Help Please
Hi all- I am new to this forum and in need of any assistance. Here is the deal, my father had been rated 100% disabled by the VA off an on for years. He then had his 100% rating for about 6 consecutive years when he passed away. They listed NC on the death certificate. My mother took care of him the entire time and did not work. Now she has been denied benefits because he was not rated 100% disabled for I think 8 consecutive years is what they said.(how can this really be a law?) So now she has no income and no health insurance. The VA is saying tuff. I dont know what I can do... Any ideas? Any responses very much appreciated

Dic
I have 100% p&t, close to 70 years old and have passed the 10 year mark. Could anyone tell me what I need to do now, just in case I pass away before my wife does, to make certain she get's DIC. She has had numerous strokes and is incapacitated, would not be able to file. Should I have a special folder that instructions for someone on what to do if I die before my wife. If so, what should be placed in the folder. Any help would be appreciated.

Dic In Usa Vs. Dic In Canada
What a shame that if you happen to be a surviving spouse in the U.S.A. and your 100% disabled Spouse dies before the 10 years pass, you might receive nothing. That's right NOTHING! In Canada, Surviving Spouses receive benefits immediately. Read this then write your Senators. Congressmen, Commitee on Veteran Affairs, etc. What an injustice! In Canada: Surviving Spouse/Surviving Commom-law Partner When a disability pensioner dies, the survivor may receive, for a period of one year, the same pension and / or POW compensation amount (including Attendance Allowance and Exceptional Incapacity Allowance, if applicable) being paid to the pensioner at the time of deat…

Dic Awarded In Record Time
Hello Everyone, Just had to tell you that I received a phone call this morning from my rep at American Legion. She told me that my DIC claim (effective April 14, 2009) was AWARDED!!!! I should be getting my formal letter 10 to 15 days! She said that DIC, DEA, Acrued Benefits, burial, etc., have been awarded. They are now figuring out the figures. I filed for DIC (with all of your help) on May 11th. Thank you again for all your suggestions and input. I must have done something right!

ptsd Accrued Benefits
some widows at other sites have been urged to join us here- one widow seems to have misinterpreted the Accrued benefits regs- Simply put- if a veteran has a pending claim at time of death-the surviving spouse can claim 'accrued ' benefits via the 21-526. Accrued benefits can be paid to the surviving spouse or in equal portions to the next of kin. However NO accrued benefits are paid to anyone unless formal application has been made within one year after death. Even if the 534 is never filed , any next of kin can apply for accrued if they are eligible. The important thing on accrued benefits is that the claim MUST have been pending at time of death. Pen…
