  1. If you are FERS you can get SSDI. If you are CSRS you can't. I presume you get a disability pension from the Feds? I would sure try for TDIU if you are 70%. It will be more than your disability pension from the feds because it is tax free. My FERS and SSDI do not match what I get from the VA. When you hit 62 the feds are supposed to recompute your disability pension. I got 29 years and about 7 months time.
  2. Boxer Yes, it is the same old VA maybe with some cheap new paint. They still want to try and wait you out with hopes you will die before your claim is decided. I just do my claims step by step and stay within time limits for appeals. I feel it is time to call in the lawyers if you feel that you are in way over your head, or you get to the CAVC. I think to some extent having a lawyer at the BVA is a waste of time. What you do want is for your claim to be perfected before it gets to CAVC.
  3. Where is your claim right now? Claims go from VARO to the BVA and then can be appealed to CAVC. This in itself takes years. You get remands all along the way usually. You can get into federal court but this is after all the other avenues are exhausted. I guess what I am asking is where is your claim now in the appeals process?
  4. Where did you find this lawyer? When you have to tell you own lawyer to file a NOD that seems strange.
  5. The VA is waiting for us and our spouses to die. They know they can out live all of us.
  6. We will be in Afghanistan at least two more years. The VA sees this surge of veterans who have been exposed to combat conditions and they just do not want to pay the cost of PTSD claims. I trust the VA about as far as I can throw them. They misdiagnosed me for years and low balled me for decades. If not for IMO's I would still be at 30%. I agree with all that it will get harder to get a PTSD DX from the VA. Everyone on that court needs to experience a fast and dirty C&P exam at the VA to see just how bad they are at making a good DX. The number of PD and adjustment disorder DX's will rise. Soon the vet will have to be stark, raving mad to get a MH disagnosis.
  7. Boomer With numbers like what you have I think you will probably get classic DMII in the future. I started out with those type of numbers back in 2000 when I went for AO Registry Exam. That is like saying you have high blood pressure if you are 140/90 but not if you are 139/89. I think I would seek treatment for DMII outside the VA because you may have damage via secondary disorders by the time the VA gets around to saying you have DMII. Your eyes, your feet, and your heart are places you are vulnerable. John
  8. VSO's should push VA to pay interest on these awards. The poor vet waits maybe 15 or 20 years for an award suffering all the while and gets nothing but what he should have gotten in the first place. The VA has every motivation to delay these awards forever. Does the VA charge interest if they find that you owe them money rare as that is? The VA hounded me for $200 back in the 1970's like you would not believe. They made a mistake in my G.I. Bill. I beat the payback, but it was an ordeal and I was dirt poor.
  9. T8r If the vet had a hga1c of at least 6.5 that would indicate a DX of diabetes. The military and VA often will put off a DX of DMII until you hit that magic number of 126 fasting glucose or the 6.5 for hga1c. You could have readings just a point below those magic numbers and they will say pre-diabetes. I think this is arbitrary and really makes no sense except for those who have to compensate vets. Do doctor regulary ask for hga1c unless they suspect DMII? A high fasting glucose reading would indicate possible DMII and the hga1c would confirm it. Then there is the test where you drink or eat a meal and they take before and after blood after 2 hours, but they usually have to suspect DMII.
  10. How can anyone determine which part of his mental/emotional problems are the result of the brain injury and which are from PTSD? Does he get a VA pension?
  11. Moving while you are waiting for a decision from the VA is usually a bad idea. These guys can screw up a %$# dream. I have been in the same place for 25 years and the VA has screwed me up once or twice with bad addresses getting into the system. I would bet the fact you moved slowed down your claim. There are lots of retired vets in AZ. When you move I don't know if you go to the end of the line in the new VARO or not. Don't even think of moving until you get a decision. John
  12. What were your fasting glucose levels? There are levels that are considered high and then there are levels that are considered DX for DMII. If you have fasting glucose of 120 that is high, and probably means you will get DMII. If you have glucose of 200 that is diabetes if you get that kind of level more than once or twice. Is there anything in your SMR's that says pre-diabetic or "at risk for diabetes"?
  13. If the VA has evidence that a veteran is unemployable due to SC condition they are supposed to infer possible TDIU. I got this from VBM. They used example of vet with foot odor. The VA sets up arbitrary limits and rating criteria as far as inferring things. They are supposed to infer possible HB if a vet is 100% schedular for one disability.
  14. How about a realistic time frame for your claims progress through the system? Way too much to ask for I think. Better just to throw dice or buy a VA lotto ticket. How is it possible for SSD to do it in three months?
  15. The VA said they did not have my DD214 and I have been SC since 1971. They were just too lazy to look in my C-File.
  16. Carlie Yeah, I forgot her 80% is too much money for NSC pension. She should still apply for SSD. There has just got to be a way for her to avoid being homeless via some VA program.
  17. I read about a WWII vet who fought in France and Germany. He suffered severe cold weather injuries. He put in a claim back in 1946 I think. He was denied because his records were lost. He suffered for over 60 years. Finally at age 93 he was granted benefits. I don't think the benefits were retro, however. This is the way the VA and DOD treat the "Greatest Generation". Think about how they treat us.
  18. Have you filed out the official form for TDIU? I don't know anyone who has a 70% rating for depression who can actually hold a job. Same for PTSD. These things cause you to miss work and unless you work for the VA you are usually gone in six months. It is time to put in SSD claim.
  19. I think I would start by talking to a VA social worker about becoming homeless. It is hell when you are unable to support yourself and have to wait on the VA to crank out your decision. Many here have gone through this phase. I would go to the VARO and talk to a couselor about your financial situation and I would just keep asking and pressing them for help. They have programs for homeless vets especially in your case where you have a high SC rating. Have you applied for social security disability? You are also eligible for a NSC pension for the time being. Don't give up. I got SSD a year before I got TDIU. You are a service connected vet. You are not a drunk or a bum. The VA has a responsibility to you. John
  20. These C&P exam doctors get paid piece rate. They are not going to read 100 pages of evidence from a vet they talked to for 15 minutes. They are paid to give a picture of your disability as they see it on such and such a date. Then they give an opinion about your disability being SC or not SC. Better to put more effort into finding good IMO doctors or the opinions of your own private doctor if you have one.

  22. When you hand your new evidence to the C&P doctor you have no proof that you submitted it unless the exam doctor gives you a receipt and I bet he/she won't do that. Many don't even want to look at previous evidence because they want to have an independent look at you with no preconceived notions. At least that is what one told me. I think he was just lazy and need to cram in a few more exams before lunch. You need a papertrail to prove you submitted new evidence. VARO's are great at losing evidence.
  23. John Basser That is a very concise and complete doctor's statement. That is all the vet really needs I think. The doctor needs to break it down so that the VA cannot dispute it. I think if your fasting glucose levels are >126 on repeated tests in the SMR's then that is good evidence since the military probably does not bother to get more tests until the vet passes out one day in diabetic coma.
  24. When you have 100% or Total plus 60% you will be eligible for "S" or housebound.
