Military Pay In Lieu Of Compensation

Here's the details: I currently have a claim in with the VA. This claim is an appeal to my original rating. I just checked it on ebenefits; its under a pending decision approval. However, a new claim has been opened up, today, stating: "Military pay in lieu of compensation" This is current as of today. I think that is what the VA decided on my current claim which is still in a pending decision approval. Can someone tell me what does this Military Pay in lieu of compensation means? It also states it will take 95 to 138 days to process. Thank You

When were you medically separated? If you were separated with less than 20% between the years of September 11, 2001 and December 31, 2009 you may be eligible to have your separation converted to a medical retirement.

I did not know that thanks very much justrluck. I did call the VSO but he was meeting with a Veteran. His secretary said she has no idea what that means. Well, anyway, again thanks for the comments. I learned a couple of things already which i didn't know before. At least when my VSO calls me I will have some type of rebuttal to give to him. Instead of asking him well what should I do? Again thanks very much!!!

Your VSO may not have any info on this. Try: http://www.pebforum.com/site/forums/physical-disability-board-of-review.91/ and look for my posts. I have posted a great deal about the process, my results (granted retirement) and now am waiting for DFAS to audit my pay account.

Limbo is status quo for the VARO.

I find it interesting. I call the VA two different times. I got two different answers. They said it pertains to a pay issue. I could receive back pay or I could have my compensation used to pay back my severance pay. I don't know what the heck they are doing.

I just thought of a question; I am currently using Voc Rehab. If they did make a mistake and the VA recoups my compensation for my severance pay-I HAD NO CLUE- will they come after my Voc Rehab allowance rate in order to pay this off quicker? I am going to look at your links now justrluck. which the way my luck is, it's justmyluck!!!

Their recovery of your severence pay should only come out of any comp you are due, not any Voc Rehab money, so I wouldn't worry about that.

The reason the military only gave you 20% was to avoid military retirement which would have given you tricare and some other benefits. To get that upgraded to a military retirement is worth it in your case. Justriuk should really be able to help you in this case as far as advice. Get the maxium compensation you can get from the VA and just don't listen to anyone who tells you different. With your injuries you will be glad you got it while everything was still freash and you did not wait 20 years to try and get it.

I read, I believe, all of your posts. I find it interesting that we appear to have similar situations. I was discharged at 20% and received severance pay. I applied for benefits and received a monthly award. I am thinking its one or two things the VA is doing. I think either the VA did me a HUGE favor, which I don't see happening, by asking the Military to upgrade my 20% to at least 30% for retirement or they are trying to get the total amount of my severance pay so they can begin subtracting my disability payments from that. I am dead 50/50 on both. I don't see why the VA would be so kind to help me out like that-just doesn't make sense; then, I don't see why it would take 3-6 months just to get numbers approved with DFAS. Just call DFAS or send them an email. It will save A BUNCH of time. Perhaps I am thinking rational here. I think there is more to it. Not really sure what more & I did talk to my VRO. He doesn't know what's going on. He said this is an abnormal approach. So, who knows. I am prepared either way but I hate the waiting game. IT IS TORCHER!! I am serious about asking somebody to look at my PEB findings and discharge from the military to see about possibly having it upgraded. I don't see me getting retirement pay. I am still able to walk around and do some normal activities. I am with the VR&E attempting to get put back in the workforce. We have developed a plan so I am sure I can still work. This process is all new to me so I have no idea what to do. To be honest, I dont think my VSO has any idea what to do. He just rolls with the punches like I do. How would I go about asking to have my military discharge looked at for a possible upgrade?

@ John I see you are from Tampa. Ironic. I am coming to Tampa next Tuesday to find a cheap studio apartment there. Hope so anyway! I have alot going on but I have been wanting to move to Florida for a while. It appears the timing will never be right so one has to take it upon their self and just go. I narrowed my choices down to Orlando and Tampa. Leaning more toward Tampa. Great deals there;especially after the housing fiasco. If you know of anyone with a cheap little studio apartment or even a 1 BR in a good location, I would be more than interested in speaking to them upon my arrival. Probably a long shot to ask but it never hurts.

As for your comment, imagine that! Still taking the green weenie long after getting out of the Marine Corps!!

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
