By George, I Think She's Got It
I edited out my topic, because I thought it had been fixed but it appears I was wrong. I guess I was mistaken, I could have sworn just a few minites ago I saw the correct format, now it's back to the way it was. Subject most recent topic on top most resent reply on the bottom so you can follow the flow of replys to the bottom and then make your own reply either as a full reply or a quick reply. subject Title J replys first t replys second breplys third and so on to the most resent reply at the bottom. Smc Correction-
I posted some where that, as an example of SMC awards, a veteran who is entitled to A & A, and has a 100% SC disabilty and also I used service connected loss of both hands and suggested this vet is entitled to the SMC "K" award for each hand- I just realised that the SMC M award would provide a higher SMC rating- for loss of use of both hands.I think I used my husband as example as I have CUE filed under Sec 1151 SMC as well as claim under Nehmer retro for SMC. It looks to me like the difference is quite large- A vet with a spouse today who gets 100% and A & A would get $2,990 per month under "L". the "K's are only worth about 84.00, so therefore a v…

The Edgewood Saga Continues
well the VA finally admitted I was at Edgewood, in response to a letter I wrote Senator Craig, they had Renee Szybala, Director, Compensation and Pensions reply, she stated that I arrived at Edgewood on 10 July and was sent home sick and never used in any tests, I was discharged before testing began according to her. I know she was basing her info on what someone at VARO Columbia told her but they lied to her, my records show I arrived at Edgewood on 25 June 74, was admitted to the hospital at Aberdeen on the 3rd and discharged from the hospital on the 10th of July, back to Edgewood and I was there thru Aug 22, 1974. BERTA: My post from the other day, that I started, asking about Agoraphobia & Anxiety, that the VA rated me for, and included in my PTSD award, and made me 100% scheduler, you were wondering how did the VA consider me for SMC. They didn't, I didn't know anything about housebound/aid & attendance, until I read about it on Hadit, so I filed for them both on October 31, 2004, and so far, haven't heard boo about it. I have called in several times, but all the VA says is they are working on it, but almost a year now, no C&P exam or nothing, I think they are jerking me around again. Va Calls Cue On Itself
gee-when it rains it pours- I only have a few more days off from school- and it seems like many of my local vets are suddenly getting decisions- One of my vets just had a CUE called on itself by VARO- long story-wont go into here- but their wording in the decision-which is very favorable to him reads thus: The decision (2003) "was improperly based on the available evidence of record at the time and the rules then in effect. Therefore a revision of an effective date is warranted." Well- seems to me they made CUE in his 1980 claim too- I am using their exact wording to state the CUE I am writing today. hypertension Berta And Friends
I filed a NOD on my hypertension and requested a DRO review of my claim. I enclosed Docket No. 03-37 357 and hilighted the decision. My SO got excited. I also filed a new claim for Bilateral Peripheral Neuropathy, Upper Body. I had an AO exam and the VA Doctor discovered lack of strength and feeling in both of my hands. The PN did not come before DMII so I think the claim should go through. Two questions, what Exam does the VA use for PN and what do I need my regular Doctor to say on an IMO. Nexus, etc. Thanks! Received Letter From Vamc Yesterday
I got a letter titled "Notice of Entitlement for Spouse and Children" yesterday from VAMC and I was curious if anyone would know if it was just a form letter that they sent out to people with 100% (schedular and/or P&T) or if it is sent out specifically to people with P&T status? The letter basically talks about CHAMPVA and who would be covered and where a person could get an application or call for information. I sent in a request for P&T status about a month ago, but I can't see it going through so quickly? MY ROM ARE FORWARD FLEX 35%, EXTENSION 5%, RT LATERAL 10%, LT LATERAL IS 20%, LT ROTATION IS 30%, RT ROTATION IS 20% L5-L1 LOWER BACK IS LIMITED BY PAIN AND SOME MUSCLE SPASM. NEUROLOGICAL FINDINGS IS LASHEGUE SIGH WAS POSITIVE FOR THE LOWER RT LEG. Rating Codes
I have hard copy of all of the rating codes but I haven't updated it lately- I used to use this site: http://www.vba-arms.intecwash.navy.mil/reg...okc/c_index.doc It doesn't seem to respond anymore-get message to that affect- Does anyone have the specific link to 38 CFR Book C as to these codes?
