my anxiety must be sky high today....i got into a fight, yes a fight, in the parking lot of the VA this morning cuz some stupid bitch thought she was entitled to whatever parking she wanted. never mind that i had been waiting 10 min for that particular spot and she just drove around to it! never mind that i am the vet and not her! fu(#ing heifer was in a yukon and i was in a minivan. she won the spot after hitting me with the vehicle and i jumped out after her ass. before i knew it, i had grabbed her and almost punched her in the face. someone caught my arm but i completely lost it.i find another spot and when i get out of the vehicle i notice that the man who just pulled out decided to piss in the parking spot. i only realize this after i step in it....i go in and have a session with a new intern. shes pissy cuz im late. im still shaking cuz of the bitch in the parking lot. so the session ends and i head down to c&p to see if i have to sched the appt or they sched and inform me. the lady there was apparently the head of the welcome commitee cuz, well, she was rude as all get out! i told her it was an expedited claim. she informed me that she didnt care if the head of the va himself was handling it, it doesnt matter, it will still be several months out. i bite my tongue and walk away. 2 hours go by before my next appt for ptsd group. i get to the group room only to be told it was cancelled this week and nobody told me. i leave pissing and moaning. so,, on the way home i decide to call the school bookstore to see why they gave me the wrong book for class. we hand them our schedule and they get the books. stupid me trusted them! im told i need my sched and my rcpt to get an exchange. sched is no problem but i do not have my rcpt. they told me tough shit, buy another book at full price. sell book back as used. ummmm - NO!!!!

im ready to explode! i just dont think i can take any more at this point! and i even took my meds today. today just feels impossible.....

if u have requested and been granted an expedited claim, can they really schedule the c&p exam out several months? isnt that kinda stupid and defeating the purpose of expedited?

if u have requested and been granted an expedited claim, can they really schedule the c&p exam out several months? isnt that kinda stupid and defeating the purpose of expedited?

Probably alot of stress coming out of working on your recent ceremony.

In my opinion "expedited" just puts us in a different line.

I know the VA is frustrating but you must use your head. The way to beat these guys is clear thinking. If you lose your wits you will lose your claim. You are dealing with idiots and people who don't care if you live or die. Play the game according to the rules and then shove it up their ^^%$.

Try to take it one step at a time. Do make sure you do take all of your meds as directed.

In my opinion the claims process is designed to wear you down.

They want you cave in and give up.

Once upon a time, I thought the system was to help me.

I sure got a rude awakening.

My last battle was a long almost 7 years from the R.O and then sent to another R.O

off to the BVA and remanded to the AMC and denied and back to the BVA Judge

who awarded me Service connection.

That was a long time for me.

It was the worst years of my life, for I was always having to watch out for pot holes set out

for me by the VA.

Had it not been for the members of the board, I would never be able to type to you

as a service connected veteran.

Lot of stress. I usually put my blinker on when I wait for a spot cause it all depends on which way they back out doesn't it?

She probably was a VA employee to boot. I have written to the Director and asked many times to make enough parking available for Veterans and to make the lot off limits to VA employees. After all most of us are disabled and most of them are not. If the employee is a Veteran or has a disability than make some spots available for them.

Hang in there in time you will not even remember the idiot. If she keeps it up Karma will bite her in the azz.

Veterans deserve real choice for their health care.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
