Question

i am sick of the whole mess i hired lawyer sent papers today. these vso's act like you are a pile of s--t when you try to get info out of them.i am sick of it ,they are worthless and more likely are to damage your claim rather than help. legal help for vets

is who i got . they were kind enough to extend my time for holding my files and i decided on them ,michael viterna.

if i do not hire lawyer i am going to really get screwed . this vso s--t isn't worth a damn and i am tired of their condescending e-mails when i want a simple answer.

i have no faith in vso's anymore and do not see what purpose they serve they sure haven't helped me ,what i have got was on my own.

they should be barred and let lawyers step in from the start,that would stop the backlog. the lawyers could get it right from the start and cut down on appeals .

thanks pete i filed for increase and dependency at ro somehow it wound up at appeals mgmt and was sent back to ro for more development. my poa did not know s--t about what was going on and complaining about her workload. she kept on saying let me know when you get a letter. hell when i get a letter it will be all over with.i just do not think my poa has my best interest at heart. and i am afraid they may have considered this a nod on my last award in sept 08. no one will tell me anything.

Do you believe that some times POA's tend to by pass the difficult claim and go for the slam dunk ones. I many times have noticed the appeal that takes research and study by the POA--appears pushed a side. Which I would question why?? POA's are not paid a contingency fee/percentage?? Yes, it takes more time on the difficult claim of their eight hour day. So what! Possibly it boils down to they processed one difficult appeal that day versus five slam dunk claims. I am basically referring "slam dunk" claims as the Agent Orange (not all) claims. Many--such as cancers (prostate, CLL, Lung, multiple myeloma, etc.) are going to be approved, once definitively diagnosed and in country service proven. What brings in much more difficult work by the vet and POA is the secondary/aggravating conditions that surround many ailments. *I am using the "slam dunk" term as generic---I do not mean to imply that every ailment/disease I've mentioned is approved without a hitch or delay. Respectfully, many still take a lot of time and hard work by all. The problem is finding some one to do the "hard work" and that is some times why many have chosen to hire "attorneys".

i would agree with your assessment of the slam dunk theory,they can go for those and attest to their victories and forget about the hard ones.

there has always been doubt in my mind about these poa's vso's who are in the same building and do a qiud pro quo allegedly.

i have had a difficult time with my current poa and feel like i am intruding on her space when i ask a simple question.

she says wait until you get the letter and let me know ,but when i get the letter it is all over with then. what good will that do ?

while my claim was at appeals mgmt. she did not know why or how it got there or what was being claimed .

i am sick of them and they should be investigated to see if they know if they know what the hell they are doing.

naturally if they can get a case that is obvious that it will go through they will jump on it with minimal work to do and get recognition for it as a success in their cap.

however there are some dedicated poa's and vso's but i have not met one yet.

Present your POA with a CUE claim and watch their reaction. They will probably tell you it is hopeless without even looking at it. Unless you claim is the original Slam/dunk I would hire a lawyer. We have that opportunity now, but who knows for how long?

my poa is the worst i hope i can get every thing to this lawyer before anything goes

haywire and he gets a chance to straighten it out. my poa has discouraged me from several things and really has tried to put me off. it is a taxpayer institution and i have not been getting my moneys worth "state veterans affairs commission."

i complained to my senator about this outfit and thought i would keep them as they started answering my e-mails .

before every time i tried to call the director was in florida for something or another on my dime.

i plan on giving them a little piece of my mind before this is over with.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
