To be considered for an increase:
Hypertensive vascular disease (hypertension and isolated systolic
hypertension):
Diastolic pressure predominantly 130 or more......................................................... 60
Diastolic pressure predominantly 120 or more......................................................... 40
You have to go after Kidney disease. Remember regardless of what the RO says, HTN always effects the kidneys either directly or indirectly. Also known as aggravation.

Get your Doc to fill this out. Rationale will be needed to connect current issues with service. Arthritis is a good point as it will help form a time line.

Then have the Doc attach an opinion.
You may need a stronger advocate than the DAV. I suggest an accredited agent when the VA denies your request to re open.

The defense bill has Space A included and Hagel made it disappear.
How do we like that move. The Air Force does not want disabled vets flying space a.

VA doctors do not like it when the VBA adds to their workload by shoving forms at them without getting their input.
That is why the docs refuse to do the DBQ.

I suggest filing a NOD or Notice of Disagreement and obtaining an outside IME. Now you can bring a Claims Agent or Attorney on board to help you.

You need a change in representation ASAP. You need an accredited person to work your appeal.

Ask for 100 percent convalesence rating because of surgery. Then battle for SMC S. Are you IU p and t?

Joe if they fail to secondary the HTN,you should ask the VA in the form of a NOD to state that the HTN if not secondary be rated as an aggravation to your service connected heart disease. Since it likely will be rated zero % unless your Systolic (top) number is 160 or Diastolic number (bottom) is predominately 100. Any cardiologist will write an opinion for that.

Cue is based on a leagal error. Evidence weight or typos will not work. You must find something within the regs that they violated or mis rated.

You do not have to prove you had secondary conditions in service as many arise years later. All you need is a doc to state that your conditions are related to diabetes.
Are you service connected for heart disease? You should be and that should SC your HTN.

Your diabetes and ischemic heart disease (blocked arteries) are presumptive to Agent Orange exposure, See Nehmer decision attached. http://www.leagle.com/decision/1999120732FSupp2d1175_11060/NEHMER v. U.S. VETERANS ADMIN.
You are a member of this action and the VA refusal to grant your claim is nothing but a plot to deny your benefits.
You should fire your reps and pick up an attorney or claims agent who will become vested in your claim and fix it for you.

Everything with the VA involves a fight. You NOD a decision if within 1 year of a denial or if too late, cue the original decision. If you win it goes back to 97.

(c)Service department records.
(1) Notwithstanding any other section in this part, at any time after VA issues a decision on a claim, if VA receives or associates with the claims file relevant official service department records that existed and had not been associated with the claims file when VA first decided the claim, VA will reconsider the claim, notwithstanding paragraph (a) of this section. We did this show to bring awareness to a potential disaster scenario for veterans receiving IU and SSDI.
I have been predicting events like this over the past several years. The CBO is a think tank that always brainstorms ways to for the Government to save Money. They are also tasked with the financial side for Bills by giving estimated costs for all bills. Their recommendations are really interpeted into each congressional piece of legislation. This time Mulvaney has really proposed a budget that shows an increase to the Dept of veterans Affairs by adding to the VHA and taking from the VBA. The improvements are Choice Card, Hiring Doctors and No Choice Card extension. Anyone tried to use the choice card? The cuts to the VBA are IU compensation when a Veteran reaches age 62.
This is still in the Congress as of this morning. If someone said It had passed the house then there was mistake made. If I did say that I was wrong and Apologize to the audience.
Now is the time to act to show your representatives that you do not agree with this Proposal. All of the Big Veterans Organizations are against it.
This budget also indicates SSDI will also be cut as it is known by the politicians as a form of welfare according to Mulvaney. This means if you are a disabled bet under 62 and receiving SSDI you will be re evaluated by the SSDI in an attempt to sever your benefits.
Also keep in mind that the Political Structure in DC has changed and things like this are more likely to pass then they were in previous years.

Contact the patient advocate where you saw this doc. Explain the wrong information and state that it my have an adverse effect on your benefits. Show documentation.

Berta this one was cut and dry. A vet service connected for a lung disorder except asthma and has Pulmonary HTN shall be rated 100 percent regardless of PFT results.

Champ changes to secondary payer when spouse turns 65 or gets medicare. Champ VA pays the other co pays and is still primary for meds.

When you won the clain you should have added your kids to your VA comp. The VA pays extra for Kids and it is charted. You are the beneficiary of that money and it should go for the Kids well being.
