filing intent to file''

I think I may have screwed up, I never sent in my evidence that I use a cp machine and  my VA dx of Sleep Apnea in my original ptsd claim as SLEEP APNEA SECONDARY TO PTSD.

So crazy me I got into ebennys and click on new claim write  my name and file number  and it said I am filing a new claim  so I exited out and never put what I was intending to file for and this morning the VA says I have a new intent to file claim and have one year to file.

I thought they would add this to my original ptsd claim S.A. secondary to this claim  instead they say its a new claim? &have one year to submit it.

what should I do? call the 1-800 and ask them to withdraw that intent to file claim

because now there saying my claim could take up to 10-20-16 to 5 -10 of 2017:sad:

 

Any suggestions?

how do I check to see if my VA dx S.A. OSA was submitted to my ptsd claim?

how do I check on ebenny's to see if this was added to my ptsd original claim?...it seems thinking back I did put the S.A. dx and the use of the cpap machine in my claim from my healthvet Notes...if I did then I do need to call and with draw this new intent to file....correct?

You do not need to withdraw an "intent to file" - it just sits there and if you don't file, then it disappears...

Here is my screen shot...I now have "two intent to files" b/c someone decided to open up a "new claim" for my L ankle increase separately.  Why??? I don't know, because is already included in my FDC which was filed on 1/12/16.  

Did you click on the link under the new claims (date link) and see what the claim says???

It is my understanding that if you have a claim already submitted and add more evidence, it will just be added to your existing claim.  I don't think you have anything to worry about.  I'm sure other's will chime in.

Ok

I got it now

Claims intake center in Jansesville Wi sent me  a letter today.It says on 1-22-16  I filed an Intent to file claim...you have one year to file your claim or it will be out.  ect,,,ect,,,

I did this on on ebenny's but I thought I was adding evidence to my now active claim   and I didn't know it was an intent to file, so can I just call them and tell them to withdraw the 1-22-2016 intent to file claim  I made a mistake on ebenefits 

As for as filing another claim I don't know right now? it depends on this new ACTIVE CLAIM. THE OUT COME OF IT?

On ebenneys it says my active claim is estmated to have a decision 4 16...to7 -16

 

any help from anyone?

yes mam  I did,

I am just confused rather or not to just keep it going for a while incase I do need to file another claim?

or  just call and tell them to withdraw the 1-22-16 intent to file.

if they treat this as a ''new claim''  its probably ok to just let it wait itself out   because right now I don't know if I will be filing another claim or not?  if I'm satisfied with my active claim   I am finished with VA Claims.

 unless I come up with an Agent Orange Disease later?

      Frost v. Shulkin (2017)

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
