File One Claim, Or For Each Symptom
With my brain injury there are a lot of symptoms that can be rated as illness's by themselves, if SC. I had in the past filed on fatigue and am rated at 20%, undiagnosed. I have a claim for depression, secondary to SC denied and appealed. My C&P examiner for the depression said my depression is caused by the brain injury and it is likely my fatigue and other problems as well. So, with no hospital records on file, -accident in Gulf War- they said sorry. literally. Being rather slow, thinking ability and whatnot, it took the brain damaged guy a while to find the records. The day they came in I filed on the brain. Am I going to have to file a claim for each of my symptom…

He asked me what he should do I had no defintive answer to give him as his cailm was on appeal on someones desk in that office. Any suggestions to give him? Jim Stokes PS I'm having a tough t…

diabetes Odd Update On My Review
VARO assured my vet rep the claims folder went to a VA doctor in Buffalo last Wednesday for Expeditious review- Two strong IMOS and also additional probative med evidence, from the veteran's medical records, VACO etc-to suuport the claims- Today the 800 # vet rep- who has helped me track this stuff said it was all in transit yesterday and today it was received bu a doctor at the local VAMC in Bath. Called my vet rep and he was astonished- he is finally getting the point- I have already tipped the scales in my favor with all of my evidence - I didnt care when it went to a VA doc in Buffalo-they have some real doctors there- (If that was true) and he agreed th…

tinnitus Informal Claims And Inextricably Intertwined
Question # 1 If in 1978, a vet had an Audiology C&P, requested by a VARO adjudicator and listed as "Special Ear Examination" -- and the C&P examiner list's under findings Tinnitus alledged -- would this be an official (if there is such a thing) informal claim ? FYI - 20 something years later Otitis Media and Tinnitus were both granted. In going over ALL records I've just realized that at the time of the Ear C&P, I was taking VA Rx'ed antibiotics for Otitis Media and this is why the ear canal showed no effusion. Question # 2 Can anyone refer me to something in writing, concerning VA, that defines Inextricably intertwined claims and/or issues. …

Claims Format,
No one ever sees the claim as it is written and leads to a winning claim. We always get bits and pieces letting us know of the win and that is about it. I'm wondering if their is some form or steps or something that allows one to put in writing a well thought out claim that even the VARO would have a hard time finding flaws, in which to deny the claim. Example, Not to be used; A. Disability for which Compensation and/or Pension is sought. 1. Records that support incurrance in service or one year from discharge a. Chronological list of addition records supporting disability B. Treatment showing continuety a. List of effects on self and …

Fee Basis Card?
I have been a patient at the New Orleans Va off and on since 1972.However with the recent disater there is a chance that medical center will never reopen due to the excessive flooding. I had my meds renewed by a out of town dr. to the Jackson ,Ms. Va.I telephoned that Va this morning asking for a fee basis card to a local Dr. The lady incharge said she was sending me a package to apply for same. My question, she said I must take it to a local Dr for them to fill out,is it hard to find someone who wants to deal with the beauracrats? If approved does this also include private hospital care should that become a factor? I appreciate any advise on this matter from the bee…

Benefit Of The Doubt 38 U.s.c. 3007 (b) (1988)
I found a COVA claim with similarities to mine and I wonder how the VA was able to get away with out consideration being made to benefit of the doubt. My diagnosis was made by a conforance of Navy Dr's at my Medical Board, after reviewing my complete record up till that time, which included my military records and medical records and 24/7 observation and treatment for three months, while hospitalized for same. The VA C&P exam couldn't have been longer than 30-45 minutes in duration and in that time, he not only determined that I had a different diagnosis, but had no residuals from a fractured nasal bone and concusion and couldn't support the diagnosis for which…
