Tinnitus And Ptsd C&p

Well finally got some movement with c and p. Still don't quite understand why they waste money on a Tinnitus claim. That should be open and shut book, its not like they can say I don't have it. WOW just connect it or not don't waste good $$$ on something that proves nothing. I'm not claiming hearing Loss for crying out loud. But the exam went just like the other 2 VA and private LMAO. Then comes the PTSD exam, I really don't know how this one is going to pan out. No VA records different Dr. than the one stated on the paper. Anyway got 25yrs done in 15min LOL. Almost like a rush job. But, I must hand it to QTC, they do give the impression that they at least care and are very friendly all they way through unlike the abrupt attitudes and almost hatred you get at the VA hospital. So for that I thank them and will eventually see what they sent to the RO. So on to my orthopedic c and p Monday. Wish me Luck!

Update and Opinions blink.png I spoke with the QTC a few days ago just to verify my reports had been forwarded to the VA since supposedly they only had a week after exams to respond in kind to the VA. Low and behold I am told that they have not forwarded the exams to the VA. Guess why? No records from the VAexcl.png LOL. The clinic then goes on to state that they are awaiting the records so that an IMO can be performed. Anyone got a clue? or opinion good or bad? any would be greatly appreciated. Also anyone dealt with this situation before and what kind of timeline?

Currently, at the Regional Office where I work the following applies:

Audiology exams (for hearing loss and/or tinnitus) whether performed by the VAMC or by VA contracted providers, i.e. QTC, VES, MES ... require the examiners to have reviewed your VA claims file prior to rendering thier opinion about the eitilogy of your hearing loss or tinnitus. If they do not conduct a file review, the examination is not determined to be an adequate exam for VA compensation purposes. It is "mandatory" the claims file be reviewed by the examiner, or rather it is mandatory the examiner state he/she reviewed your claims file. So the examiner can give his opinion as to whether or not your hearing loss or tinnitus, is related to your military service. No review equals an inadequate exam.

The file will be sent to the examiner, or the file will be sent to someone else, who is able to review the exam findings of the examiner and your file. They will offer up an opinion about your hearing loss and how it relates to your military service. If the examiner/reviewer says your hearing loss and/or tinnitus "is less like than not related to your service", you will be denied. If the examiner states your hearing loss/tinnitus is "more likely than not related to your service", your exam findings will be entered into the Audio evaluation builder for hearing loss and rated a S/C percentage based on the predetermined "program" for rating hearing loss percentages. If you get an opinion that your tinnitus is related to your military service you will be awarded the customary 10% disability, there are exceptions when tinnitus is rated more than 10% but they are very few and far between. Hope this helps to understand the usual process for examining this condition.

thanks Harleyman! 10% on tinnitus. I believe the other issue related to the QTC was PTSD in which they needed the records as it was denied. Not sure if this is a provisional or not I can see my letters on Ebenies but no envelope at this point. I appreciate the information and will definitely be in contact once I get the BBE.

After your exam, the QTC doctor calls a number and verbally issues his report, which is then prepared (typed up) by their admin department. Then it is forwarded to a quality control department and once it is cleared by them it is sent back to the doctor for a final signature. Once the doctor has signed the final report it is forwarded. I've been talking to QTC 3 times a week for 3 weeks and for the past 2 weeks it's been awaiting the doctors signature. This process can take well over a month to complete even when they have everything they need.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
