. Be careful what you wish for. We only recently won the right to have an attorney rep. us at the ROs (2007) and our win rates have skyrocketed.

I first enrolled on the Agent Orange Registry in about 2008. No real reason then, except others said it was a good idea to get on the list. I was in-country in Vietnam from 1968-69.

In 2012, I saw that Ischemic Heart Disease was added as a covered Agent Orange disease as of September, 2010. I had a heart attack in 2006. So, I applied and got a 60% rating and was paid retro to September 2010. That 2-year lump sum deposit was sweet!

In 2013, I applied for PTSD and was denied because of a doctor filling out his report wrong. I appealed and was granted 50% only 6 weeks later! Now, my rating increased to 80%.

In December, 2014 I applied for a rating because the VA said I was a diabetic and put me on an RX. They rated me 20% for that, but not enough to change the 80% rating I already had.

In February 2015, I asked to have the PTSD rating increased and that I had left my job 2 months earlier because of the PTSD. In April 2015, they increased my PTSD to 70%, for a new rating of 90% overall.

However, they also put the added benefit of Unemployability on the claim, which boosted the claim way up there. With a spouse, I went from getting $1688 to $3415 per month! They now put me at 100% Total and Permanent disability!

When that rating came in, I immediately went to my Motor Vehicle Dept and got a Disabled Veteran plate for my car. Cost: only $4.50/yr! Then to the county appraiser's office here in florida to file for my exemption. At 100% total and permanent, they waive 100% of your property taxes on your home! ($3600/yr savings!) If you are under 65, which I wasn't, you can also apply for a waiver of your monthly premium for some types of Servicemen's Group Life you may have.

Also, but not the least, I went to a somewhat (75 mi. away) local Naval base and applied for a ID card that gives me 100% privileges at any commissary or exchange anywhere in the world, at any military base. I went to an Air Force one yesterday! I can even book a campsite or room at any base that offers it. Disney, Universal, etc are on the discount list too!

there has to be inside actions, relatives, ect that work at the ROs hooking them up. There have been people recieving double checks for years.. That is why the whole system needs to be audited by an independant company , preferably from another country, and be sealed and presented to the Sec of VA and congress and the FBI. Yep. I see them all the time at my VAMC. they get thier old man cane out of the trunk. adjust thier swagger and shuffle on in to the vamc. I believe God has a way of dealing with people faking health problems, they claim it long enough, it will happen. The man claiming blindness was indeed blind, he was blinded by greed , and will lose everything , including his freedom
he likely got turned in by someone who despised him to his back but smiled to his face/

Makes me sick to my stomach!!!! I see it happen almost every appointment I go to. I just pray that God handle it as he see's fit cause it causes me even more distress, etc.
Scandals going on everywhere!!! The whole government and all its departments, to some government employees, civilian world scandals, government bale outs, etc. vets and civilians out to make a buck while the innocent suffer. This world is going to crap in a very manner. What ever happened to honestly, truth, moral values, integrity, etc???? Pray the day of reckoning comes soon to cleanse the world or corruption! Sorry for venting. I do love my country and would serve again but just can't stand such dishonesty, etc. Everday is another report of something I just stopped watching the news all together. Rather spend my time with family, helping others in need, and trying everyday to be a better person than I was the day before. May God bless everyone with better health, safety, happiness and good fortune.

If your not able to work because of your SC Disability yes they can deffer your claim to TDIU using the extra scheduler CFR'S REG's part (a) & part (b)

What they may do is rate you 20% more above your 50% which would make you 70% and eligible for TDIU but only if your disability keeps you from working and in your C&P exam the Dr did say you could not be in a structure or close surroundings due to your PTSD Hence Unemployable.

If they give you Service Connected 20% and your total SC %disability is 70% and not deffer you TDIU you can appeal that if you can't work.
They should send you the TDIU Form to file for the TDIU in your decision. If they don't > Apeal the decision.

At least the V.A isn't putting us on the back burner. It looks like there making headway and taking the initiative to give us the best services and health care we deserve. After I got out out of the hospital awhile back for my ptsd, the day after I got home,I couldn't believe it.I got 3 phone calls throughout the day from the V.A,one was a social worker,a nurse and a doctor all asking me how I am feeling with alot of other questions related to my Emotional health and the nurse asked me how my satisfaction was with the care I received on the unit,I said 100% because I felt the care could not be any better.I been to many private insurance pchyciatric hospitals in my life, and the care I received did not even come close compared to care I received from the V.A.With all the corruption and scandels that's been going on lately,I can only see the care and services for us getting better, that's what I feel with my experiences from the V.A in recent months.I'm sure the care is not the same in all the states, but hopefully it will be equal to the care that I been recieving here in Upstate New York.Have a good day everybody.

Now it's time to apply for an ILP program and a hobby to occupy that newly connected brain of yours, sir. Perhaps a woodworking shop to focus you mind and make bird houses or cedar planters? Maybe a new interest in a garden and a greenhouse. VA is obligated to help 2,700 Veterans every year who are "severely disabled" who are not candidates for a $100 K job a year at Amazon. Like us. The Independent Living Program has a grant for up to $80 K available for you but you'll never know that unless you're a member at Hadit or Asknod. VA hides this one over in the VR&E tent and sometimes denies it exists until you push hard. It's there, believe me. I got a complete computer and peripherals to publish my blog Asknod. I'm all in for the greenhouse at the BVA right now. Nothing's easy.

Welcome home, sir. Glad to see you made it even with a few chips and dents. I did two tours back to back from 70-72 and came back with almost all my 2,000 body parts. We're disappearing fast. Last I checked, there are less than 855,000 of us genuine, red clay between the toes, brown water leeched and jungle rotted Veterans left. Sorry for the Navy guys. Not trying to minimize service but the AO cadre-those who are presumed exposed- is shrinking faster than an ice cube in a hot frying pan. For what it's worth, if your ship's water went through a desalinization plant with H2O from seawater close to estuaries, then I think you should get the presumption. AO and ABlue are some nasty cocktails. I know.

prayers sent,, dont give up,, we all have our burdens, only God knows why,, We must endure our hardships, just as Jesus did all the way up to crucifixion. Many times we box ourselves in, and create a very small world for ourselves, where things seem hopelss.God can change things around in ways that are incredible! The more you trust in God, the more he will help you.
Dont live too far in the future.. live day by day,, hour by hour if you need too. Rarely does things turn out the way our minds conjure up the projected outcome to be.. Break life down to its simplest terms.. what do you really need to live.. food, shelter, clothing... We are not gauranteed tommorow and many people on this planet will not be alive tommorow.. Death is so final.. Your life is a gift from God.
Accept, endure, and continue to live. your special and the life you live is special.. God has a plan, let it materialize..
