Be Warned.... Claims Processing Are Taking Longer Than Ever

I'd recently went to my local VARO to see my VFW service rep to ask about my status ( I know what my results are but just waiting for them to type it up ). My VSO said that the regional office is " really really " backed up in processing claims. They have never mentioned anything like that before in the years that I have been dealing with them.

So now it does make sense. With the floodgates of Vietnam vets filing new claims for agent orange and all those Iraq war vets filing new claims and ALL at the same time, you can feel the VA system bulging worse than ever. Dealing with them for so long, you become accustomed to the usual wait, but this time its different.

Not sure about what your VSO is talking about, or just blowing smoke. A good way to put some air into what he is saying check the "Monday Morning Reports" from the VA. You can even check each RO by name and state.Also I am pretty sure you can go back a couple of years and compare.

The RO's are way slower than back in the days before Agent Orange but until we get a friend in congress and they light a fire under them or give them more funds. Or make changes we are stuck with it.

Good Luck to all who are waiting! Been there and done that. My last appeal took over 4 years!

How far behind depends on what VA Regional office your claim is with, they are all behind I believe, how behind it is depends on location.

I've had a few challenges, perhaps the same as you. I relate them here to demonstrate that we can learn, overcome, and find purpose in life.

I never knew this type of reporting existed. Very interesting. Speaking of my VSO, its not like that. They don't do anything for me, I do ALL my paperwork myself. I just need their " stamp " of representation.

In the army we use to call their type of job " shaming".

Get your claims in now because in two years we will be out of Afghanistan and it will disappear from the news. That can only be bad for vets since resources may be shifted to other hot spots. The public and even politicians from both sides are sympathetic to vets during war time. Then they forget!

It is taking way too long to develope claims and get first decisions. Add a few more years for appeals and you start to look at five years to get a half way decent decision for many. My CUE claim is headed for year number seven, and I don't know how long to go before I reach the end.

I may be nuts for saying this, but I suspect the next VA iniative coming two years after the Aftgan war would be....... CUTTING COST. Once the war topic fades away, VA will look for ways to trim. However, they will hire more processors to solve the current flux ( while never get rid of them later on ).

Its my cynicle side thinking of this, but expect the 3 year C&P Reevaluations to be prompt, brutal, and more against the Veteran in the future.

Its just how government works, we are the customers. With no wars going on, VA must justify the heavy budget they don't like to lay off people.

Yes, I think the VA may start to cut costs by raising co-pays for drugs and socking it to NSC vets first. They will move up the food chart to SC vets and just make small cuts to this or that program.

After the end of the Vietnam war and the end of the draft the G.I. Bill was gutted. Also, the kinds of C&P exams I got in the 80's were just a joke. If you did not have an IMO you were lucky to keep the rating you had and many vets were cut in the middle 80's. The C&P doctors only asked me two questions: Do you hear voices? Are you working?

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
