Hello All Hope All Is Well.

If this doesn't pop your bubble I don't know what will.

Some of you are aware of my situation and the East Orange VA Medical Center.In my attempts to resolve falsified documentation and progress notes.

After contacting nearly every Various Agency regarding these concerns,only to be redirected back to this Facility to Include especially SECRETARY SHINSEKIS OFFICE and his wonderful,courtesy,professional STAFF whom never responded to my letter to date.A secretary placed a call to OIG, who called me on Friday and accused me of bodily harm to the director of this facility imagine that.Now mind you I have bad legs spinal injury and 50 years old and high school was over 35 years ago.The arrogance of this guy who spoke to me was like a street punk no professionalism at all,I did explain to him that I will never NEVER return to this Facility in this life time.And I asked him for his supervisors name and number and i will be contacting him on the behavior of this representative of Office of Inspector General.

Needless to say i called today to speak to the Secretary Shinsekis Secretary to explain what has transpired on Friday,Only to be scolded by this individual and threatened me with law enforcement action.Sure as the sun will rise OIG was at my door giving me a WARNING not ot contact any Various Agency till further notice.

AND YET I WHOM SERVED BACK IN THE SEEVENTIES THE ARROGANCE OF THIS WASHINGTON DC PEN PUSHER SHOULD BE SO ASHAMED OF HERSELF TO BE A REPRESENTATIVE WHOM ARE SUPPOSED TO BE IN PLACE TO ASSIST VETERANS WITH ISSUES.

At this point these individuals whom live off the TAX PAYERS should go and pick up a weapon and serve before they know what the heck they are involved with half of these pen pushers are not veterans.

All I can say Is I am ashamed to be an AMERICAN CITIZEN AND A VETERAN WHOM SERVED PROUDLY TO be BELITTLED BY THESE ASSHOLES.

SHAME ON YOU ERIC SHINSEKI AND YOUR ILLICIT STAFF.Take responsibility for your endeavors

Hello All Hope All Is Well.

Yesterday received call referencing (FEE BASE CARE) can someone explain process to me please thank you.and requirements.?

As for my care at this facility even when I send a COMPLETE REBUTTAL as to what is and not facts of my care and inaccuracies of medical treatment.I am still very uncomfortable for my well being and care here.Was removed by VA POLICE in the past? Without just cause.

I contacted HOUSE Sub Committee of Investigations Veterans Administration.M Shorter.

His Advice due to Pending Investigation by OIG Criminal Investigations he could no longer address or assist in any way until completed.

I also contacted OIG Agent posed this question to him Referencing continued Health Care negligence and as to where to go and that I will not return to a facility whom for whatever reason can say make up or accuse me of anything they choose just to lock me up.

He told me to go to any other facility than if I choose although he stated you are allowed to return to this facility.

I said to him now why would I go to a facility whom have abused this power?

And not to be let out no ACCOUNTABILITY where as I have been forthcoming and transparent.He then continued to say as for the alleged threat is all they are concerned with.NOT the lack of health care or anything else. Imagine That !!!!!!

It boils down to their word against yours, about the "bodily harm threat" thing. Unfortunately, in the VA system, the gworker's word is always taken over the Veteran, while it would make sense that a Veteran has sacraficed MUCH MORE than a gworker, and therefore, has a much higher committment level. The Veterans word should be taken over the Gworker. You know, kind of like the police officer's word is accepted over the criminal. We are the ones wearing the uniform! Its all backwards.

I would advise you to keep your goal in mind. If your goal is revenge..it wont happen, and you need to forget it and take refuge in your God. If your goal is to obtain a certain benefit, then you are much more likely to achieve this if you remain cool and collected, and patiently state your case. It almost seems as if you have, at least in part, achieved your goal with the "fee basis call".

That is, you said you didnt ever want to go to the VA again, and it sounds like that opinion is mutual..that the Va is offering you "fee basis". By offering you fee basis care, the Va is saying we will pay your medical bill to keep you off the VA premisises. I think I would oblige them, then savor in your victory! I cant get "fee basis" except in special circumstances, so you are getting much better health care than I am, because private industry health care is superior to the VA, in part, because it is easier to sue a private doc for malpractice than it is to sue uncle sam for the same.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
