Cardiovascular-renal disease?
According to CFR 38 3.309 chronic disease (A) Cardiovascular-renal disease if manifest within first year of discharge shall be presumtive service connection. My question is that I need clarification of the law as I had renal disease leading to renal failure, however I never had any cardiovascular problems. I am trying to get my chronic kidney disease services connected based on the stated law above. Can anyone help clarify please

Bruxism
If I file for bruxism secondary to ptsd, would I receive a rating for bruxism or would they just call it a symptom of ptsd and not assign a rating? If bruxism is service connected, does the VA have to cover your dental?

Asthma
I'm getting ready to file some claims in January and one of them is asthma under the pact act. I have a PFT from a year ago and use a rescue inhaler along with a daily steroid inhaler. My question is: 1. Will the VA accept a private DBQ using my PFT results from a year ago or will they likely require an updated PFT? Thanks

SMC increase
I am 100% P and T with SMC-S and have filed claims to reach SMC-M 1/2. I filed 11 claims 9 of which are related to Parkinson's disease. and two to service-connected Stage III Kidney failure. The VA has already given me 30% for Bowel problems because of PD which was 0%. A rating of 30%for bowel issues is the highest rating I can get. The rest of the claims are being deferred, because of the number of claims that have to be sorted out. On 9 of the exams the QTC MD found in favor of the things I claimed. Couple of questions . . .
I'm considering filing some claims for the following: 1.) In '71, I was involved in a near critical motorcycle crash/accident, excessive amount of speed (about 80mph) into a parked car in someone's yard (multiple fractures/3-4-day coma) which I finally recalled/remembered, in the mid '90's, (when some of my memory returned but I still have little memory of my 2 yr VN service), was a suicide attempt. At the time I had no memory of what happened, spent 5 days in ICU, for a total of 3wks hospitalization, and a few surgeries over the yrs for a non-union FX, from the crash. DC7332 Fecal Incontinence secondary to DC7319 IBS
If I file for fecal incontinence secondary to IBS, would I be awarded two separate ratings, for example FI 30% and IBS 30% or would they just consider the fecal incontinence as a symptom of the IBS and roll them into one rating and give 30% total for both conditions combined?

upcoming telehealth MH & cognitive C&P exam
i have a telehealth MDE exam soon due to a claim that was filed. looks like the exam is for depression, psyc dx, and cognitive assessment, through the years and currently. it's been quite a few years since i've had one of these and back then they were in person. any advice and/or tips for these modern telehealth MH appts? what to expect?

Bruxism secondary to PTSD
If awarded Bruxism secondary to PTSD, would I get a separate rating for the Bruxism or do they consider it as a symptom of your PTSD and just combine it with your PTSD rating? If they consider it a symptom, is there any way to get it as a separate rating? Thanks

Fecal Incontinence secondary to IBS
Going to file some claims in January. One of them is fecal incontinence secondary to my service connected IBS. The only tests that my family doctor did for the diagnoses was review my history, asked me some questions about my symptoms, a colonoscopy, did a visual and digital exam then made the diagnosis. My questions are: 1. Will the VA consider this a good diagnosis or are there other specific tests that they require? 2. Is my history and doctor notes good enough for the connection to IBS or do I have to get a separate NEXUS letter?

VA asking questions on injury background. Warranted?
Greetings all, I served from 1988 to 2009, roughly 18 of those 21 years were as an Army CID Special Agent. In 2001, I was shot in the leg, which destroy the femur. This occurred on a US military installation, however I was taken to a civilian hospital for the surgery and was later transferred to a MEDDAC. The bullet traveled through the femur, so a rod was inserted with two lower and two upper screws. I lost not only length in the leg (2cm) but my hamstring atrophied.
