Earlier Effective Date
Trying out cut & paste - something HADIT members taught me. D. Effective date Pursuant to 38 C.F.R. ù 3.400(B)(2), the effective date of VA disability compensation benefits for direct service connection is the "[d] ay following separation from active service or date entitlement arose if claim is received within 1 year after separation from service; otherwise, date of receipt of claim, or date entitlement arose, whichever is later." See 38 U.S.C. ù 5110(a), (B). In this case, the veteran was separated from service in October 1978. R. at 24. The first time she filed a disability compensation claim was in December 1982. R. at 75. That claim was denied finally …

ptsd Ptsd Question For Veterans
I am still on active duty and was diagnosed PTSD by a civilian doctor when I was hospitalized during 2002. No military doctor was available during that period, so tricare paid for the civilian hospital (mental hospital). After that, they decided to hospitalized me at walter reed and this time the military doctors said that it was not PTSD, that it was a "personality disorder." I went back on active duty with no further incidents on this issue. I plan to retire next year. Question: is there a chance I may get disability rating (upon my retirement) for what happened in 2002 based on the civilian doctor who diagnosed me with PTDS? Any advice is appreciated. Cam…

Social And Industrial Survey
HI there. Because of my SC brain injury, my language skills test in the 60 to 70 percentile(high average), yet my verbal skills are in the 3 percentile (better than 2 out of 100 people). Needless to say I do very poorly in the one on one c&p exams, especially after factoring in memory problems(at least, for my benifit. The VA does quite well when I cannot express my difficulties fully). A social survey would (seem?) to be a huge must for me to properly express my situation. I do not suppose it can be requested, or better yet, forced? No need to explain the 10 min c&p results with someone like me. Thanks.

Appeals Process
Tbird, I posted sometime ago that I had filed a claim and was waiting for the VA to make up its mind. Well the finally did and I do not agree with what they have done. I was already through with my C&P appointment when i found this site and wish I had found it alot sooner. When the VA info did come back the rated me at 20%. For lower back problems which I had surgery for while in the military. My problem is that i still have constant problems with my back. I would like to file an appeal but, Im not sure if I really deserve more of a rating. I still work and do not miss work, but that is only because at the most I work 3 days in a row. The last day I work I have to tak…

hypertension Question On Possible Cue Claim
I need some help please. In July 01 I submitted a claim for joint pain of hands, elbows, knees, shoulders and hips. In December 01 VA denied the claim based upon their claim that I did not show for a CP in Sep 01. I sent NOD because I did go to Sep CP at which they conducted an exam on my eyes. When I went back to CP check in station I was told that was it and I would be notified if they needed anything else. As a result of the NOD VA scheduled a CP in Dec 02. In Mar 03 claim was denied on VA claim that the CP did not show any loss of function and that Pain was not a disability. In Apr 03 submitted VA Form 9. In Mar 04 checked on status of claim was told that no…
