Chapter 35 Need Help
Timeline My 100% disability date was September 18 2002. My son was 25 years old at that time. He did not turn 26 until eight months after eligibility. My award letter states: Basic eligibility to Dependents' Educational Assistance is established from September 18, 2002. He has an associates degree from before my claim. He wants to go back for his Bachelors. Questions - Can he apply (age 28) to finish bachelors? What forms? Submitted to who?

3rd Denial Letter
Aftyer six monthes of waiting for an ADMIN Review of my case it seems clear that VARO employees can't read. They seem to have no understanding of the rule on a "presumptive period". They admit that in a previous denial letter that they have records of me being "hospitalized" for my claimed condition within a year of discharge from active duty. Yet they claim I have to have been diagnosed with this condition while on active duty. Is it just me or does that argument for denial totally ignore the reason for having a "presumptive period". And of course they are still claiming that I didn't list a specific stressor although I did list that an illness that almost kille…

Need To Get It Off My Chest
I have finally swallowed my darn pride and admitted I need help and am going to the mental health clinic on Monday. Here are the reason why: I have been having chest pains with heart palpitations, sweats, and occasional numbness in my arm since 2001. This started after I had ran a 10 mile race. I went to the emergency room with the above symptoms a headache and a nose that had been bleeding off and on for 8 hours. Diadnosis high blood pressure. I then ran a race 2 weeks later (13.1 miles) after getting medical clearance from a stress test and heart doctor. 3 days later I was jogging home and my hip was hurting. Got home and sat for 10 minutes when I sttod up hip wo…

Compensation Payment
VA compensation payments are the same for everyone no matter what state they live in, right? For some reason I thought I read it was different from state to state. Also, when the VA finally makes a determination, what time during the month are the payments mailed? I read that your marriage license and birth certificates should be mailed in with the medical info for the c-file, is this true? Thank you Jangrin B)

ptsd Ptsd Claim Was Deferred
I found out that my PTSD claim is being deferred because they are still waiting on my mental health records from Ft. Stewart. I had the C&P exam for PTSD on Jun 1, 2006. I'll admit that it was hard to talk to the doctor about a lot of things, and didn't offer much information if he didn't ask. I had the exam before I discovered Hadit, and now realize some of the things that I didn't say may hurt my claim in the down the road. However, he said that he could tell that I was deeply affected by it and was still having a hard time talking about it. I am currently taking Zoloft. He said I have a GAF of 60. He recommended that I continue to seek treatment and continue wi…

Cbs Report
CBS nightly news is doing a report about the conditions at VA hospitals for the most severely injured vets many brain damaged. It showed two vets so far that have brain injuries and the VA cut both of them off from physical therapy after a few month because they said these vets who gave it all are soaking up resources. They wanted to warehouse them. The families are very upset to see their loved ones treated like garbage. These guys gave everything they had and now the VA says they are too expensive to help. I bet if Rumsfeld or Condie Rice stubbed their toes they would have the best medical care money could buy, but these guys who depend on the decency of the citize…

ptsd Helping A Freind
OK, I never post here anymore since I finally got my 100% scedular. I have recently met a freind Who return from Iraq a few months ago. In talking with him I (a layman) could tell he had some PTSD amonst some other disabilities. He is very reluctant to disscuss particulars. Afew weeks ago he tald me he got a backpay check from VA with no award letter. I ran into him recently and had the letter. He let me read it. His award was 50% PTSD with a 56 GAF. He had a bunch or denials on physical claims. I think in the physical he told them of the pain he had but not how it effected his ability to do stuff. All were denied because pain is a symptom not a disability. He has bad a…

Vike--- You Are Pretty Good! Heres One For You
Is it legal for the VA to continously seek unfavorable medical opinions to refute favorable medical opinions? I thought this was a violation of Marianao vs Principi/ Second when a board of 2-3 is convened shouldn't this include the Medical Providers who proffer different opinions? Can the rater slant evidence to nonservice condition when service connection has been granted? Anyone else please feel free to give opinion

hypertension Is There Such A Rating
My neurologist conducted a new MRI yesterday of my brain. He now says that I have severe "white matter disease" due to hypertension and DMII. The MRI was conducted as a result of my constant loss of balance which makes me fall to the right side and my now inability to reach and grab things with my right hand. When I reach for things my hand goes in circles and I miss the object by about six inches to the right. Is there a rating for White matter disease? It is basically lesions in the white matter portion of my brain from blood clots cause by the DMII that have travelled through my brain and successfully passed through without getting stuck and causeing a stroke. …
