diabetes Help! Another Medical Opinon #5 And Counting!
Gosh, I do not know how long this will go on! Since my last post in March, my claim for Cause of Veterans Death was returned to the AMC and once again it was sent out for another Medical Opinion this month which makes the 5th time they have requested a medical opinon. I have submitted 2 more IMO's from his treating doctors since my last post, both agree that his DM II was a contributing factor in the cause of death and also state that he had IHD. (all the proper VA lingo was included in the IMO's so there would be no speculation when it gets to the raters desk) The hospital discharge summary on date of death indicates that he had an acute myocardial infarction with lef…

Accrued $$$ Under Terry V Principi
A question popped up here in Claims Research as well as maybe the DIC forum on this regulation and I just found some interesting info that might help any widow or widower as survivor of veteran. I had mentioned in the older topic that although I was eligible for 3 years of accrued 100 % P & T due my deceased husband- the regs at that time allowed only payment of 2 accrued years-and of course the VA always used the cheapest years.I got accrued for 1`991 to 1993-yet accrued from 1992 to 1994 was the higher amount. No reg to fight that with until Terry V Principi. Terry V Principi (per NVLSP-VBM, 2009 Edition page 513)”results in an entitlement to much larger am…

Veteran Claim
I filed for DIC and Pension in 2009 and I received this letter today. The letter is from Social Security and is titled "SOCIAL SECURITY REQUEST FOR INFORMATION". --------------------------------------------------------------- In the letter: Social Security has received the following: A claim filed with the Veteran's Administration for social security benefits has been forwarded to us (Social Security). The claim we received is a duplicate of an earlier claim. The decision we made on the earlier claim still applies because there are no new items. ----------------------------------------------------------------- I did not know the Veteran's Adminstration forwarded …

Reps Problem
The check is in the mail. If I had not been aware of this benefit(my former reps didn't have a clue as to what it was - although it is part of every DIC app)-for those widows or widowers who meet the criteria- and if I had not raised some Hell yesterday-with the VA -I could have lost this benefit and the retro cash! The regs were on my side -that is all I needed. Actually the problem started when they lost my app twice but I am used to that-and the VA approved this in January but some dope tried to tell me I had been denied. His VA supervisor was just wonderful and knew right away that I should have gotten this benefit months ago.And he saw to it that I wil…

Any Reps Dicers
The REPS office is -in my opinion- a mess- My REPS check was supposed to come last week (the REPS entitlement program is explained here under another topic under DIC forum) Since REPS lost my app last month although the VA gave them approval for it in January- the REPS man asked me to fax it to him- Feb 12th I think it was- and it only needed a SSA statement that he would obtain. Yesterday he could not find my app at first-(he was the one who misplaced it in February )and then he realized he had not contacted the SSA at all and told me I would get expeditious treatment as he would contact SSA right away-and the check would come by first week of April. He replaced…

Inservice Medical Records
i ordered my husband's medical records from the national archives about 2 months ago and received a letter form them yesterday that his records were sent to the va claims office in january 2010. my husband's doctor faxed a letter connecting his hep c death directly to his blood transfusion's he received while hospitalized for a severe wound he received while on active duty. my question is (in your opinion) would the va be able to adjust his medical file not to show the blood transfusions he received during surgery so as not to pay a dic claim? i know this is a silly question, but never the less this is bothering me. thank you for your help.

Benefits Question
after my appointment with the ss disability doctor yesterday, i got the impression from them that the va would give a better check each month than ssd and i probably should turn down ssd if i were approved before the va decision. my husband's doctor faxed a letter to the va in st. paul this past saturday connecting all the dots for his service connected death and as the dav rep shared with me after he read the letter ... no way in hooterville can they turn the claim down. there is not a shadow of doubt his death is service connected. your imput is appreciated.

diabetes Help! Va Sent For A Medical Opinion From Vamc 4times
I have a Claim for Cause of Veterans Death & TDIU. My husband was 90% SC at the time of his death in 2004. He had applied for TDIU & reopened claim for Hep C. but that claim was not decided until after his death and was denied. I refiled as the widow and was denied. I appealed the decision, had a BVA hearing in March 2008, in August 2008 was awarded the TDIU and claim for cause of veterans death was remanded. Remanded stated that they were to try to locate the STR from service and also get a medical opinion to opine if any of his SC conditions contributed to his death. I received a letter stating that they could not locate the Service Treatment Records from whe…
