VA Requiring Second C&P Exams?!!!

Rate this question

Mo

Question

Hello all. This is an update on my progress.

10/23- Review of PTSD C&P Exam

10/31 - Lower Back C&P Exam

11/19 - Claim Submitted FDC on EBenny (all DBQs, Med Records, Forms, and Sworn Declarations uploaded)

11/23 - "Gathering Evidence" Status

12/1 - Spoke to RO and VA had submitted a 'medical opinon request from outside dr"

12/3 - Received call from "Veterans Evaluation Services" in MN stating the VA is requesting a local medical provider to conduct the same 2 C&P Exams!!!

Has this happening to anyone else? Could it be good or bad news?

I filed for Depression secondary to IVDS, Bilateral Radiculapathy of lower extremities secondary to IVDS, IU, and increase in PTSD.

Any input would be greatly appreciated.

~Mo~

I had a similar situation happen. The VA scheduled a C&P doctor to do the exam and he did a great job listing all of my info but forgot to provide nexus. I got denied. So I waited for a while and appealed. I took my important info and sent it along with the form to congressman critter and asked that they submit my info for me to VA Regional Office. Suddenly from nowhere I get a new C&P exam. When I went to C&P exam I took all my info plus copy of previous C&P exam. I said I should have already been service connected for this and said "Hey previous doctor didn't provide nexus statement". She apologized for mistake. I couldn't believe it. She says this time you will get your nexus and I did. I couldn't believe it.  Suddenly service connection and and high disability rating provided by VA Regional Office. It is amazing how many hoops of fire you have to jump through just to get service connection much less a correct rating percentage for your disability. I have heard no so much from VA I am incredulous when I get a yes from them! I had a DRO appeal approved finally!

An off the wall opinion is that the VA has taken so much heat that they are trying to occasionally actually do things right!

I'm glad that things finally went to your benefit!  And, hope that others also benefit from the changes.

Glad to hear it worked out for you!

The nexus does not need to be from a VA C&P doc (unless it is solely for a PTSD claim). I had a VA specialist write a nexus for me once. Some VA docs are hesitant to do that.

I'm on my fourth c&p exam for the same condition. The first was done on my original claim a year ago, it was done great, but the doctor gave a different diagnosis because she didn't look at my records. I submitted for an increase a month or so later, and was given another C&P with VES...that visit went well. Two months later the VA requests yet another opinion, but this time with a dentist via QTC, this exam took 3 months for the VA to get the results back (the dentist just copied the notes from my previous exams and didn't even look into my mouth because he said he agreed with the evidence/diagnosis I provided lol). Just found out today from Peggy that the VA has requested a fourth C&P for the same condition...wth...it's like they are fishing for the results that they prefer! What makes this worse is that out of the two diagnosis's that the va is trying to decide which one to pick, they both have the exact same rating criteria, same etiology, etc as noted on my first exam. My first exam gave the VA all it needed to increase my rating, it should have been a CUE, but I filed a request for reconsideration instead. I have no idea what they are doing, but as I can tell I'm not the only one who is getting the same exams over and over again. Each time there is an exam it's 30 days until the appointment, and 1-4 months before the va receives them!
