Compensation For Children

I applied for VA compensation Feb this year for Bi-polar disorder. I was awarded 70% in JUly. I understand this was very quick. I have 6 children. My children were not listed on my application so I was advised in award letter to submit info. I did and was awarded funds for four of them in Sept. I was told that 2 children could not be awarded funds because VA neded their birth cities. I know that I included this and called the 800 number. They confirmed that yes I did include it and that a clerical error was made. However now the processs has stopped. Whenever I call now I get a different message. One rep was so rude as to tell me that there are Agent Orange vets still waiting and that my extra 20 bucks a month would have to wait. I in no way mean disrespect for the Vets who have had to wait years but as a disabled Vet with six kids and a wife need this money. It is for my child who is in highschool and one other so the amount is actually over 200 a month. Going back to Feb this amount is now over 2000.

Any suggeststions for how to get a nice answer and hurry this up at all. I can wait but sometimes when reps check they cannot even find my kids listed.

Second, my VA psych dr has recently noted in my charts that my status should be unemployable.. do I need to appeal original 70% or start a new claim if I should be100%. Right now it is 70%Bi-polar and should have additionally diagnosis of PTSD related to sexual trauma aboard a ship but I am not confidant that the assault was ever recorded in my records.

Any help would be great.

I would write them a letter with my C file on it and put Attention to and then put the initials of the rater on the most recent decision you got. (The initials of the rater are with the numerical RO code in upper right hand corner of the decision.) and put the Attention to initials on the envelope as well on top of Department of Veterans Affairs etc etc

You have every right in the world to get your dependents included in your comp check.

In the envelope and also referred to in the letter I would enclose -if I were you -the TDIU form unless VA sent it and you responded with it already.

With the 70% rating the VA should have considered you for TDIU and sent you the form or given some good reason why they didnt.

.( One rep was so rude as to tell me that there are Agent Orange vets still waiting and that my extra 20 bucks a month would have to wait. I in no way mean disrespect for th"....

The new AO vets are getting exempliary claims treatment and their claims are being handled independent of the main RO claims. This rep should be reported to Sec. Shinseki's office.(Public Affairs division-)

And apply for SSDI!

Are you dealing with the Louisville RO?

Who did you use as a VSO and from What location.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Thank You for your help.

I met with a DAV rep out of Ft Thomas thurs but I am not sure I was given correct info.

She told me that I could apply for Total and complete at the same time as TDIU but if I was denied Total at a later date but was initally approved for TDIU, that I would have to pay back the TDIU if it was determined that unemployabilty was not considered service connected.

She also said that if both was approved since a person could not collect both then both would cancel each other out and pay would stop until it was determined which was correct.

When I called VA 800.. I was told NO to apply for both and that total and complete always takes precedent over any other awards. Even if I was approved for TDIU then since complete is complete, nothing would cancel.

I am just afraid to apply for TDIU be approved and then later have to repay money..

She advised that apply only for the Bi-Polar right now as I have been meeting with a therapist for PTSD but have not entered the PTSD clinic as the therapist thought I was fighting depression to much to go through the PTSD clinic which can be traumatic at first.

I was approved for SSDI in June if that effects anything.

My question would be Do you know if a person has to pay back TDIU if it is determined that although they are unemployable that they do not meet criteria for total and complete?

Should I apply for both at the same time or will they complicate my case?

I know this is not what you want to hear but it took me two years to get dependents benefits, and even then I was shafted on the effective date for dependents benefits, requiring appeal review. Its not settled yet from years 2002-2006. Remember, the way things are there is financial incentive for the VA to delay your benefits as long as possible, because no interest is ever paid to a Veteran. Every one else in the world, it seems, deserves interest, except Veterans who do not.

When I complained about the delays on dependents benefits they said they would be included in a new RO decison which was forthcoming. There is a "culture of denial" in the VA, which is even present on some of the other websites, where past and present VA raters offer comments on Veterans cases.

This DAV rep has me a little worried about their advice to you. She really has confused you. You may want to consider the AL instead of these folks.

Now the VA will not pay for 2 conditions to the same body segment including mental health. What they will do is take the most severe one and connect it.

They are not going to stop your comp unless clear and unmistakable has occurred on your claim. I certainly does not look like it.

The 2 children that are not listed by the VA: Re send their information to the RO. Ask for them to be retroactively added as your dependents.

The VA may be a little stressed because the AO vets are being comped for the new SC issues related to the Agent Orange changes in the rating criteria with the new added conditions.

This should have absolutely zero effect on you,

You should file for IU based on the fact that you are on SSDI if the SSDI is for your mental health issues.

Look at it like this: Your VA benefits is not a handout or a gift from the VA. It is an earned benefit that arose from being a veteran and suffering from a disease or injury incurred while

you were in service. It is a matter of legal precedent..

Keep focused and do not waiver or give up.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
