ptsd Postal Fmla For Ptsd?
I have not used sick leave for many years. Wonderful health? NO! Scared to death! My post office started leaning on plain old sick leave for "ridiculous" things like ....being sick? many years ago. FMLA was your only safe harbor and there are some complex hoops to jump through. We now have some kind of centralized automated phone notification that nobody understands, and I am wary of partly because of my hearing disability. I go when I have stomach viruses, I go when I have the flu, I even went one time when I split my forehead open right before time to leave. I should have gone to the emergency room for a couple of stitches, but butterfly bandages an…

Restrictive Pulmonary Disease, Tos, Brachial Plexus
Hi, In early August, I filed for 100 percent unemployable because I have been retired by outside pulmonary doctor. I am drawing LTD at the pressent time and I have lost 40 percent of income because of this. I also have a DRO claim that has been in process for 2 years for Radiculpathy stemming from a cervicel spine Injury. I was awarded only 10 percent for that claim. The ling issue is due to asbestos exposure. I was an asbestos worker removing asbestos from Nuclear Submarines. (This is all documented in the record). I filed this claim originally in 1994 but the VARO at the time said records were not available. I did not appeal. IS there any chance to get the VA to regre…

ptsd Hearing Problems
I just got around to filing for PTSD and deafness in left ear and timmitus in both. My PTSD claim and hearing problems are documented by a medal . Although I am about 90% deaf in one ear I still hear relatively well. Now if I put an earplug in my good ear, I can't understand a person speaking normally. I can hear some tones but I can't understand speech. I'm wondering how the VA will look at this? Since the VA will probably try hard to avoid compensating me, I'm going to try hard to get a win. I'm not trying to get anything I don't deserve but i do want to do poorly on the hearing tests. Are the test 100% foolproof? If I don't respond to the noises I can barely hear; …

Reimbursement Program For Troops Stalls
October 3, 2005 Reimbursement Program for Troops Stalls By JOHN FILES http://www.nytimes.com/2005/10/03/politics...agewanted=print WASHINGTON, Oct. 2 - The Pentagon has not completed guidelines for allowing soldiers, their families and charities to be reimbursed for some combat equipment they bought for use in Iraq and Afghanistan, a year after the passage of legislation calling for such a program. The measure, which allows for groups and individuals to make claims of up to $1,100, called for the Department of Defense to set rules for a reimbursement program by February 2005. The sponsor of the original legislation, Senator Christopher J. Dodd, Democrat of…

hypertension Decision Today
I received my decision. We must confirm our previous decision which denies your claim for service connection for hypertension as secondary to diabetes mellitus, type II with organic erictile dysfunction. The medical report you submitted does not provide a link between your hypertension and military service. Therefore, your claim of service connection for hypertension as secondary to diabetes mellitus, type II with organic erictile disfunction remains denied. Folks I receive $85.00 per month for loss of use organ for ED. #2 Entitlement to Individual Unemployability is denied. I am at 60% total. I'm not sure what is my next plan of attack. I had an AO physical an…

Is The Va Legally Bound By Its Own Regulations?
We often quote the M21-1 in claims research, but is the VA bound by all statements in its published circulars, pamphlets, manuals, etc? What about its own adjudication procedure manual? While the VA is bound by its own regulations, that doesn't necessarily apply to all statements in the M21-1. So what part of the M21-1 is legally binding? Here's a link that gives case law and extensive explanation regarding this. (The particular case is related to an asbestos exposure claim.) http://www1.va.gov/ogc/docs/prc04-2000.doc "QUESTIONS PRESENTED A. Do provisions of paragraph 7.21 in Veterans Benefits Administration (VBA) Adjudication Procedure Manual M21-1 (…

tdiu Question On Rating Of Hearing.
Ok here we go, husband is 100% TDIU & P&T. Went for a hearing test in 2003 and was rated by the Cleveland Regional Office, SC at 0%. Went for a hearing test today and was told that he had a paper that said he was denied for SC and showed him where he was not rated at all for his hearing. He also had Jim's services records from when he was discharged where it stated that he had significant hearing loss. His hearing tested fine before entering the service. Jim has never seen these records. Now where do you think we should go with this? The guy that gave the hearing test seems to think that Jim should have been SC all of these years for his hearing. Thank y…
