Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

From Post Determination, Back To Rating Office
Hello everyone, Today I learned my claim file has gone back to the rating board from Post Determination. Why would this happen and do you think this is to my advantage or disadvantage? In addition, I learned that my c-file is in Puerto Rico instead of my VARO, which is in Winston Salem, N.C. According to the V.A. Rep. my file was chosen randomly and sent there because of Winston Salem's backlog of claims. I wonder if this is a blessing or not? Interestinggggg! The last time, I spoke with a V.A. Rep. he said I had just left third base on my way home. I guess, I'm back on 3rd base, nevertheless it won't be as long as it has been (I don't think). Have a great eve…

Claim At Post Review(?)
Yesterday, I called the 1-800 # and was told by a rep. that my claim was now at Post Review(?) Determination(?) (can't remember which word used). He said someone has to check behind the rater and take care of the details concerning my "helpless child". In addition, he playfully said in terms of baseball, I have left third base and I'm now on my way to home base. My question is where does the claim go next? Also, I would think this means I'm sc...what do you think? I know I should have asked the rep., but in my excitement about the claim moving so fast (on the raters desk just last week)...I didn't think about asking him. Thanks.

Detectable Psa After Prostate Removal
I hope I'm not bringing up a question already answered. I served in VN in '67 - '68. I was given SC for prostate cancer after filing in Feb '08. I had an aggressive type and had a prostatectomy in Mar of '08. My Dr. said I would need radiation most likely after surgery but they would wait as long as possible because any progress being made vis-a-vis bladder issues would be halted by radiation and never get any better. Radiation is coming up soon as my PSA has risen continually as follows: 6/08 - .037, 9/08 - .040, 12/08 - .50, 3/09 - .062. I had my C&P in Dec '08 during which my urologist's records, which I presented, showed that I would need radiation and al…

Which Way To Go...new Evidence Or Nod?
Greetings all, I am reposting the following here in the hope that I can gain some insight in what to do next. I had a service connected claim of obstructive sleep apnea with CPAP which was denied because the VA found no evidence in my SMR. I am a tad miffed because in my service medical record shows my diagnoses of Obstructive Sleep Apnea and to start CPAP therapy in September 2007, but this wasn't even referred to. I had my CP exam in October 2008 and showed the doctor my SMR with the diagnoses and sleep study results listed on it, but not the actual sleep study. The doctor stated that I had subjectively reported I had sleep apnea but no evidence was given t…

Help For My Father
My father-in-law is service connected 20% but cannot find his award letters, or remember what exactly the 20% is for. How can we find this out and apply for increase of these. He was awarded service connection upon retirement in 1987 so I think he is due for an increase. Thank you, Bergie

First Exam Done, Mainly Back Issue's
I had my first exam that the VA set up last week. I had a disk fusion on my L5-S1 last year after my disk collasped while still on active duty. I got out on the 15 of this month. I also have been having pain radiating down both legs and have been going to the clinic to have it checked out, which that did nothing for me but I do have it documented that I have been going to be seen for it. My discharge physical states that my ROM was 20 percent fwd and 0 percent back and 10 percent bilateral. It also say's decrease sharp/dull left calf lateral foot. The doc that I seen through the VA ROM measurments were 15 fwd ,10 back, 15 bilateral. He also performed the test where yo…

tdiu Question About Smc
Currently 70% with TDIU for severe panic anxiety with agoraphobia. The wife has had to quit her job because being alone brings about severe panic. Problem is, this places one in a financial burden. Are there any special compensation schedules or any way to get caregiver assistance so that she can go back to work? Thanks for your time

Can I Get An Idependent Medical Examiner Now?
I have a claim for increased disability pending. I was seen by the VA physician a week ago and I saw in his report that he is asserting that my increased disability is not related to my current 30% service-connected disability by the lamest, through-the-looking-glass story you could imagine. Can I ask the rating board to hold off on the decision until I can arrange for an IME (Independent Medical Examiner) to submit an evaluation of my chart? The VFW has my power of attorney should I work through them? Can I ask them what other decisions have been made in similar cases? If not, can I find that out somewhere? Thanks

Dav Visit
Yesterday I went to the DAV to file additional paperwork for my NOD appeal for neck pain. They increased the rating from 0% to 10% which I rufse to accept. The problem I have is that since the award I've had PT, acupuncture, fascicular ablation with no improvement. I also recently (last month or so) developed worsening pain and radiation into forearms with rotation of neck side to side. Also have arthritis, and recently placed on morphine for pain control. I have scheduled an epidural steroid injection series next month. All documentation was provided of the above information. Does anyone think I will get an increase if so what might I get, any advice how to procee…

Question For Meddac
MEDDAC, You seem to know what you are talking about, and I appreciate the time you spend on here explaining things to other veterans, I hope you can lend some insight for me. I have a question, but first the background; I currently have a claim in for service connection for carpal tunnel syndrome (submitted June 2008). It was in my claim back in 2000, which was put in right before I retired. I know the rules now are that if a veteran has a diagnosis within a year of discharge, it can be service-connected. I had complaints of problems with my fingers going numb while I was on active duty. Within 3 months of my retirement, I had a nerve conduction study done, and g…
