DD-214-215 Army Review Board of military corrections

I been trying to get my 214 straighten out  and sent them all the records I had  but none was my Germany Military Service  I just found some old medical records/copy  in my C-FILE where I was treated for the flu and some other kind of Bronchitis...from  the dispensary  clinic on the compound where I was station...47/48 YEARS AGO

It has my name  service # and my unit I was with and location & what I was being treated for and the Dr's name rank!

 could this be USED as a record to prove my service in Germany?

I had gave them my unit and battalion name I was with and they said that's not enough evidence  its just your lay statement..I wrote them back and said well its the truth  this is where I was...they said without evidence they could not do anything.

I certainly understand now  and I may just forget the whole 9 yards.

  This is not for claim purposes but  personal reasons , so its not that important that I get the change made...it would be nice if all the dates were correct on my DD-214 but its just not worth the time and hassle to get my DD 214 corrected.

Thank you for your time and expertise on this Issue.

I will just not worry about all this anymore.

I recieved my denial today from CMD (Case Management Division from the

Army Review Boards Agency

251 18th St,South,Suite 385

Arlington VA 22202-3531

What I don't understand is all the records I could find and send in  that had my unit name and dates from Germany  was not proof enough.

And also the records I sent in from travel in country travel orders sign by my commanding office and my name and rank on it  to leave the compound and also the two DA Forms 137 Clearance Record from Germany...not sure about the clearance records from Vietnam but I'm fairly sure I had to be cleared.

no contraband was allowed at the Airport and they took a lot of my Pics and memorable- bella away from me I had in my duff Bag.

two DA forms 2496 this form shows the true dates I left Vietnam and when I sign the  extension for foreign service tour.  and the date I was not to leave.

 Disposition form and a DA FORM21-66-4  Enlisted Efficiency request. DA Form 3078 clothing request

The only records I could not find was the unit morning reports and what my Temp MOS Was (63-F   b/c obviously they never change it ? at my unit command or on my DD 214  but I never did my Primary MOS the whole Time I was in Vietnam   Well maybe a couple months before my company commander and Staff Sargent Request me to report to the TMP Motor Pool  &Ask for Capt Minton and Lt E.L.Thompson from the ''operations Branch''  HH Company SAIGON SUPPORT COMMAND  

Lt Thompson was my reporting officer  I went through him before leaving the compound to travel North in country in full combat gear/weapons/Ammo as in  M-16 AND 45 CAL Pistol  In Leg Holster and Radio Contact for Air Support..believe me I'll never forget those days.

As I understand it my unit is dissolved now and no longer exist after 1975  the fall of Saigon   which I was long gone by then.

However CMD ( Case Mangement Division) is only going by what is on my ''orginal'' DD-214...And its wrong this is what I wanted to be corrected.  but it is what it is

BCMR rejects about 98% of requests for any change in your service records.  If you really want to fight on their terms you need a lawyer who can do it for you.  I was trying to get some medals and to get them to admit that I should have had a medical discharge with pension back in 1971.   First, they informed me that the 15 year time period for filing a claim had run and that all my facts were of no import anyway.  I thought I might get a minimum of respect from those guys but found the to be Azzholes of the highest order.  I do have "Vietnam" on my DD214 or the only other way would be for me to depend on medals and my sick records from Nam that I do have.  I could not even prove I was there but I do have a load of personnel records but almost nothing on the DD214.  The Army or VA did lose all my AIT and Basic medical records and almost all of stateside records one of which I needed for a TMJ claim.

I agree with ya John  I may as well just forget about it   it is not hat important anyway  no claim or anything like that...I had my medals and CIB on my DD 214 and my unit ,I work out of the operations Branch Sec of my unit in transportation

Had I known then what I know now  I'd saved every damn thing on paper I got my hands on.  I throwed away a lot of Itinerary  stuff /old orders ect,,ect,,,   never figured I'd need them years later.

      Frost v. Shulkin (2017)

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
