"The VA currently has a backlog of about 850,000 claims." Holy crap!!

"“In 2013, our goal is to ensure that no more than 40 percent of the compensation and pension claims in the pending inventory are more than 125 days old,” Shinseki said in his testimony to the Senate Armed Services Military Construction and Veterans Affairs Subcommittee." That's great but there are still more than 9 months left in 2012. What measures are they taking NOW??

From watching Hadit it seems to me that they are starting to bring the back log down. Was over a million a while back and now it seems we have success stories every month instead of in bursts once or twice a year. Lets say I am cuatiously optimistic although I now have a claim that is 20 months old and stuck in Waco quagmire

Veterans deserve real choice for their health care.

Whatever they do -

I wish they would also make more effort in training and raise the expectancy

level of accuracy in adjudicating claims, to higher than 70 percent.

IMO - much of the backlog is due to inaccuracy during adjudication

which leads to appeals.

Does anyone have a number on how many of the 850,000 current claims,

fall into the APPEALS category ?

Carlie passed away in November 2015 she is missed.

Carlie, a 30 percent error rate would not be acceptable for the post office. I worked for the post office and when we got a case check we had to have a 95% accuracy rate. We did not even have to have a HS diploma. These VA employees could not even make it on the graveyard shift at the post office.

There may be a small decrease in the backlogs but the overall number "they" have reported is lower than the total,,,appeals also number. I posted a comment on the backlogs situation about 3 or 4 months ago and it was nearly 1.3 million or more. I also reported that during the reign of Jim Nicholson as Secretary, he reported to the House Veterans Subcommitte of a backlog of 750,000 in 2007. That number brought the dismay of many of the subcommitte members as unacceptable . Promises made to reduce it and the total number of days then to adjudicate a claim was 173 and he announced he was trying to bring it down to 145 which his answer was labled as "appaling" by one commitee member. Nothing has changed really. The number has continued to climb and I only can see the number has slowed some due to the hiring of 3500 new adjudicators 2 1/2 yrs ago to help with the Nehmer and Vietnam Era backlog. They have not finished 2009 claims and appeals. Mine was just awarded from 2009 NOD at the DRO.

Carlie is directly right on target. It is the fact that the adjudication process is so bad that the appeals process is backed up. The ROs cannot make a simple determination and have caused this huge problem. My claim is not different . Awarded a few which never should have needed a DRO and taken 5 years. Then to top it off they missed the Pulmonary Hypertension completely which results in an appeal and more dead time and delays.

John , how can ANYONE run a business like them and get bonuses and raises and even keep their job? It is so incredible.

Carlie ,,,back to your question of appeals and the number. I said the backlog is 1.3 million but they are saying 850,000...... both of these numbers do not take into account the appeals process alone. It must be staggering. Just think of how many of our Hadit family has appeals going and then look at how many Vets are not members of Hadit and are appealing. I would love to see that number from someone ....... and I do not want to see some VA propoganda to mislead us and Congress by giving us some number that is incorrectly lowballed. Good question and one that needs to go to the next HVAC or SVAC meetings.

It is so frustrating to see this fiasco... and as you pointed out Carlie, it is unecessary.

Above all every Vet because of this problem must dig in and NEVER GIVE UP. God Bless, C.C.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
