  1. Remember this. anything you claim happened while STATIONED IN AN ACTIVE THEATER OF WAR.. must be taken as true and correct fact, unless is so riduculous it seems to be false. heres how much leeway it has though, a guy claimed he was kidnapped by aliens, and he WON!!! no shit.
  2. we are trying to get initial service connection for anxiety/depression. current diagnosis is solid, now we need Nexus of origination in service. Mental health doc with connections or affiliations with pre natal, post natal, maternity issues would be a bonus. we may take a 2 pronged approach as well and get a maternity doc and mental health doc opinions. Thanks very much for the help, we will check into these folks.
  3. heres an old standby CP examiners use. ok the format on the form will have a question then underneath the same a box to check/ example. Does the scar the veteran has become painful ? YES check the box that applies.. is the scar painful.. AND THEY CHECK THE BOX THAT SAYS NO!!! ok, so when this form is fed into the machine, the boxes that are checked is what the M21 system sees. THE BOX THAT IS CHECKED IS WHAT COUNTS!!!! Ive caught this trick on several exams Ive had, and called them on it. I got a new exams due to this. AND won. Ive actually had 3 different exams for one condition due to catching " mistakes" made on CP exams. READ them carefully and be sure the boxes checked are in agreement with what was said!!!!
  4. either they are blatantly screwing veterans over, or it doesnt require very much gray matter between the ears to get a medical license. sometimes I wonder. dont they know were going to follow up on thier reports? or do they all assume were dumb asses because we were GIs. some of the most intelligent folks ive ever met are vets.

"I did not know that VA Dr's had permission to take Veterans Medical Records Home with them to read? this would be a hippa violation. there only required to read them in a professional work like setting preferably a work station....what if the Dr had a car accident on the way home and that Veterans medical records were scattered up and down the roadway. I forget what regulations that's under but its there."" this is funny,because the VA is in a perpetual state of malpractice.. so taking home records wouldnt even be considered a violation in a system of gross negligence .. ha it would be akin to swiping some company ink pens .
  6. so think abt it, the CP docs have 2 incentives to screw you, one they get paid by the VA 2 If they get rated and ranked for " performance" you can bet your lucky marble they get bonuses. so you tell me. is this system fair, when they get no positive mojo for helping a veteran? Fairness in this system is an IMPOSSIBILITY!!!! This system needs to be challenged in the courts because it is a scam.
  7. these examiners ALL work for the va.. There is no way there cannot be a conflict of interest. When the C,P examiner looks at your file, and sees that you were denied before, what do u think there inclination will be.. will it be to go against the VA and say , you were wrong? HIGHLY UNLIKELY' Let me tell u a story. back when I was getting CP exams, there was a doctor CHOW in texas that screwed up my exams royally. I was able to get another exam due to it. When I went to the next examiner, who was a veteran from the Philippines, he was there when Mc Arthur was there, lived it, very nice Dr. He told me, it dont matter if u served one day or 3 decades, we all raised our hands and made the sacrifice he was very grateful that american soldier helped his country, he recalled when MCarthur said.. . " i SHALL RETURN", and so happy when he did return to save what was left of his country.. I could tell he was a great man. and had been thru alot.. I could see this mans charecter and constitution in his eyes. . He told me that good old Dr Chow had the highest rating in thier sector amongst CP docs. They are in a local network. He told me this doctor was well known for screwing the veterans. It seems like the doctors share a building, and work on the VA stuff part time.. This doctor would not even interact with the other doctors in the facility he wouldnt even allow them in his office to bullshit.. . At my CP appts, he refused to even shake my hand. This Dr CHOW, in my opinion couldnt care less abt veterans, and was more concerned abt getting a fat check and high rating from the VA likely a bonus as well. This particular Dr is in central texas, and if you get scheduled with him, your likely going to get the short end of the stick is my personal opinion. I was kind of surprized that the kind DR was telling me all of this stuff abt his fellow DR but I had kind of figured it out anyway. The veterans should be able to choose who does thier exams, because the current system is rigged against the veteran.
  8. well theres some accountability now at the VA , its amazing how folks tend to start doing thier jobs when the possibility of being terminated becomes a real possibility. Evidently theres a selection process for vets being chosen for the ramp program that they are using. The particular claim im involved in has been getting kicked around at the RO for close to 6 years now. Will it be an embarrassment for this claim to show up at the board of appeals with a 6 year dickering history on it, very likely.. can the RO be shamed, I doubt it. after the last denial they dickered with it for almost a year, before offering the ramp program. I dont think they ever actually certified the claim to go to BOA, we filed the form 9, and waited.. we never were placed on the docket, and im sure of that because I checked. . they kept it in a state of limbo, to pad the numbers is my hunch. .there was no reason for them to sit on it for close to a year. Then they pull the Ramp program out of the hat, with a 90 day adjudication target as a carrot to keep it from going to BOA even longer. If they can pull a third of the claims into the ramp program to avoid them going to BOA, heck, on paper. they magically just reduced the backlog by 30 percent. I truly hope this Ramp initiative isnt more of a numbers washing tactic than anything else. Time shall reveal ... in fairness Ive heard good things abt ramp as well.

NEEDED . veteran friendly mental health doctor in the great state of texas, we are playing the evidence game with the VA and were are down one , (strange how that happens when the person they send you to at VES gets thier check from the VA)....thanks Dr Mara ... so we need a reasonably priced IME Doctor of psychiatry in preferably Tejas... , but if needed will travel to oklahoma, thank ye! Pro BUENO (pro bono,, free,, gratis..) would be awesome, but willing to pay reasonable fee.
  10. we got ramped and raped at abt the 90 day mark out of waco, tx.. seems they are now working at breakass speed to get to the claims and deny them . ha . really, I think they are trying to keep claims out of the Board of veterans appeals more than anything.. why, I bet it was a directive from the head shed. Maybe the circuit court judges arent getting enough cocktail or tee time and they complained. thats important ya know.
  11. Ive been to several in Waco, insist on a formal hearing, and take note if they start turning the recorder off and on. The meeting will be non adversarial. they may just be trying to see what evidence you have, by no means give them an original. lay your evidence out, and see what they are trying to do. you can show up, lay out your case, and ask to schedule another meeting in the near future. you can bring a computer in with you. you will go thru a metal detector. so if you have a tape recorder put it in your purse. Waco isnt a bad place to have a claim, if you get the right DRO.. you can do this. just be vigilant, smart, and aware.

Today I spoke with an inside source at my local VA and was told that the reason the DR s dont want to write up anything for vets is they are scared the vet will file a claim, based on what thew DR writes.. so this should tell you everything.. the DR are getting repercussions for writing them.. just as I suspected. So theres another landmine in the veterans path to impede us from getting the benefits that were supposed to be guaranteed to us under the laws of this country and part of our benefits package. they just continue to chip away at things that are supposed to help the veterans. The fact that the doctors at the VA are working in a situation of duress, is very disturbing. It puts me in a dilemma because the doctors likely dont want to deny the vets, but if they dont, they catch hell. just an evil institution.
  13. I would like to point out that a veteran can request a hearing at thier local Regional office at any time your claim is still there, . If you would like to try and get something cleared up, you can request a conference and they will see you, prior to a decision or after.. . I didnt know this until not too long ago. I think calling them would be much easier but they dont allow it. Shortly after a negative decision has been made, before the ink dries good, can be a good time for a conference, that could clarify wrong information, and lead to a favorable claim, also, at a hearing, you can ask the regional office EXACTLY what needs to be done to win your claim, if there is a path, they are required to tell you by law. A couple hours of your time, could save you years in waiting for appeal. It can also be a opportunity to submit evidence, in a tamper resistant environment, because in a formal conference, they are supposed to record everything being said and done. be sure to ask for a formal conference if you wish to submit evidence, because it will likely insure what u submit doesnt go into the shredder. if the person you are in front of turns the microphone off when you attempt to submit evidence, then they are trying to screw you. this actually happened to me. the person who did it no longer works for the VA though.. . Good riddance S Wilbur..
  14. Folks lie abt things to get into the millitary all the time, and the millitary turns a blind eye, depending on how bad they need folks. I flunked the marijuana exam first try, second try I was sworn in. walked into the Mepps in New Orleans , they needed a warm body to train. they got one.
  15. they already approved the PTSD with sub abuse secondary, YOU WIN! talk abt double talk GEEZ. what bullshit!!! I would request a formal conference at your regional office ASAP. point out the fact that it is symptomatic to your PTSD, which they have already acknowledged.. You were screened before entering service, and if the substance abuse didnt come out in the wash, and they accepted you, they cant go digging up bones now. really though we need more info, what exactly are u claiming, what other evidence was considered, what other info was in the denial. have you filed before and what for and when.. theres alot of intricacies that can affect a claim. did u disclose any problems to the millitary prior to service.
  16. good stuff, let them cut the pizza how they want, long as they give the whole box to the vet!!! sometimes I think the VA cannot discern between a symptom of a disease or injury, or the disease or injury itself BACK STRAIN.. now thats a symptom, but it sound very mild. so the V loves it. have you ever heard a real doctor say,,, ohh yes, patient stiiffypoke,, that poor guy, hes had a back strain for 10 years now.. a back strain is a mild, short term injury. Not something that goes on for years. but you see , they dont want to know the extent of the problem, because it forces additional comp. so they quickly give u the ole faithful back strain diagnosis, your empty peanut shell rating, and hope u go away. yes you can go away mad, but just go away. hell they will pay you less in 5 years at 10 percent than what a full spine MRI costs.. very clever they are .

""" THAT WAS SLICK MY FRIEND. ha yes Buck, I always look at the whys of situations. I think that these Drs are getting ass chewings from the regional offices who are handling the claims. when someone doesnt want to do something that otherwise seems like a simple task, there usually is a reason behind it. The doctors are experiencing some sort of unpleasant result of writing these DBQs. The form is simple, short and easy enough for a 6 year old to fill out, so thats not the problem. there has to be repercussions that are taking place. Its occassionally throwing monkey wrenches in the RO s claim denial processes. my wife said same thing, her doctor instantly sat straight as a board, like a hemmoroid busted in her tighty whities, and her whole demeanor changed, and she barked out a loud and clear "I DONT WRITE DBQS FOR NOBODY, VA OR SOCIAL SECURITY". like she was pronouncing her constitution or something.. ha
  18. I was under the impression that a vet can only be service connected for a specific mental disorder, like you cant get 20 for anxiety, 20 for depression, 30 for ptsd, ect, its called pyramiding.
  19. the only reason they should ask to see you bend is if your spine was fused, and they want to see how much flexion you have lost. its ridiculous I tell ya. Ive been recieving alot of treatment on my spine, and learned alot. Once again, I have NEVER been asked to demonstrate how far I could bend, by any medical professional. so where the Va got this hokus pokus test is a mystery to me. just some mechanical test so the vet buys the scam I imagine. when you go see a pain doctor, neurologist, ect you know what they say... SHOW ME THE MRI report... !!! they dont say, bend over .. it may say that on your bill, but not your diagnosis. LOL

    I recall years back when u first came to the forum, now your a moderator!! freakin awesome. I have been absent, awol, but im back, and will try to help best I can. Ive been thru ALOT with the VA. I learned alot too, thru walking thru the fire .   if theres a shenanigan the VA hasnt pulled on me Id love to know of it, ha . The best thing we can do to help these veterans is educate them.   These younger guys are very resourceful,  if we point them in the right direction, they know how to harvest the info very quickly, many were born with a computer in the house.  The internet is the great equalizer of modern times.   

    right now we are fighting for my wifes claim, the  RO in waco has been wiping thier arse with it for 6 years. were giving them hell though.  got in the  Ramp program, they got to it in abt 90 days, but sound like they want to deny again, last time they denied, a year went by before they even certified it, and we werent even on the docket yet to go to the BVA.   C&P tommorow, wish us luck.   22. yes, we are putting in for a change of doctors very soon. I was telling my wife, as a psyc doc, she should be the last person at the VA you would find uncaring and unhelpful to a veteran. A shrink should be the shelter you run to in times of storms. a confidant, a champion for you. a supporter, trusted role model. if the sorry excuse for a doctor she is seeing has the attitude she has,, SHE IS NOT WORTHY OF TREATING MY WIFE. , she deserves better than a greencard collecting a paycheck on a work visa with a reciprocal medical degree substiute . My wife is a veteran of the greatest military, of the greatest country on the planet, and a shake and bake white coat with a fake MD behind her name isnt worthy of caring for her. . and she will hear that to her face very soon.

Additionally, completion of medical forms by health care providers based on an examination or knowledge of the Veteran’s conditions, is included under title 38 Code of Federal Regulations (CFR) 17.38(a)(1)(xv) as part of the medical benefits package (with the exception of the completion of examination forms if a third party would customarily pay health care practitioners for the examination, but will not pay VA). NOTE: At present, as a matter of policy, there are no known forms that would fall under this exception. unless there is a revision or addendum to this law, I cant see how they could decline doing this job under the law
  24. on the same token, yes I know the point of trying to make this Doc do thier job to help our cause is a moot point, but letting VA doctors refuse to do the jobs that our tax dollars are paying them to do, just giving them the green light to disregard thier job description isnt fair to the veterans. If it is in thier job description, and the veteran asks, they should do the job asked of them. when you dont hold people accountable for thier actions, or in this case, inaction, it encourages bad behavior.
