Howdy Bro and Sis, If this is true then it is a HUGE VICTORY for Vietnam Blue Water Navy veterans: Mike ***** BLUE WATER NAVY WINS!!!!!!!!!!! From: "Pete McCaffrey" usmcisgt@hotmail.com To: vva@vva2.talklist.com Subject: GREAT NEWS for the BLUE WATER NAVY Date: Thu, 17 Aug 2006 15:54:34 -0400 Yesterday the Court of Appeals for Veterans Claims (CAVC) made a ruling that all Veterans that served aboard U.S. Naval ships during the Vietnam War are eligible to claim Diseases associated with exposure to Agent Orange/Dixon. The Whole Game Is Appalling!
I get so frustrated when I research sometimes. Time after time I see the BVA chastising the VARO, and the Court of Veteran's Appeals chastizing the BVA, and on up the chain. The BVA and the Court consistently say - "since the previous agency didn't do their job - we can't do ours." But instead of just over-ruling the previous agency - they just "imply" they were "wrong" and then throw the ball back to them - leaving the claim in VA limbo. It is almost like this is a game they play with each other - and the veterans are just the playing pieces...the pawns... check and checkmate! Couldn't they AT LEAST establish SOME type of FINE system.... to pay the vets a little…

Claims Flowing Throuigh The Va, We Need A Chart.
We need to gather information and put it together, I would be happy to summarize it. What we need for the vets at Hadit is a process flow for a claim. The VARO must have one for I believe it is required. for example. Recipt of claim. where does it go, then next, next, next, and so on and so on. This way a vet can ask the VA where a claim is and look the information up and determine what stage the claim is in in being adjuducated. Any ideas are appreciated.

Tort And 1151
Hi, What is the difference between a Tort and an 1151 claim? I know or at least I think I know, that a Tort would be lump sum and an 1151 is monthly as far as pay, but what are other differences? Is a tort harder to prove then 1151? How do you file a Tort and what is the time frame that you have to file a claim? Can you file both and if so why would you file both? Thanks, sbrewer

New Vcaa Notice On The Way! Thanks All!
When I looked at my VCAA notice - Under the Title of How You can Help and How Va Can Help You. it stated " No evidence to suport this claim has been received to date". I took everyone's advice, contacted my representative and called the Management Center and told Pearl, one of the counslors that can open a code 6, that my VCAA Notice did not look anything like the one that I downloaded from this site. She looked it up for me and said." this statement is not correct." She said, "I know that this is not correct, for I have seen your file". I told Pearl that I wanted it in writing what information, private medical records and what ever that they had from the BVA typed u…

Va Representative
Hi all, Can someone tell me if a person who works for the VA as a VA Representative. and you give him your application is that considered that the VA received your application/claim. The reason why I ask is that a friend of mind in the South submitted an application/claim by giving it to a VA Representative. Now the VA is telling him that his statement that he gave application/claim to VA Representative does not establish that a claim was received by VA. This is all they would tell him. This was not done through a Service Organization, because if it was he would have to have signed a power of attorney. If there are any regulations on VA Representative pleas…

A New Way To Deal With The Va.........
As I sit here at my desk and look around at all the B.S., all the paperwork, all the forms that I have or haven't filed or filled, I just had an FLASH! I am gonna download, copy and fill out and send in, one each of all the forms that VA has in their inventory. I think I will do this once a week, nothing fancy, no "Priority Mail" just a regular old stamp. This way they CANNOT say that I didn't file "timely" or I didn't "respond".......................... And I will do this UNTIL they get tired or overwhelmed and THEY will be the ones that GIVE UP!

Need Advice
I requested a ILS program in Feb 2005, I moved to Georgia in Dec 2005, so the request was put on hold. In Feb 2006, I went to a group orientation and watched a stupid film. It was determined I would benefit from a program of ILS. I saw two contractors, one interviewed me as to my needs, and wants, the other came to my home and took pictures, in preperation to do adaptive remodeling (ramps etc.) That was on 23 May 2006. My counselor told me another contractor would write the plan that was on 26 June 2006. On 11 July 2006 I was informed contractors cant write plans anymore because of lost laptop, and increased security. Was told to come in on 25 Jul by counselor and plan …
