Side Effects And Conditions
Berta I ask you and other this question because you seem to know a lot about side effects of meds. I am suffering documented side effects of a number of the medications I take from the VA. The pain medications, in particular, cause all kinds of side effects including depression, GERD, and even falling. The Va wants me to go to a Falling Clinic of some sort. Would these conditions be service connected since the meds the VA is giving me are causing new conditions? I am getting sick of the VA billing my insurance for conditions they are causing. Should I file for all these secondary conditions due to the meds they are giving me?

Va Answer
Hi everyone, On yesterday, we took Berta's advice and my husband went on the VA website an inquired about the VA in Tazewell, Virginia. He wrote: The VA in Tazewell, Virginia no longer exist. I submitted a compensation claim to them in 1958. It is my understanding that they have been closed for about 30 or 40 years or more. My question is (1) Where would the VA in Tazewell have transfered their recrods to? and (2)What was the date of their actual closing? (3) I would like to know what is the next direction that I should take in locating this claim. They forwarded his inquiry to the Regional Office in Hartford, CT, since we live in Connecticut. This is the answe…

Pacemaker/defibillator
I have just recently had a pacemaker/Defibrillator implanted in my chest on June 16th. I am already 60%SC and drawing 100%IU because of the heart. I have heard that I can indefinitely be given 100%SC for as long as the AICD (Automatic Implantable Cardioverter-Defibrillator is in my chest. It says this in Title 38 #7011. I am wondering what would happen to my P&T stautus?? I just want to know if anyone else has been successful changing from 100% IU to SC 100% using this device as the reason. This would give me back my full retired pay and would be worth approx. $14K in the next two years. I am looking for advice/comments from any one that can help me make a decision o…

Pva Vcaa Info And
http://72.14.209.104/search?q=cache:Jsaohs...=2&ie=UTF-8 This is the SOAR's pdf and I think the PVA has a good take on what I have been saying about the VCAA letters. Also . "In the case of Huston v. Principi, the CAVC held that VA must provide the notice required by the VCAA to claims for earlier effective dates for the award of service connec- tion. Huston, __ Vet. App. __, No. 01- 0575, slip op. at 9 (July 11, 2003). Th. Id." and there is interesting analysis of a CUE issue (Lane V Principi) as well as SVelha- taking into account the claimants severe mental disorder- and other good stuff-

hypertension Look At Your Evidence Thouroughly
We all have been denied on occasion. We submit claims to the VA then they send out notices and denial letters stating regulations and totally absurd crap. After having fought the process for the past 15 years I have observed as much as I could and have researched every BVA decision on the web. I have concluded that the deck is continuously stacked against the Veteran because of the following. The Military has extremely poor record keeping and once a claims folder is sent to the VARO, It is often not even examined. They just browse over it and miss pertanient evidence and issue denial letters. Often a poor Vet who gets the letters gives up and turns totally …

Bva Claim Misdirected
Hello, I've looked around here and in the FAQ's but didn't see my specific issue so I'll ask here. Recieved a letter from the RO saying they certified my claim to the BVA. Letter also said I would be contacted by the board acknowledging reciept of my claim file. After 45 days of no contact from the RO or the BVA, I sent an email to the ombudsman inquiring about my claim file. Took a week to get a reply, but was told they sent my file to the DAV for review. Problem is my POA is the Legion. Sent them back a email copied to the AL SO at the local RO. The ombudsman responded that there was no 21-22 in my file. I faxed down copies of both the 21-22 appointing th…

Interpreting Varo Silence As A Denial
Just throwing this out there for opinions, if anyone is so inclined. Can a VARO's non-response (since February 2006) be interpreted as a denial? Can one treat silence as though it were a denial, and then send a formal written request for the denial and an SOC? We're trying this to force a decision, one way or the other, so we've done this. I finally sent a "last-attempt" certified letter at the beginning of July, giving the VARO until 8/15/06 to issue its denial and an SOC, otherwise, I would seek a Writ of Mandamus. This goes back to my husband being one of the few veterans whose rating is 90% per the VA's use of unapproved, uncodified software, vs. 95% = 100% usi…

Va Watchdog
VA Watchdog has some very interesting information about vets who have more than one claim on appeal in the system at the same time. It seems the VA can grant or deny one claim and ignore the other claims and they are considered denied and the VA does not have to notify the vet.
