  1. I have it, but the issues Is this EED if it is moved back will be an aditional 15K from payments I made for the student loans. I think you only get one shot at it, and the payments start again here in less than a month. So now I am going to start paying them but I don't want to wait forever.

  3. This is really good advice. I will wait for the Judge as it is sitting with them right now at the BVA. If the Judge corrects the RO's decision, then there is no issue. As of right now they have a IMO from 2015 which rebuts the 3 VA doctors who put me at a low rating and ignored what should have made it higher. and if they do not do the right thing then I will for sure file a CUE. Thank you all for the advice.

  6. This claim is from 2014. I did the DRO and got nowhere I have been to the BVA and back to the regional office with a partial award. I then appealed to then appealed again to the CAVC with a lawyer and it was sent back to the BVA then to the RO and was awarded with the wrong EED. It was then appealed by my lawyer as it was sent back to the BVA as not being correct as they put the date as 2021. They missed it by a few years. I have been sitting back at the Board again since last June. I thought this would go back to the front of the line, but it just seems like a new line. Has anyone had a current appeal that was sent back? Then how long did it sit there before they did anything? I have called everyone and am still getting the same answer "it is with the Law judge" Asked if there was any time range that could be given and no luck. Any advice here is greatly appreciated.
  7. I am going to go out here and guess and say that you were not on base or doing anything with the military? I would assume it would be a no, but tell us what happened and maybe there is someone here who has a better answer?
  8. I say to always go after it. If you are leaving anyone behind, you want them SC so they can get some benefits if something happens to you If you pass away from something that is not SC they can deny DIC to your family. I fought everyone of mine and won. I have never had another review of other things and if they did, we would go at it again. Always tell the truth and you will be fine.
  9. It is great you never needed to get an IMO. I agree it is not always needed as most of mine were done without it. There are times where it sadly is needed. I have a rare condition and the VA had no idea how to rate it. I had to take it to the CAVC and yes, I needed a lawyer as I did not have time to fight this and take care of my family. I did need one, IMO for this condition. For all the other 9 conditions I did not need any help doing these. I got all the help from here. So, for the most part I agree you should not, but there are times it is needed.
  10. Mine took 6 months. I had to contact my senator (all 3 of them) I got one of their assistants to help me and within a week I got my decision and the change in benefits. I did wait the 6 months, which I should have done the above sooner!
  11. Brokensoldier is correct, there are not enough C&P at the VAMC. This is why they do the contracting out as they could not keep up before. I remember back when I started this and they were 3-4 months out on a C&P. Now they are a week or two here.
  12. It really depends on what state you live in. Medical Merijuana would be my suggestion.
  13. If you have any paperwork from your doctor to show your issues, I would take it with you and highlight the important parts. I had to do that with Dercums disease as they have no idea what it is. I had to find a Skin specialist to tell me what it was and what kind of lipomas I have. I did not to this to start with and it cost me 10 years of fighting. Anything you can do to help them will help you in the long run
  14. I am not sure that button speeds anything up as it looks to be you are just saying you have no more evidence. After 30 or 60 day it really does not matter and they are never that fast.
  15. It is also a presumptive if you are Gulf war Vet.
  16. If you are a Vet who are under the Presumtive conditions, you should (IMO) file it under burn pits if you were around them. This is how the VA associated mine to them. I wrote Laystatements, and I have a very well written document to show the link of SA with burn pits. This is something that worked for me and might not for everyone, but I was able to do it without paying for an IMO. It took me a lot of time and effort and one denial, but in the end they did service connect my SA. Also I was NEVER diagnosed in service with SA. Again this worked for me and may not work for everyone. If you would like the document I sent that won my case, I can share it. just let me know
  17. I am sorry as I did not mean to come off as rude, but it really bugs me when I hear a person who is there to help is doing everything they can to stop you. I am dealing with my hearing loss in one ear and the ringing never stops, so I feel your pain. I was told by so many people at these places that are suppossed to help and unless you are missing a body part then they feel you do not deserve the benefits. I hope you find a good VSO and always question something if it does not sound right.
  18. ( I'd like to get hearing aids from the VA, but my VSO told me I need at least some percent on my SC hearing loss.) That is a LIE you are service connected for hearling loss. Call the VA and schedule an appointment for a hearing test and talk to the nurse. Tell them your issue and ask for hearing aids. You have a service connected condition. They will cover what you need for it.
  19. IMO you need to go and get hearing aids at the VA. Even at 0% they will get you what you need. but it sound like it is worse and you need to file for an increase.
  20. I had to leave the DAV, because the rep told me I was not injured enough. And that my claim had no weight to it. Also that you can't claim something that is not a NORMAL thing the VA will recognize. I went and submited my own claim and they called me and dropped me. I called the VFW and they helped me the whole time and never questioned one of my choices but gave me help to win it.
  21. It depends on what it is, and I am not saying yours is. Mine was because they saw it as pyramiding. Which in a way I could see what they were saying and went to the CAVC to get a higher rating an they agreed it was the same thing. (I still disagree with it, but that horse has been taken out) I doubt they will as all of my other BVA decisions have been fine.
  22. They will review it every time. They can also disagree with the decision and send it back, but they do need to have very good reason for it. It happened to me and the judge in the end agreed with the RO, I am not saying it will happen to you. It does happen. Let them finish the review and see what happens
