just wanna ask anyone ,"Is it clausable that these benifits are for ever?" or is it a patch,a temporary fix, I been on IU and SSDI since 2002 VA payed me back to 1998, Is it gonna end? when am I gonna get the C&P? Is that designed to cut you off? CAUSE IT SURE SEEMS LIKE IT TO ME not trying to burst any bubbles but I"am really concerned..you know if they want they can say you can work selling news papers...what is in store around the corner what is the rule thumb? is it posible to never get a C&P? really I'am new to this..the C&P thing seems hostile are they really out to cut us off?

If you are on TDIU and are not working then the VA will have a hell of a time taking it away from you. They have to show that you are able to work, and how can they do that if you have not worked in 6 years? Now if you go to work full time then you are in trouble. Are you P&T? How old are you? If you are over 55 there is a slim chance they will even call you in for a new C&P. If you are on SSD and TDIU I would not worry too much.

If VA has granted you IU and paid you for it at 100% since 1998, I seriously doubt they

can reduce this without very good reason -- something like you start working or

fraud is shown to exist.

You can be scheduled and requested to appear for a re-exam anytime VA request's it.

Lifetime IU is not guaranteed. In order to place a security blanket n the IU, a Vet should pursue a schedular benefit. This can be done over time for as we age, secondary conditions are likely as well as the severity of conditions will usually increase.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Veterans deserve real choice for their health care.

I found out by accident that the reduction was going to take place less than a week later. The regs say that I am not required to fill our and return one. Jim, Do you remember the VA Regs you cited for them; I have not been sent a 21-4140 in a couple years, I may print one and FAX it to them, but I would also like to be able to argue (as you did) with law ---wondering if you would post those VA Regs for me??? Thanks Brother, ~Wings

I sent them copies of the regulation. Didn't make a damned bit of difference, so I finally faxed them a filled out copy of the form and no reduction happened.

USAF 1980-1986, 70% SC PTSD, 100% TDIU (P&T)

1st a general rule of tumb- if your IU has been in effect over 20 years then you are at home plate, unless it is proven that you gain the benefit criminally. If your IU benefits or any percentage has been in effect less than 20 years, then you can have your benefits adjusted to lower levels if improvement is shown. What are your chances of a proposed reduction? I would say "fair" if you are between 20 to 45 years of age and "Slim" if over 55. In my personal expirence if you have a one condition that u are IU for it raises the likelyhood, but if you have multipal conditions it lowers the likelyhood. Hope that helps.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1.       Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1.       Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
