  1. Called Peggy today. She told us we should have a decision on my hubbys cad recheck around nov 8. We ask about appeal and she said they have mad a decision on 9/8,. And we should receive a letter. She said she could see the decision but she could not tell us what it was. So we called the bva number,. Some guy answered the phone,. He did not sound like he liked his job at all. But he did say they have not made a decision yet and it was showing still with rep. Now it was aug 30 when we had the girl at eglin send all the labs and dr new dbqs in. It was showing even before she sent this in that it was with rep on ebenefits. Could they have gotten the info and immediately make a decesion? So who do I believe. Peggy was more talkative. Maybe the dork in D.C. Was just looking at ebenefits. What do you all think.

  3. Berta back again on this ihd thing. It was approved in 7/14. Now ther is another claim on ebenifits, which we did not file. It says coronary heart disease RFE. Now my husband got a call for a c&p exam. It is not at the va in Pensacola, where he is usually sent. I guess it is at one of their contractors office. I assume that they are trying to link his kidney failure with his heart disease. But we did see something on the old paper work that says,"since there is a likelihood of improvement, the assigned evaluation is not considered permanent and is subject to future review exams. So my question is if the heart don diction gets better will it also stop the kidney claim? Now my husband had aortic valve replacement and that is when they found the cads in left ventricular first diagonal branch had 40 to 50%. Right ventricle showed mild disease and luminal irregulaties. He had aortic stenosis which had fused two leaflets together. My point is could the stenosis af the aortic bye considered ihd. I have had other people it is. They reopened the claim where we had claimed the aortic valve secondary to diabetes before ihd was put on the presumptive list. Then closed it. Now they are doing totally new claim? Go figure. I do remember seeing somewhere on the va site where Nemertea was looking into a lot of mistakes with these claims for ihd, that they found a lot of mistakes.
  4. We won't if I have anything to do with it. Sometimes it seams like he is. We finally got the letter, with docket number. And tell us his appeal was with his representive. So I'm going to get all labs, documents, and ask doc if he agrees with these doc by pub med, which is research they have done veterans etc and take it to her to get her to write up whatever and give it back to me to get mailed certified with return receipt. Then they are talking abou 270 days on average after this. Which is ridiculous. But that is the system.
  5. Once they start reviewing your claim at the bva, how long does it take to finish. I have stuff I need to send in , but was waiting for the docket number. Finally got it about 3 days ago, by calling bva. She said they were working on July of 15 I think. But then I get this thing on ebennies that they are reviewing now. And the claim which we don't know who filed it for cad rfe. So we have no idea what is going on here. He filed a claim way back in I believe 09, for heart disease(arotic valve regurgitation) secondary to diabetes. They denied it. They reopened it for some reason around 2011. And then closed it again. Then he had the valve replaced. That is when they found the cornoray artery disease. So if they try to link his renal failure to cornoray artery disease, will they go back and reopen it again. I'm so confused.
  6. Berta did your husband have renal failure too. And this odd, I do remember somewhere in his med records the word cardiomyopathy. I will check into it. His appeal is at bva being review by '" his representitiv',. That is what I do not understand. Representitive.
  7. But it is already at bva and I called bva and it has a docent number
  8. Berta and Gastone,. Now it is showing the appeal with his representitive. So does that mean someone at the bva. Or what? The other claim is still showing on ebenifits.
  9. I will try to get his doc to do that. But it is going to be like pulling teeth. Even though he put his diagnosis on paper. I don't know if he will do it. because . When I ask him if he could put that his diabetes was more than 50 percent the cause of his kidney failure. I really do not like him. He said something one time about veterans getting to much. If he won't I may just get another doctor. But my point that is what he diagnoised him with, so why can you not say that. Then maybe he has not been treating for the proper reason. Maybe I will say that to him, if I go with my hubby to his next visit. In the first place he is not doing crap for him. Other than reading his labs. Oh did forget to say my hubbys gfr was 42 at that appt cp.. Thanks Berta.
  10. They denied claim for chronic kidney disease secondary to diabetes, because when then checked his urine from the they make you urinate in, they claim it did not have any protein urea in it. So they are basically saying it cannot be secondary to diabetes. However that is what his private nepthrologist says it is. Renal diabites type ll. I have found several articles that say you do not always have proteinuera,. In fact it is a study of va patients. I'm going to send those in. They also denied increase in diabetes. we called Peggy toady, but not much info. She did give me number for bva. I called them and got his docket number which was put in Jan 15,. And they are working on July 14. So it looks like a wait. Vi ask her about the new claim, and she said it was at the regional office, and she could not talk to me about it. I told her he did not put that claim in. She said only him or some one put it for him. So I'm thinking about mistake has been made. I think that is someone else claim. Now will it end up holding our appeal up? I may end up callin Jeff Miller. Someone needs to stop all these stupid mistakes. Now I did ask if you guys have any idea, if they will go ahead and grant p and t. Because of the question on the dbq, asking if the doc felt he was able to work, and he checked no, even though we did not file for this? One the new claim I'm going to give it a week and then start pressing them to find out what is going on. Since we did not it it in. Find out whose it is. If they cannot find out, I'm sure Miller can persuade them.

  12. Yes appeal is at intake center at bva. But have not received a docket number yet.here is a copy of c-file denial. We have not talked to Vso yet. And the reason is the new claim says a development letter has been sent but of course again it has not arrived yet. The claim originated June 30 and is in gathering evidence. We don't have any new evidence relating to kidney disease connected to his heart disease. He has had diabetes since 1999. He was diagnosised with kidney disease in 2011. And ihd in 2013, when they had to replace his arotic valve. Now I have no idea what is going on. On the new claim on ebennies in a little box. It ask if we want them to go ahead and decide the claim to check the box. My other question he did not put in for p and t,. But if you notice on one of the dbq our doc said in his opinion he is not able to work. And these are diseases that are going to get worse and contribute to his death. So will they grant p and t. Even if he did not file for it. I think they want to say it is related to his heart,. But afraid they will say related to valve problem and deny it again. So if we say yes decide it. Then that kills the appeal. I'm I right on that? Any ideas are appreciated.
  13. I hope so,. But I hav to wonder what or if the va is trying to wave a bone here. Maybe they are not wanting to pay from 1/2012. So they are looking to tie it into heart disease and pay from 07/14. But he has had the kidney disease for about 5 yrs. and you know what is on the even site on the claim they put on, over to the side, it has a section that ask if he want them to make a decision now. I have never seen that before. Any one else ever had this to happen?

  15. Yes filed a nod, filed19 within the 60 days. Vso thru American legion filed all. We have copies did an iris, about 10 days ago. No ans yet. I got Drs to fill out dbqs etc.. I have got all his lab work from the time he was diagnosis with renal failure. His Vso to wait till we rec docket number, otherwise it might get lost without it. However, we ar still waiting on that. Of course it is like everyone else, by the time they get around to rating it, you are much worse than you were, so then it is time to file for increase.. Lol. Will they take into consideration that the dr. Put down that he is not able to work at all now and grant P& T. I mean we did not file. We really did not think about it. That is what happens when you get old. Thanks for listening and I appreciate your advise.
  16. Let me make a correction. I was trying to say p&t instead of tdiu. My husband is like the rest of you guys that went to nam. Enlisted 5 days after graduating has. 17 yrs old. He did a total of 20 yrs between navy and Coast Gaurd. Then he did18 yrs in law enforcement. I think he worked enough. Couple of other jobs in between.
  17. Also,. He did not put in for tdiu. But the va did ask that question on the ebb the dr filled out and his family dr checked he was not able to work. Does the va automatically give that to you. And also put in for an increase on the diabetes. He is at 80. Now, if he gets tdiu that diffently puts him over the 100 or at 100. Will the be paid from the time the claim was put in? Is this something we should call and ask. I can not get hubby to move on this. I'm afraid he will jump in and just take what they offer him. What do you guys think about this. Please help me to understand all this.
  18. Ok my husband has Ann appeal in since11/12 for chronic renal failure secondary to diabetes. There is a new claim in ebenifits, which we did not do. It is saying for cornary heart disease RFE. I'm assuming that means renal failur evaluation. So I'm assuming again they are going to try and approve it asso with the heart disease. We put in for the heart disease 7/14. He was diagnosed with diabetic nephropathy by his private nephrologist. What are they trying to do? The appeal is still up. We have not gotten anything from them. No docket no etc. but he would loose a lot of back pay is what I'm thinking. Any thoughts ? From anyone.
  19. I think it is my daughters age too. Someone old gets it easier and quicker. I remember I put in at 56,. I was denied at first. I went with a company called allsup to help me the second time around. . I got a date for the judge in mobile. About two weeks before that,. I'm assuming after they got the doc report,. I got a letter of approval and did not have to go before the board. But do you know the answer to my original question? If this would constitute a hardship, since we are having to support her, until they make a decision on her ssdi. Right now if they approve my husbands claim and he gets the percentage we are thinking. They would owe him between 60 to 70k.
  20. Gastone,. Omg I just went back and read my own post. I am typing on my iPad. I need to watch it better,. Because it often puts something different than I thought I typed. So I'm going to do this again. I totally messed it up and confused you. My daughter is not or has never been in military.. I was talking about her putting in for ssdi And being denied. I don't know how it put in that her sister is a lawyer... Omg I really confused my iPad. And she has an appeal going with ssdi now. She is single no childern so she had to move in with us. Cause you can not work, not even part time when you have put in for ssdi. So we are supporting her now and paying her car payments and part of her meds. Which she is on 3 injections weekly and a ton of oral meds. My question was since we are supporting her, and getting behind on some of our bills. Would that qualify for a hardship,. On trying to get the bva to move on with my husbands appeal? And if you do not have childern it is hard to get any help. Sorry for the other mix up. I'm going to have to start proof reading my work. Lol
  21. What would a hardship be. My 31 yr old daughter was diagnosis end with ms about 2yrs ago. She had eyes to cross and they stayed that way for about six months. She has had a couple of relapses, but they were not has bad. She did have to have a nurse come out and do infusions a couple of months back. She has fibro to. She applied for disability was turned down once appealed it and is still waiting. She is single and no kids. But she did have to move in with us. And we are having to help with her Jed's and doc bills. It is starting to cause us to get behind on bills. Would that qualify has a hardship. I think her sister lawyer is dragging it out. She is on obamacare? But it does not cover everything. Thos meds ar expensive too. She has put in for bet card but since she doesn't have kids, does not qualify. We are also helping with her other bills. Car payment.
  22. My husbands claim shows it at the intake center at board. When should he get a docket nu mber? He filed the claim in Jan of 12. Denied October.12. Filed appeal in November of 12. Still no docket number. Should he call Peggy or what?
  23. Is yours show at intake center at board. That is what my husbands shows. We still have not gotten a docket number. Going to send in lab results ect. If we ever get the docket nu mber.
