  1. This is an evaluation of individual unemployability related to the veteran's service-connected mental disorder. The veteran's VBMS/electronic medical records were reviewed. The veteran was not individually re-examined as his last C&P examination occurred within the last year. The veteran is currently 70% service connected for Bipolar Disorder. The report of the original C&P examination conducted by Dr.X in November, 2013 indicates that the veteran met full criteria for a diagnosis of Bipolar I Disorder per DSM-IV diagnostic criteria at that time. That same report noted the following: "Veteran is currently unemployed, and he is not attending any school/university at this time. Veteran reported being terminated from his position at a printer repair company 2months ago, due to not showing up for work; veteran was only employed with the company for 2weeks. Veteran denied having other work history since his discharge from the Airforce. Veteran reported he has enrolled in school, most recently X, and should have started classes this month, however, he has had no motivation to go to class, and veteran is unsure of his student status at this time." Based on review of the available evidence, it is at least as likely as not that the veteran's service-connected mental disorder could cause occupational impairment during times of severe depression, due to lack of motivation. This lack of motivation to attend work would likely be independent of work type (e.g., equally possible to be amotivational for physical or sedentary employment). The veteran has also previously been hospitalized for SI; given his history of suicidality it is reasonable to anticipate that this may cause occupational problems for him in the future. There is little evidence demonstrating occupational or educational impairment in the past due to manic features and it is therefore unclear whether these would be likely to cause ocucpational impairment in the future, though within the realm of possibility. It must be noted that the potentially salubrious features (e.g., a regular routine) and effects (e.g., improved self-esteem) of employment may also serve as a protective factor for individuals coping with Bipolar I Disorder or other mental disorders, and it is within the realm of possibility that employment could contribute to globally improved functioning. --------------------------------- Entitlement to individual umemployability, Entitlement to individual unemployability is denied because the claimant has not been found unable to secure or follow a substantially gainful occupation as a result of service connected disabilities. The veteran is considered capable if gainful employment. {38 CFR 4.16} The VA exminer opined that it is within the realm of possibility that employment could contribute to globally improved functioning. The examiner also noted that there us little evidence demonstrating occupational or educational imprairment. ------------------------------ I've been unemployed as of a year today, last year I attempted to go to school twice. I'm lost.

  5. based off what I read in my award letter the rater just looked at what the medical examiner put in the C&P.
  6. my IU claim is little over 2 months been in prep for dec for like 2 weeks....C&Ps and everything done. My initial claim with like 3 contentions took 8.5 months and after hitting prep for dec was done in a matter of days.
  7. Rating 8100 Migraine: With very frequent completely prostrating and prolonged attacks productive of severe economic inadaptability 50 With characteristic prostrating attacks occurring on an average once a month over last several months 30 With characteristic prostrating attacks averaging one in 2 months over last several months 10 With less frequent attacks I'm currently 30% and I'd miss a few days of work. Doctor just prescribed OTC meds and barely help. My VA doctor has put me on a beta-blocker and that's not working much either. I'm unemployed but I've been having headaches almost daily. If I'm 100% or TIDU for depression would applying for an increase of headaches affect any current ratings?
  8. Can someone explain to me what "Grossly inappropriate behavior" is?
  9. I don't really have any. My medical care is good and my longest claim was 8 months.
  10. SSA requested my medical records from all sources but didn't get my VA records? The lady on the phone said the VA never replied and due to my lack of evidence I am being sent to a EXAM, this lady tells me this is better as the EXAM will be more recent and better than the 8 MONTHS of records I had with the VA for my MENTAL condition. I'm going to get what I can from blue button on my healthy vet download it to a disc and bring it into the DDS place.
  11. yikes... I been using it for like half a year with no problems until now.
  12. I have no idea what to do, my appointments aren't updating, my notes aren't updating, it been like weeks..April 22nd was the last update.
  13. I talked with my psychiatrist at the va, he said he'll talk with his team and write me a letter in support of IU. If I have a MD and psy.d agreeing would this improve my chances of IU?
  14. va has to request, I have to ask the VA to request them. I found the form to get the VA to request the records, I'll talk with the psychward monday to see how i can get them.
  15. The VA put me in a private psych ward a few months ago. I filed an IU claim and the ebens is requesting evidence from private doctors. How do I get the ebens people to request my medical records from the psych ward? I could do it myself but I have then pay them 25 dollars then a dollar per page and the psych ward is like 60 minutes away!
  16. 4 weeks ago I filed a New FDC claim for 2 conditions I have online. 2 weeks later I filed for IU online. under online applications it shows the FC claim and IU as submitted online on the correct dates. When I go to claim status only the FDC claim shows up and no mention of IU claim. Should I submit another IU claim? Should I contact some? My anxiety is bad.
  17. Ask a mental health professional. If I had to guess, chronic means constant, non chronic mean occasional or requires a trigger.
  18. https://www.baycitizen.org/data/veterans/map-disabled-vets-stuck-backlog-limbo/
  19. I thought if you were diagnosed with something within a year of discharge it was considered SC?
  20. I don't fit the bracket for 100% in mental health, my reward letter explains it. I do think I am unemployable though due to my bipolar disorder... I applied yesterday online for IU. I had also applied for 2 new things the week before. Will they combine the 2 claims or do them separately?
  21. recently got rated 70% for bipolar/anxiety 30% for headaches and 10% for tinnitus. My claim has complete exactly one year after discharge and it has not been a good year or 2. It's hard to leave the house, my mood is constantly depressed, I'm not supporting myself, living with parents. My military career was going great until the bipolar hit. I can't work in my current state and my psychologist at the VA agrees. I'm grateful for my 80% but I can't live on my own with this. Is it too early to file for TDIU? What's the worse that could happen, lower my current ratings?
  22. the symptoms and how whatever your condition affects your functioning are the important part, I'd worry about that instead of the diagnosis.
