I had exams that were a product of my 2005 remand from the BVA, they sat around at the AMC collecting dust as they claimed that they were waiting for stressor verification to come back. I took the initiative and requested a copy for myself and then as I got mine the AMC magically got theirs. They then scheduled me for exams and the exams went pretty well, one PTSD and the other for my foot. Except the doc on my foot failed to opine if he thought the injuries that were well documented in service, and needed surgery giving me limited plantar flexion, were shall we say "Service Connected." Well the PTSD exam went so well that I now take 2 medications and of course I guess they did not like the VA examiner giving me the benefit of the doubt so I am being told by the contact in the AMC that they will be scheduling me for new exams. I also have to get more evidence myself from an agency in the Army I used to work for. I did speak to the Director of Accredidations at that agency whom informed me that the records they had on me were limited as they did not keep detailed records from as far back as the 1990's. I am so angry right now that I am afraid if I go in to another PTSD exam I will tell them how I really feel, and find myself unable to go home if you know what I mean. Ugghhhh!!!!!

Well, I got a call from the local clinic. Now they are telling me that I have an appointment for my shoulder, arm, hip, knee, and ankle. I have an open claim on my ankle, and get 40% disability for my arm. So what is this about?

Not easy to tell except apparently they are working on your claim. Don't miss any of the appointments.

If you can't go home after the C&P exam all the better for your percentage. They won't keep you long. The last time I got put away resulted in an earlier effective date for my TDIU. All they care about is CYA if you tell them you are suicidal. If you stay at the VA State Farm for a few days and then tell them you no longer feel like killing yourself they will cut you loose pretty quick. Do you have a wife with your health care POA? They can release you into her hands as long as you tell them you don't feel like offing yourself anymore.

No, I have an ex-wife and don't want to have her with my POA. My girlfriend does not have my POA either. I do trust her. This appointment is for my shoulder, arm, hand, hip, knee, and ankle. The only claims I have are for my foot, and PTSD. I am guessing they might want to see if they can reduce my arm which is at 40%.

Went to the Appt last Wed and it seemed to have went well. I got the C&P exam copy, and it basically said the same thing as the last exam. It points to the incident with my foot happening in the Military which I hope is enough for the rater. Also the examiner points out that my foot in in 40% Plantarflexion in the neutral position with movement of 5 to 7 degrees, and the foot is dorsiflexed between 37 and 40 degrees. Now when we were in the exam room he said that I had fixed dorsiflexion. I hope that is how the rater sees it, which alludes, but does not state ankylosis which is crucial. Any thoughts?

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
