New Claim Appeared Automatically

Question

I logged into my VA.gov account today and noticed it said there was a claim for compensation started. I never filed a claim on my end. I’m not sure if it’s just coincidence, but there’s a few things that strike me.

The claim is dated for today(June 30th, 2020). My last claim was July 1st, 2015 which was a re-evaluation. I was called for a C&P exam back then, can’t remember if it was before or after this date.

So it’s been almost 5 years exactly, do you think this was automatically triggered by the VA to do a re-evaluation of my current status? I honestly can’t think of anything else it could be.

One last thing, I submitted my taxes this morning also. I’m currently rated at 80%, but getting paid for TDIU. On my taxes, the only income there was to report was around 2k in hobby income, in which my expenses almost matched(few hundred dollars shy, I believe).

I know I shouldn’t be as worried as I am, but the paranoia in me says that they saw this tiny bit of earned income and requested a re-eval. I can’t say for sure, the status of my generated claim says they’re still adding details and to check back.

Any ideas or info on the matter is appreciated 🙂

MarineLCpl If you call and get the document from the contractor, let us know. Usually, they will tell you that you have to get it from the VA. It would be interesting if you were successful.

I just noticed the same thing on va.gov and eBenes this morning. There is a new claim, for a condition  I was already service connected for in 2016, effective date 2014, and new effective date and increase per BVA 2018.

And, now, suddenly a new claim, with completion a date 2021/2022? I have a pending supplemental claim for mental disability and a TDIU claim, maybe there all related?

Jamezam, in your case, when a veteran files a claim for TDIU if he/she does not specify which condition(s) causes him/her unemployable, VA can re-evaluate all the veterans' service connected disabilities. In other words, filing a claim for TDIU is like filing a claim for an increase.

My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions.

Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up.

I do not give my consent for anyone to view my personal VA records.

pacmanx1, I filed for TDIU in 2018 as soon as the BVA increased my Scheuermann’s rating and asked VBA to rate my migraines.

I specified Scheuermann’s for TDIU, I just had migraine rating increased to 50%, and pending mental conditions claim.

Could be 5/10/20 year review? I also have BVA remands and appeals in the works

Who knows, but can’t imagine taking until April 2021/2022 for the TDIU.

Thanks pacmanx1…

Well, I haven’t had any mh exams since 2015 when I was rated P and T. Self schedule appts, yes, but not anything VBA required.

They closed the claim already..16 day process, I’m in shock. eBenefits is still saying 70% for PTSD, so it looks like they continued my current rating. BUT, it appears they granted P&T status. FINALLY, lol still not sure how it changes anything, tbh, I’m just glad they didn’t propose to reduce...that would have been the last thing I needed. No 100% either, as I figured. Honestly don’t think I fall into that range, so I’m not upset about that per say.

Cool, so at least that is a peace of mind on your part. There is a lot more that goes into a reduction of a P/T rating. Was that just for that contention?

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)
