Question

I HAVE BEEN WORKING HARD WITH MY HUSBAND TO GET HIS CLAIM DONE WITH THE VA, FIRST WE FILED FOR SSD AND HE WAS AWARDED THAT WITHIN 6MTHS OF FILING. THEN WE FILED FOR

HIS VA SC DISABILITY, WE WAITED 13 MTHS TO GET A C&P, WE DIDN'T KNOW ANYTHING ABOUT

TDIU AND P&T WHEN WE FILED, I FOUND THIS WEB SITE AND IT HAS BEEN SO MUCH HELP, MY QUESTION IS SHOULD WE WAIT FOR HIS APPROVAL BEFORE WE FILE FOR TDIU AND P&T OR GO

AHEAD AND GET IT IN NOW, WILL IT SLOW DOWN HIS CLAIM, HIS DOCTOR SAYS ONE OF HIS

DISABILITIES ARE FROM A SC BACK PROBLEM AND THAT IS WHY HE CANNOT WORK, HE ALSO SAID

HE WOULD DO WHAT WE NEED TO HELP US OUT, THAT IS HIS ORTHOPAEDIC DOCTOR, THANK YOU FOR YOUR HELP B)

WELL IT IS ALMOST THE NEW YEAR AND MY HUSBAND AND I ARE HOPING TO HEAR SOMETHING SOON. WE DECIDED TO WAIT IT OUT TILL WE HEAR SOMETHING, DID IRIS AND SAID HIS CLAIM WAS AT THE POST DETERMINATION STAGE SO WE DECIDED TO NOT MESS WITH IT RIGHT NOW AND NO WE DO NOT HAVE A VSO OR ANYONE HELPING US, I DO DISABILITY , COMP AND AUTO FOR A LIVING FOR THE DOCTORS OFFICE SO I JUMPED RIGHT IN HEAD FIRST, THANK YOU SO MUCH FOR ALL YOUR HELP AND I WILL LET YOU KNOW WHAT WE FIND OUT. :D

If he gets a rating of 70% or over the VA is supposed to consider IU if they have evidence he is unemployable. You will probably have to send in the IU form at some point. With the SSD information you can pin point exactly when he had to stop work.

They can go back one year from the time they first rate him as IU to award retro.

We are hoping and praying to get a good rating? It is a long wait and tons of paperwork as you all know. Where do we get the IU form? or P&T form :blink:

Here is the TDIU form.

Under # 18 Check yes and then under # 25 Remarks-refer them to additional page with C file Number,name on it on it and tell them what the SSA award is for-if he gets SSA-

If the SSA is solely for SC conditions they must consider the SSA findings-to include the date of unemployability.

Somewhere hear said they can go back about 17 months- for the EED- I know in my husband;s case they (VA) awarded for the same date SSA did- which was one year prior to his actual filing date of his VA claim.

Under the Remarks page tell them anything else that could help support a TDIU award.

SC meds could prohibit employment due to thir side affects and if a vet is ever turned down by VA Voc Rehab solely due to their SC this too is evidence of unemployability due to SC.

Yes he get ssd for DDD of back, pain, and the meds the va gives him, he was in

a car accident while in the service, he has been getting ssd for about 2 years now

And monday we go to the VA to set up an appt for a neurophscy ??? eval

I would really like to see him feel better about life in general, Thank You

Well just an update, Hubby called VA 1-800 # and spoke to someone who told him

to be watching for a letter, I guess we will find out what rating they gave him

soon, I have already been printing out forms for tdiu and reading how to do a nod

because by the way you tell it the fight has just begun,, thanks hadit for all your

help

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1.       Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
