How does a IMO describe years of 'unemployability' due to mdd? My thoughts go something like this...

" In my determination, this patient xxxxx is currently diagnosed with xxxxx. .....a VA rated condition of ....that permanently affects ,,,,, ability in getting and maintaining a job in their skill field that provides constant pay, above poverty level. The patient has been diagnosed with ------- since 19__ and continues to see me for this condition"

Any other thoughts? thanks.cg

For my children, my God sent husband and my Hadit family of veterans, I carry on.

It would be good to get an IMO that said it a little differently Cowgirl-'the veteran, due to her service connected disability, is unable to attain and maintain substantial and gainful employment.'Then they would give their medical rationale for that- the meds you need for SC have side affects prohibiting employment, your work history shows considerable time off for SC illness, employers statements show disability related problems with co-workers or work out put-stuff like that-It would be good too if an IMO doc can state there was continuity of symptoms and treatment during the period of unemployability consistent with the sc disability.

When thousands of Americans faced annihilation in the 1800s Chief

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

Berta, you forgot about the more likely than not line. An IMO doctor would put ( more likely than not faster ) than a definite answer. This is also what they like to see on things. This way it is not disputed easily.

The patient X had X worng with her and it more likely than not - caused everything that you need it to say.

I HAVE BEEN ON THIS VETERANS SITE SINCE THE BEGINNING AROUND 1997, This site has had many changes. All of the changes have been for the good of the site. T-Bird does her best to keep Veterans informed. This is the best Veterans Discussion Board on the Internet. I wish I was able to be on here as much as I used to be. The amount of post that it shows that I have made does not go back to when the site started. T-Bird had no idea that this site would ever get as big as it has grown. She is a big inspiration for a lot of Veterans. If it were not for this site, a lot of Veterans would not have ever had their claims won..QUOTEHelp a Veteran any time that you can. They need to be informed of the claims process...

How much proof do I need on a claim?

VA law requires "as likely as not." Doctors are used to stating opinions to a medical certainty. That is a much higher burden of proof. Show your doctor the following chart. It may help.

continunum of causation-- burdens of proof

standard ---------- how much --------- context

as likely as not ---------at least 50% ------- verteran claims

more likely as not---------- more than 50%-----civil trials

clear and convincing------ about 75% ----civil juvenile court

to a medical certainty===about 80%------ court doctor opinion

beyond a reasonable doubt----- about 90%----criminal trials

beyond a shadow of a doubt-----100%------ignorant doctors

How do I give an opinion for nexus (relationship to a military incident?

When asked to give an opinion as to whether a condition is related to a specific incident during military service, the opinion should be expressed as follows:

1. “is due to” (100% sure)

2. “more likely than not” (greater than 50%)

3. “at least as likely as not” (equal to or greater than 50%)

4. “not at least as likely as not” (less than 50%)

5. “is not due to” (0%)"

A least as likely as not will work for the VA raters. The 50 percent puts the claim in Equipose and the Benefit of the doubt rule should Kick in. As long as there is no negative evidence.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

      https://www.law.cornell.edu/cfr/text/38/3.344

    • Good question.

Maybe I can clear it up.

The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      More here:

      Source:

      https://www.va.gov/disability/dependency-indemnity-compensation/

NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
