Tdiu Unemployment Form Help Needed

I am filling out 21-8940 today, is there any advice I need? The page seems clear, I have only worked on temporary jobs under one employer, so thats all I can list there. Question, how critical is it to have 'exact' dates and hours worked? As a temp, the pay slips are simplified, but I can get a printout for surety, of course that will cost. Question, are these numbers 'representative' for the entire claim being accepted, with more validation later, or need to be 'exactly detailed'? Also, time lost for illness, thats a best guess. With my chronic issues I was unable to work most days. I can use remarks page to explain, but want to keep it necessary information only. Thanks for advice.cg

CG, Social Security has a website wher you request your total earnings statement, by year. The VA is supposed to request those records for you - but why depend on them to do anything right?! Request your earnings statement from Social Secuirty and forward that hard copy to your claims file. ~Wings

CG - they do not have to be exact. However, they should be as close as possible. On a TDIU claim the VA will contact your employer for verifaction. Once you submit the claim stay in touch with the VA to kinda track when this verifaction is requested. Once this is done, if you still live close enough to the employer then you should personally contact them and let them know how important it is that they return the form to the VA. A lot of times on a TDIU claim the employer is the hold up. They simply forget or plain out do not send the form back. Once requested the VA will wait 60 days before they attempt to request the info again. jmho

Thanks 1968,wings,ricky,you keep me going ya know! Regards facts, I am so honest I stress if there is a shadow of a doubt. I did request SSA updated statement as suggested. Will let you know how it goes, just tryin' to get it done soon and right first time.cg

cg, you can print the form online and hand walk it to your employer and have them fill it out to your satisfaction and let them know what your doing...mine were happy too see i was getting the help, [i could'nt see i needed]...then walk/drive that "TDIU form" right to the RO have it stamped[received in] and ask for a copy and be on your way.much faster and if you live near your RO.. or mail it too the RO after you bring it too your employer and HELP them fill it out...peace, Bill

CG, when the VA requested my employment info they only accepted info direct from my former employers to them. I could not handle the froms. They told me that someone seeking benifits had forged some of their 21-8940's. Just posting what happened to me. Take care. Terry Sturgis

What if you had many, many employers over the years. I looked at my SSA earnings statement. For a period of about 14 years I never made over 4500 bucks a year. Is this a good indication of being severely disabled or being IU. I cannot remember all the jobs I had. Many are out of business. I am doing a CUE that will be retro to 1971. The VA always uses employment as the chief indicator of being mentally sound. What can they say about someone who never made more than 80$ a week for years and years? Under these conditions I got an award of 10%. They never addressed my employment issues until I filed for IU. Not one VSO ever told me about IU even though I could not hold a job for many years. In my records my psychologist says I was unable to work and the VA knew this since 1973. I think they carefully avoided asking me about my work history.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
