Nod Or Not?
My husband received a rating decision for Special Monthly Compensation (SMC) a couple of months ago. We thought it was rated too low, but we hadn't yet filed an official Notice of Disagreement (NOD). However, I did talk to our senator's veteran and military representative about several things that are going on with the VA and us, and during the conversation, I mentioned that I thought the SMC was wrong. We just received a letter from the Congressional Liason saying the VA is working my husband's SMC claim for R1/R2! Obviously, the senator's office must have initiated this, but does his inquiry suffice as an NOD? Or should we make sure we go through the usual proced…

It Has Arrived, Arrived, Arrived At Last!
:( My purchase of the VBM CD has arrived, arrived, arrived at last. LOL :( It is loaded with so much information, It will take my limited concentration, a long time to go through it all. Their's just to much to list, even if I could. At least I will have something to keep me company during this coming winter. The C&p:
I got my two minutes of C&P. I vaguely remember him asking me if I was in combat and marriage problems. I think the way to approach these guys is to take a shopping list and either leave it on their desk so they have to enter it in the record, or insist the guy listen to your story. I moved from 30% to 50% in 2 minutes. Now I will go after my other 50% & unemployabiity. I think I told him I was disabled since 1990. Not sure. I have the DAV doing my case and set about a rebuttle soon. Like the new board!!

Disabilty % Increase Request
Good morning to all. What is the process of requesting an increase in my rateing? I am currently 50% and with my latest MRI it is very possable acording to my Tricare PCM my neck pain is a result from my lower back service connected injury.How do I start the ball rolling on this request? Will there be another C&P exam, or will the board take the opion of my apointed Tricare Doctor and latest MRI results showing damage to my C-5,6,7 with spinal stenosis? When Can A Cue Be Used?
I was turned down in August of '2003 for "Neck Strain" I wasn't to upset about it at the time, becuase they upped my DDD for lower back from 0% to 30%. Now after combing through my records I have found proof of service connection where I was seen and sent to Physical Therapy for "Neck Strain" and probably nerve impingement (cervical spine) C6-C7. I never had xrays in the army, but low and behold just this past May I now have an Xray and MRI of my cervical spine whcih show C5/C6 level: small right paracentral and far lateral disc herniation causing mild thecal sac compression and moderate narrowing of the neural formina. tinnitus How Will It Be Rated? (not A % ?)
I looked at the c&p exam forms awhile back and realized it will take a variaty of these to evaluate me on my claim. I have a brain injury that is not proven SC yet but will be. I have been denied in '03 for the head injury, and will CUE that after claim is rated. The question is, I have one injury that causes a wide range of debilatating symptoms-attention, concentration, memory, cognative deficits, severe fatigue, depresion, anxiaty, probable csf leak (undiagnosed to date), and I'm sure I'm forgetting stuff. Oh, no can smell anything, tinnitus,...... anyway, it will take a number of different exams, all of which are compensatable, just to cover one injury. I'm afraid…

How Is Developtment For Appeal To The Bva
If I should have to appeal to the BVA, how different is developimg an appeal to the BVA different from a statemnent in support of claim and/or appeal of the VARO's decision? Is their a guide to what must be in your appeal to the BVA? Is it just your argument of the information found in the SOC say why you think the VARO is wrong and why you should be SC? Jim S.
