    As of today 05/14/2014 I have not received notification from Nashville VARO about decision made on April 24, 2014. DAV representative assured me on two different phone calls about the decision of granted 100% IU P&T. DAV mailed their notification on April 30,2014 but still has not showed up in my mail box. I was also told by my Congressman Chuck Fleischmann that my appeals file at his local office will be forwarded, along with several other that he has hand selected, to a hearing in Washington about the VA claims and appeals backlog. I just want complete resolution and see the big brown envelope in my mail box.

    Heres the problem though. P&T isnt really Permanent. They can reduce you until you hit the 20 year mark. So what happens when in 3 to 5 years, the revaluate your case, get some NP to say your cured of your PTSD, or that little pill they are working on at MIT that cures ptsd goes mainline?
    Thats why im not giving up on any of the claims I think they will start chipping away at claims, in any way they can in the future to save money. I hope it works out for you, and I know u must be weary , but stay vigilant.

    You see how they use these service orgs to do thier dirty work for them? Its the perfect arrangement because the RO is not in direct contact with you, they cant be pinned down on the illegal bartering because they are playing the third party game. They are using your service officer to see if you will go for it. Thats why I dont trust any of them.
    This might be fun, ... ask your service officer to have the RO put thier " deal" in writing, so you can feel more secure abt it. If they are stupid enough to do it, call CNN. And make an ass of them.

    Yeah...VA isnt allowed to play Lets Make a deal....however....was the BVA case solely for the same reason they awarded you?

    In other words was the remand solely for "appeal for tbi and my claim for finger(s)"

    Do you have any breakdown at all of the pending award?

    I dont trust your VSO....he gave you the wrong advise in April here.....but maybe I misunderstood him.

    I had a vet rep long ago and when I succeeded at the VARO level (DIC under 1151) he asked me to drop my I-9 appeal and I did because they gave me what I wanted.

    On the other hand , the week after that I got the decision in the mail, and we discussed it in person and I questioned it, saying I thought I should file a NOD.

    He also agreed it seemed odd ,as tothe point I raised, but he said No, dont file an NOD, this is 1151 and these claims are different.from regular claims No need for an NOD.Then he said he never recalled seeing an 1151 award before.
    I knew the award was coming because I won the FTCA case. So I dropped my DAV POA and gave the claim and POA to this rep. The award was in the bag. He didnt have to lift a finger to help with it.

    But I was as dumb as he was in those days.

    I had to CUE that decision. and won the CUE 14 years after the original decision.

    It was my SMC CUE claim in the CUE forum here. A 5 figure award. They still owe me some cash on that but say they lost the claim after it went to a 'specialist' at the Buffalo RO.

    I think the specialist is their name for their MF
    (MF- Mysterious force who removes , hides, or loses my good stuff all the time)

    I raised Hell with IG,OGC, VA Central etc etc........they WILL find the claims now,I am sure.(they lost both of them and are working on a claim I never filed and have been awarded already under 3 separate theories of entitlement.)


    Sorry I keep rattling this recent FUBAR off here......if any of you were here over the past 16 years you know this has happened to me again and again.......

    That is one reason why I went to a war school in 2003.(AMU)

    Today 1 day after getting the bank deposit i recieved the big brown envelope.
    100% schedular was the final grant and chapter 35 , CHAMPVA FOR THE WIFE,AND ANYTHING ELSE THAT COMES WITH

    WAY TO GO HADIT! YOU GUYS NEVER LET ME QUIT.

    I had the same thing happen to me yesterday when checking the status of my claim. The dates of What we are still waiting on from third parties kept changing. The dates were completely wrong because they were prior to when I had my C&P exams. My claim has been open for over a year now and it has gone back and forth several times from stage to stage. It was back in Gathering of Evidence yesterday when the date changes kept happeneing and now today it is in Preparation for Decision. I think seeing date changes could be a good thing and it might mean someone is working on your claim. Then again, it could just be Ebennies messing with our minds. Best of luck to you and hopefully we will both have some good news shortly.

    Good morning everyone. I happen to check ebenefits yesterday and sure enough my claim went from 80% and was raised to 90% with an award of TDUI. It took a total of 10 months for claim to be decided. Yes I am very happy with the outcome! Still trying to take it all in.

    Navy04 you can contact your loan provider and request a discharge application. Look up "nelnet" and they have the process for Total and Permanent Disability discharges.

    For the 1st time in 14yrs I personally received a call from my rater at the Baltimore Regional office. She was awesome in getting EVERYTHING back dated to my date of discharge in 2000 because it was proven it happen in service!!!!!

    Two huge amounts were deposited into my account today....Ebenefits was down earlier and I couldn't check....all i can say is WOW....waiting on the big envelope to break down my 100% schedular permanent!!!!!!

    The retro check I will receive is for my daughter who is now a sophomore in college...all of Tuituions and monthly stipend of lil over $1,000 will be paid ALL back!!!! Each day is great day but this May 1, 2014 will always be special!!!!!!

    Bottom line...WHATEVER YOU DO....DON'T GIVE UP...KEEP FIGHTING....I AM A LIVING WITNESS.....14YRS LATER!!!!!!!!!!!!!!!!!!!!

    Stanval, I am not finding a direct number for that RO online. However, look through your paperwork. That is where I found the phone number for my RO.

    UPDATE ! Called my VSO to find out the decision made on 4/24. PTSD 70% , TBI 50% TDIU granted Permanent & Total.

    Now to wait for the official word.

    Thank you all so much on here, this whole process has been such a struggle over the last 7 months. In the last month God has been good to my family and I. Starting next month I will receive my 100% VA, SSDI, and my wife will be paid 2K a month to be my caretaker. I am so grateful to guys on here like USDART, 63Sierra, NavyWife, Carlie and Berta. God Bless each and every one of you. I am so emotional right now, and I feel like I am floating in the clouds. Thank you guys again and I hope that each and every one of you will post a Success Story on here very soon. Love Ya

    I just got my 100% rating, too! (High 5!)

    After telling the person closest to me, I fortunately figured out quickly not to talk about the amount and extra perks, (property tax, fishing license, Nat'l Parks, commissary, etc). I just say that I'll get a monthly check and some healthcare at the VA...

    What I'm guessing happens with the haters is: the economy is bad, politicians are bigger douches than ever, people are struggling, and the ones who do have jobs are working their butts off, some in jobs they hate with shit benefits if they get any at all, and paying Taxes... and as far as they are concerned, those taxes (their money) are being taken away from them and going into my pocket for me to sit around on my ass and live the good life ... so, big-time Resentment.. Talking about my recent good fortune may feel to them like rubbing their face in it.. not entirely rational, but that's how humans are..

    They aren't going to care that my life was destroyed and I've suffered with PTSD and chronic pain for 40 years while trying hard to make it on my own, not taking handouts, lost jobs, broken relationships, homelessness, before I went to the VA 4 years ago... I'm just some old fart who signed up during an unpopular war long ago that the young people don't even know much about.. If they could walk in my boots, they'd get it, but they can't.. even the people who've known me a long time...

    I just got too old, too tired, to fight anymore and when help was offered, I accepted.... I consider it a gift and I'm grateful.

    So we can just celebrate quietly here... champaigne, anyone?



    BTW- does anyone know which letter we're supposed to show to get DMV, property tax, National Park pass, etc.? I have an AB8, but it shows the amount I'm awarded on it, and I'm not all that comfortable with that... Is there another one that just says certified 100% Disabled Veteran, or is that the one I need?

    TNengland, I fully agree with you as to the Fast Letter 10-02:



    It that letter applies to your retro due to an award, as the FL explains, then your VSO or someone should whip it out and send it to the VARO
    and ask for the retro due you at this point.

    We had a few vets here who had to do just that.(and got their retro)

    I turned in my information release form for a congressional inquiry just this past week.The VLJ ordered a partial grant and also a remand on 02/03/2014 . I made contact with my VSO about retro payment status on 03/24/2014, he then contacted the Nashville RO and there response about the retro is they are withholding payment until the remand was complete. I feel this goes against the VA Fast Letter 10-02 and I feel the only way I can have any influential contact with that Regional Office is by a congressional inquiry. Retro pay is over 20k, so I am determined. I will keep you updated on my situation in case of success or failure.
