  1. i am 0% for gerd and i just looked at my rating decision. it states "Since the disability at issue does not have its own evaluation criteria assigned in VA regulations, a closely related disease or injury was used for this purpose. A noncompensable evaluation is assigned unless there are two or more of the following symptoms associated with epigastric distress: dysphagia, pyrosis, regurgitation, or substernal or arm or shoulder pain." i don't know what this means, but i hope it helps you.
  2. i've been waiting since september 2005 and i was one of the original 133,000. hope you won't have to wait much longer
  3. i would talk to the np and see if maybe she could it rescheduled. the other people would probably be more receptive to her. worth a shot
  4. I noticed a new Retiree Account Summary (RAS) on the mypay website yesterday. It was the DFAS portion of the retro pay owed me since 2005. I called today and spoke to a young lady at DFAS VA Retro helpline (Tara) and she confirmed to me that indeed my case was completed. I asked her when I could expext to get the VA portion and she told me that the information was transmitted as a batch on the 17th of each month and then between 14 to 60 days the VA would deposit the money direct deposit. I asked how much the VA owed me and she told me she didn't have the exact amount but it was over $5,000. Bottom line... Keep your eye on mypay for new RAS's and once it is posted, DFAS has a lot of information
  5. i had a similar visit to the emergency room. they misdiagnosed me, and i went to the area va clinic 2 days later for proper treatment. i am 100 p&t and it still took several months. they finally paid without any effort on my part. i think a lot of it also has a lot to do with where you, live believe it or not!
  6. mine went from 40% to 100% p&t. i guess it depends on your evidnece and the c&p results. when i requested reconsideration, i was scheduled for an additional c&p to verify myclaims
  7. I don't know if a "Privacy Act Release" and a "Freedom of Information Act" request are the same thing, but I made to FOIA request and received my entire C-file in less than 30 days from Albuquerque VARO.
  8. I received my C-File today and it's about 4 inches thick. I have read about people sorting it out and placing in binders; How would you recommend breaking it down (in to what categories)?
  9. i am a 100% believer in not poking the bear, but then again i am not married. i always worry about c&p exams popping up, just as VAF mentioned above. i am 100% P&T for mdd, and i lose much sleep over this. i haven't worked since 2003 so i think i should be ok, but there is no way i could work. if they took my 100%, boy would i be screwed. i had over 10 jobs in 3 years, the last one being the USPS, and quit them all.
  10. my va disability is always deposited on the last work day of the month (which is Dec 31 (not a holiday)) and my military retirement is alway the first workday of the month.
  11. I don't think that is necessary. Simply take the letter with you. No real reason to cause this specialist trouble; he was only doing what he thought was right. jeez
  12. This could get real ugly, real quick. It's Christmas!!! Remember the movie Bambi? When Bambi's mom asked thumper what his dad told him?
  13. effexor xr is venlafaxine. i use to take, but was switched to bupropion. have sexual side effects with both, but no big deal... i'm single B)
  14. every other time i have called, i spoke to someone in albq. maybe they trying to streamline there system to cut down on waiting time.
  15. i was calling 1-800-827-1000, to contact my VARO in Albuquerque. Speaking to a counselor was no loner a choice (it used to be 6, i think). Any ways, i just didn't enter a choice and it told me my call would be answered by veterans benefit counselor. The lady was in oakland, california. hmmmm. anyways she told me to fill a VA form 21-4138 and fax it to Albq and she gave me the number. She also told me to fax it attention: privacy act. is this the same as a FOIA request? If not should I sned a FOIA request or a VA form 21-4138? Why did someone in oakland answer my call?
  16. the way i understand spike, he is referencing 100% P&T veterans. getting a 10% rating for GERD could result in you getting reevaluated for the 100% condition, and may indeed, cause you to lose it. the way i understand it, is the VA medical will take care of your GERD anyways. i think the only time filing a new claim for an additional condition may be be wise is in case of a terminal disease, which if fatal may have DIC benefit entitlements. for example, a vet is 100% P&T for PTSD. then he is diagnosed for AO exposure which has caused incurable cancer. this veteran should file a new claim because if granted, it will pay benefits to his surviving spouse and young children. just my opinion. but i've seen people lose 100% P&T over a new claim. boy that really would suck!!!
  17. the army regulation that covers spd/spn codes is AR 635-5-1. this regulation is "FOR OFFICIAL USE ONLY' so you can't look it up on the regulation website. when we would get new ones, we would have to turn in the old ones, which were later destroyed. ALL Army recruiting stations have this regulation. They're not supposed to show it, but they have it B)
  18. that's it. what really makes it confusing is that the code may have different meanings for each service
  19. when you seperate, youget 2 copies of dd214 copy 1 and copy 4. copy 4 should have it.
  20. DD214's still have sdp/spn codes. i retired in 1997 and mine is RBD. Also, htere is an Army Regulation that has all SPD/SPN codes and definitions. When I was active duty I had one as a reference regulation. I tried to access it via google and the library won't let me see it. "FOR OFFICIAL USE ONLY".
  21. congrats!!! i'm happy for you and your family. life will be much better now; iknow mine is!!!
  22. I also worked at the post office as a letter carrier. I got into it with the postmaster and I quit. I quit a wonderful job that I really enjoyed. But because of my military career, I was was unable to deal with the stress any more. If you have depression issues, don't work at the post office!!! :)
  23. I just looked at my DD214 from 1997 and my dad's dd214 from 1974. They are different, which leads me to believe the have been several different versions. The code you are looking for usually crresponds to the narrative reason for seperation. In your case, it sounds to me like you may be TDRL(Temporary Disabled Retired List).
  24. Just my two cents on "who is a veteran". one day of active federal service constitutes a veteran. some benefits require more than one day military service. Bottom line for me is; If the VA even entertains a request for compensation, wouldn't it stand to reason that THAT person is a vet? Kinda tripping over mouse turds here ain't we?
