Personality Disorder Labeling By The Va
Thanks for hearing me out. I know there is much discussion and debate on the term "personality disorder" being a reason for disability denial as result of C&Ps. Is there a way to 'correct' or deny this overused labeling term recieved from the C&P exams other than by getting a more clear diagnosis from an IMO or VA doctor? As I understand, many veterans are given this feedback and I am concerned that once given this feedback, it deters appeals based on deep personal insult. Bascially I see this as the veteran, an adult, that is facing one, two or a myriad of psych disability issues gains another 'worry' with being told they "have or possible diagnosis of" perso…

ptsd Zero % After Dro Hearing For Ptsd
Dear Tbird, This site is an unbelieveable blessing and, after more than two years of trying to prove service connection for my PTSD, I finally found the site a couple of months ago, after my Legion Rep told me about it. I have been married twice, most recently for fourteen years. I am a Vietnam and Desert Storm non-combat veteran and worked as a Hospital Corpsman from 1973-1992 mostly with the Marine Corps as a Field Medical Service Technician as a platoon corpsman , and as an EMT/Paramedic at Camp Pendleton Naval Hospital emergency services, and in the refugee camp in 1975 where all of my documented stressors occurred, along with caring for the sick and wounded return…

Esophageal Cancer (adenocarcinoma)
My late husband was a US Marine and served in Viet nam from 1967-1969. He was a machine gunner and stationed in I Corp among other areas. In 2004 he was diagnosed with advanced esophageal cancer. No family history, no Barretts. On May 30, 2006 (the day before our 37th wedding anniversary) he died from this horrible cancer. He was only 57 years old. I am interested in knowing if there are any vets on this site who have esophageal cancer. My husband was denied by the VA for compensation. I filed for DIC (had 7 doctor letters all stating in their opinion..) but the VA still denied my claim. I am now appealing. I have located through the internet approx. 15 w…

Ritalin And Army Enlistment
Army physical standards are covered in AR 40-501... enlistment standards are covered in AR 601-210. I am addressing this because there was a question about enlistment policies concerning Ritalin. Initially, as far back as 1995, if you had taken Ritalin and were diagnosed with ADD you could not enlist without a waiver, and the waiver was almost impossible to get. This policy changed in 2001 (imagine that!), and an enlistee was allowed to have taken Ritalin but could not have taken it for 6 months prior to the physical. They could have a diagnosis of ADD, but that required a waiver... but the waiver was automatic if the applicant had not taken Ritalin for 6 months and…

Suggestions Anyone?
Jerrel Cook just asked me to be his guest at startdust.com SVR vets broadcast this coming Wednesday 6:30 PM EST. http://www.stardustent.com/ In the past I discussed the AO issues etc- and the VCAA on the SVR show(Cong Filner by the way will be next week's guest again and I will be call in on my proposed amendment to the VCAA which he has-just was getting ready to mail him a letter-maybe just best to talk to him on the air- the show is taped and archived) I feel that I should do a review of the whole claims process - and offer some suggestions to the newly returning Iraq and Afganistan vets and those overseas who listen to the podcast overseas via their PCs---- …

Letter For Nod On Original Decision, Not Time For Form 9?
Greetings all: Recieved decision in May for a claim for increase. Sent a letter the beginning of this month stating I disagreed and would like to have the decision reviewed by the DRO. Do I have to do a form 9 now (i don't think I do), or when they issue a SOC? I Was feeling fairly secure about understanding of the process, but recent posts about form 9s have me questioning my understanding. I received my delivery notification on the NOD yesterday (sent certified Return Reciept). I will forward a request for a hearing with the DRO in about a week to go over the decision and what I think are the deficiencies. Probably get sent for a couple more C&Ps the…

ptsd Compensation And Pension Exam For Unemployability
i was awarded 70% disability for ptsd due to military sexual trauma 3 months ago. the examination was a horrible experience for me and threw me into a deep depression. i just received notification that in a couple of days i have to have another exam for my claim for unemployablity. i was told that i had to see two doctors this time. i am terrified. do they ask the same questions that they did the first time? what is the second doctor for. any advise on what happens in these examinations would be greatly appreciated and what things are they looking for. i hope that if i know a little about what to expect that i won't go into another severe depression. i have been …

Va Claims They Didn't Get My Appeal
Hi ALl, I received a SOC and I submitted a reconsideration on the 58 day of the 60 day limit. I hand carried it to the VARO and got a stamped copy for my records. SO said it was in stange 1 pre-determination a few weeks ago. I called the VA and they said they received no Form 9 or reconsideration and closed the case. Do I have any recourse at the local level to avoid the BVA? Am I forced to submitt a new claim and lose my retro date? I have proof I met the timeline. Thanks.
