Has This Happen To Anyone?
:) 10/1 iu deferred due to receipt of va form 21-8940 11/1 mailed form in the va priorty mail.return receipt arrive at va 11/6 call 800 on 11/30 they received 21-8940 ok good send request via iris form arrived va on 11/15 still working on it received letter va 12/20 iu denied no receipt of va form, ???????? any info helpful , send iris today asking them to verify. the vsr is not check folder any comments tks

tdiu Individual Unemployability
I am 75 years old retired from the USN. I met the IU requirement with 60, 40, 20. I am am at 80% now. I filed for IU and was denied and the reason for denial is : i have reached 4th year of college and have worked as an office personnel office during my military service. I have also received electrical and technical training during my military service. VA examination results DO NOT SHOW symptoms or manifestations that are so severe to render me incapable obtaining and retaining gainfull occupation in an office setting. I am preparing a letter of consideration to my denied IU claim. What will be your recommendation and arguments to put on my letter. Who will hire me at …

Bva Hearing On Cue Claim
I have a BVA Hearing with a Board member at the ST. Pete VARO on January 27, 2010 on my CUE claim. My lawyer will be there (if he wants to get paid). I am surprised it is happening so fast. I asked for it about a year ago. It is in regard my CUE going back to my original rating in 1973. I don't know what will happen, but I am hoping to win. If not I will go to the veteran's court with this lawyer or someone else. I am talking about potential of 30 years of retro if I win it. I will be up early that day since it is at 8:30 AM. I have never been to a BVA Hearing before so can anyone tell me what to expect. Is it just a high class DRO Hearing or much more formal? My gut tell…

Sorry About The Negativity
i posted a couple of replies that had a bit of negativity in them,for that i apologize , it is a tough road this va is,at times very discouraging. yet without them i would be lost and most likely dead. for those of you that have received the proper ratingl, i am very happy as you deserve it and the road has probably been rocky. for the rest of us lets keep our chins up and continue marching forward. happy holidays erico

Iu Claim Response Time
Hello Vets, Any know how long it usually takes for the VA to repond to an IU claiim? I was awarded 60% for SC back issues a month ago, from 0% so the record and new forms for IU are current. Your responses will be appreciated. Thanks, Blackbird

hypertension Can Someone Please Respond? I'm Going Nuts!
Hi, First, I want to thank everybody who contributes to this site. The information I gleaned from Hadit was the key factor in putting together my claim. I am currently rated at 70% since 1998 (50% bipolar, 10% left knee, 10% right knee, 10% hypertension). I was shot and nearly killed during a robbery in Dec. '04. My friend was killed in the incident. I had 4 subsequent major surgeries to repair the damage, including a colostomy and a colostomy reversal 1 year later. The Physical and emotional trauma has scarred me forever. ptsd Opinion Please
I have been and am currently 30% PTSD diabled since 2004. Filed for IU March 2009 (PTSD) due to increased severity unable to work C&P Exam (PTSD) June of 2009 C-file returned for another C&P and Examiners opinion as to iu and if could work. Attended C&P Sept for the Examiner to review and retest. Examiner stated' "As requested by the board, opinion the Veteran's symptoms are more likely than not a result of events experianced during military active duty. Confused, Need Help!
Ok, I'm not even sure how to explain my situation, but here goes... I'm 90% SC from VA, 40% combat-related TDRL from Army. My original VA claim was approved 15 Jan 09, back payed to 1 Sep 08. I received $1061/mo from Army between my retirement date of 3 Aug 08 until 1 Sep 09, when they waived my retirement pay in lieu of VA compensation. I applied for IU on 29 May 09, I just received my approval letter dated 1 Dec 09, with an effective date of 4 Aug 08. So, here are my questions: 1. Did I get overpaid? If so, now what? 2. Will I receive retro pay from the VA for IU? or 3. Will the Army recoup my IU retro pay? I'm also trying to figure out if, and how, CRSC …

tdiu Former Employer Work Records For Tdiu
i'm at 90% and two of my last employers will not respond to va forms requesting info on work records. one is out of business to my knowledge. will this hurt my chances of being granted tdiu? is our rating decision being based on whether or not my past employers respond? ( both of whom I am not in good standing anyway). also in support of my claim, a VA mental health social worker that i have known for years typed up a letter on va letterhead supporting my claim. i wonder if this will help. any insight is appreciated. thank you all

tdiu Tdiu Cue
Hi everyone, I'm new here and found this site while brousing the internet. I have a TDIU appeal in the works. The VA originally denied me but didn't address my SSD at all and then denied for some stupid reason. Actually, they used a symptom of my depression against me in denying my claim. I immediately file an appeal for reconsideration and was informed just recently by my VSO that they (VA) has decided to reverse my denial for IU on basis of CUE with a projected completion date of January 1st. What is a CUE and it this good for my IU claim? Also, does anyone think they are reconsidering my claim because they didn't address my SSD on the original denial? These…

tdiu Ssdi Not Just For Sc Problems; Does It Kill Tdiu Hopes?
I got SSDI awarded in 2004. Now I'm filing for TDIU. But... The SSDI is for my SC diability AND some non-SC issues. Will VA use the non-SC stuff to just deny my TDIU, or are they supposed to give benefit of doubt, in that the SC disability is the major problem that put me out of work?
