Losing The Battle

ptsd 3rd Denial
This may be the wrong area to post this, but for the 3rd time my PTSD claim was denied. I even had a damn letter from an old shipmate as evidence. My question is how do I find a lawyer ( Cheap ) I'm realy get close to losn it. the bank wants my house, truck, everything i spent my life getting is goin down the tubes. Gordon

tdiu Iu And Work
Hello, I'm new here and hoping for some advice. Receiving TDIU and working very occasionally (a few times a year) for a hospital, as well as a bit of self employment doing homebirths. I recently got a call from the VSO that they need me to fill out an employment form for VA, or my benefits will be cut, then got the same form from the rep agency in Oakland. First question for you all; how do I report my self earnings, or, how do I account for my expenses that I put down on the schedule C at tax time? Requested Service Records
requested copy of COMPLETE (medical and assignments) military records from NPRC 3 months ago. Any idea on how long it should take to recieve them. Also does the RO request the complete records or just medical records for the C-file? I was wondering if the RO gets records than we could get a copy of the C-file and we wouldn't have to wait for NPRC to get them to us. Thanks in advance, Jangrin :)

Vcaa Letter?
Berta, We believe this is an official VCAA letter which also starts the one year clock running. After much work and this being a real pain in the you know what, we think you can open this attachment and see the second of 2 letters recieved from VA. If you are interested in seeing the first because it relates to the DMII and seconday's claim, let us know. Also interested in your imput, we elected to hold off on signing anything until we have all medical and military and personal medical records we could get a hold of sent in to VA, then we will sign their no more inforkmation at this time. ptsd Should I Try For P&t
I have been discussing the posibility with my SO ( DAV ) of trying to obtain PERMINATE and TOTAL status. I am presently 100% Unemployable ( 50% PTSD & 10% Hearing ). If I decide to go for P&T status, do I have to go through the entire process again ( another C&P exam, submission of documents, etc... )? The only thing I would pick up if awarded the P&T status would be health coverage for my wife ( which she has at work). Kids are passed the age of eligibility for education benefits. I guess the question is do leave a sleeping dog alone. What would be the benifit of obtaing P&T status? My award was effective December 04. Input please.

Question For Berta
My appeal is sitting at the RO. The appeal if you will remember as you reviewed the original NOD, is on my stroke, stroke residuals, back and joint pain. In the SOC the reasons and basis did not contain ANY reference to the evidence submitted in support of my claim. I know they had it cause it was provided with the original claim and the NOD. The NOD discussed the evidence in detail. I failed to hit this issue hard on the VA 9 (their failure to provide any info in the reasons and basis) so I want to now submit a statement in suppport of claim outlining their failure to provide a proper SOC in accordance with law, the court and their own regulations to be attached to…

Where would the rating code be located? Would it be on the C&P exam report or would it be on the letter from the VA after they have finished making a decision? Thanks, sbrewer

Bva Appeal
My claims folder has been certified and transferred to BVA. I already had a BVA Travel Board Hearing at my local VARO which is also my AOJ. My file was transferred July 6, 2006. QUESTION: Can I still continue submitting info to BVA -- none of it is new medical info. What I want to submit is laws VA didn't go by, evidence listed but not addressed in Reasons & Basis - SOC's and SSOC's. Thanks, carlie

Medical Evaluation Board Chapter 18
Everyone said do your research and so I am. I came upon the MEBC on Determing Disability 18-11 it states Herditary and genetic conditions shall be presumed to have been incurred prior to entry into active duty. They will be presumed service aggravated unless evidence clearly establishes that the condition is solely the time result of the condition's natural progression. Ok would this mean that someone with spina bifida occulta qualify? Especialy when DR. said the aggravation has most likely caused his back problems. Plus he has an undeveloped rib ( two birth defects ).

Vike And All -new Ivds Training Letter Info

Vike- I can copy all this and snail mail to you as this will take me a long time on the scanner-easier for me to just copy- wish that link worked- but they said it was temporary- Let me know if you want it mailed and I will open my email addy and get your snail address. Va Regional Office , Double Talking
hello brothers and sisters , in arms i am here once again to say the fight goes on , what does it mean when they tell you we have proof of your illness in your service records but we show no record of you being treated for this illness out side of service . ok now you and i know what this means , specially when the only doctor you have seen sence being active is the va regional doctor and all of your medical records come from that one place , and you have several hundred pages of them treating you for the mystrious illness that they cant seem to find . is it truely the fact that they are overwhelmed or are they just that , i got fed up with the we cant find…
