Some times the veteran while at a exam rather or not a C& P or just seeing his/her pcp... may ''not'' know what to say when ask about their condition or know what to say like the stressors the Doc's listen for! Some VA Docs knows how to ask questions in a way that the veteran don't know how to put an answer to and usually this is what usually happens & unfortunately tends to warrant a denial. Just always remember any time you see a VA Dr there's a report of that particular exam and the C&P examiner will go back and read all those reports. also be wise to the fact that any IMO that you submit they have those too! Keep copies of everything you send them never throw any of that kind of paper work away you never know when you might need them. Like bronco mention seek different Dr's!! Just my opinion but get Referal an IMO for a good compassionate Doc will help. A Doc you can relate to...and one that will listen to you. Its just sometimes a better way to go and its always a good Ideal to go get your medical records after you have an exam from a VA Doc so you kinda know what there saying about you before you file. I wish you the very best with this its just a Rock in the road and you need to remove it! Hang in there you will win!
  3. CRUISER07 Sorry you guys are worried about this...it sounds to me there's just a big mix up or someone else claim got placed in his c-file?? some of them clerks at the VARO just bunch of idiots! Did you get a letter from VARO with a re-evaulation set up? if not...try not to worry! if you have to appeal then as long as his claim is in the appeal process they can't stop anything! I think you can get DIC if your hubby passes he is 100% P/T so keep that letter you have that says that..did that same letter state that his disability was of nature and no furture exams schedule? I don't think he has to be service connected for you to get DIC.....I was reading something about that today is why I'm asking...anyway if he was awarded 100% P/T I don't think you should worry.....However you may want to request his c file from VARO or make appointment & go there and look at it check all the files and see if the letters are in it that they just sent you? & even the ones you already have! I See no reason him not applying for SSDI has anything to do with this?? that is his right & his choice rather or not he wanted to file for that!!!! just money he is not getting but that would be his choice in my opinion. if he gets a letter for re-evaluation...I think I would go to that VARO & Show/tell them what all you been sent from them out of the wild blue and your hubby is still 100% P/T Been that way for over 20 years he should be protected under the 20 year rule! He is disable and can't work..and you want this cleared up asap! If you guys need to Appeal. Here at hadit there are some great folks that can help you guys berta is one of them! Hang in there!
  4. Yes Tbird it sure is Thank You! Carlie you don't have to see your Dr? labs test ect,,ect,, every 3 months? I understand they can only prescribe up to 3 months you have to see your Dr (every 3 months... ..so when you see your pcp he/she set up your scripts for 3 months and you just call your pcp each month for refills? I just seen my pcp and got a prescription for the same as yours 10 mg and they mail in the us postal service certified not fed-ex.....Just picked it up yesterday but it took 12 days...I always oder by phone 2 weeks early sometimes they say this medication is not refiliable at this time so I wait a few days..kinda of a hassle but I learn to do that, I guess each state is different the way they ship it to ya. it use to come to my po box not anymore well actually it does but they give you the pink slip in your box to go to the counter and sign for it now.

There's no telling who you talked with at BVD,..,just hang in there buddy wait until you see what the letter says from BVD sounds like something is not right, just hang on to that certified copy...can be used as evidence and proof!... but I also thought you said you faxed the 9? I hate it when this happens to a brother vet! you will win just keep on hanging in there!

I understand, I wish you the best buddy hang in there and you may just have a big old 8 year party! lets hope! in the mean time the waiting still lags on...just keep yourself busy these next few weeks try not to think negative, if your denied this time , read how they based their decision. If it was me and I was denied I'd get all the evidence IMO's statements from family/friends Dr's sometimes the VA Dr's can sure mess up a good claim I think you have 60 days with BVA to refile so watch the timeline..you probably already know all this. That post about the DRO is a good read! he explains the appealing process pretty good and what a vet needs to do if being denied. but this time is going to be your time and your going to have that 8 year party!!

I understand it that the VA Pharmacy will no longer refill schedule II narcotic medication hydrocodone (pain meds) but every 28 days as of Oct 6th 2014...before this change I got prescriptions via mail with 6 months of refills...I live to far from the VAMC to go there ever 28 days to see a VA Doc to get a 28 day supply...This applys to both VA & Retail I can understand the concern of addictive potential, but when some one is in pain and that's bout all you can take to help grrr..Just another way cutting back on spending and it sucks for us vets that need it..for pain that is!
  8. 8 years wow oh my goodness velord that's sad to hear....long wait for ya buddy! I was thinking if the BVA has come to a decision or remand with instructions why did they send his C-File back to the VAMC? Maybe a Comp& Pen? Aren't our C- Files kept at the VARO?? Hopefully they come to a decision in your favor! I'm hoping for ya buddy btw, There is a DRO that posted about the appealing process on here some where?? It has some good info in it! I think it was title something like ''Submission for the record of ''Matthew Middlemas'' DRO this may shine some light for you velord? Maybe Ms carlie can find it? velord ,you mention getting grey I think that's true for most veterans...I was dark brn hair before I started fighting back/forth with the VA Now I'am all silver headed be nice to get that rated j/k.. LoL
  9. Try medical records at your VAMC check with them you can request your medical records with them..I think the VA does everything by computer and your last 4. I had a comp&pen and week later went and got copies at the VAMC where I had my c & p exam. beings everything is on the computer I would think you could get the copies!
  10. Right on broncovet great advise there buddy! HellRaiser7 if these disability's keep you from working, & finding gainful employment or the job you was train to do and you can't....I'd file for IU If you get a VARO DRO Hearing then you can present all your evidence and meet face to face with the big guys that make the decision..I was 50% rated and a VA Dr tried to have that taken away reduce me back to zero 0%. I had a VARO DRO hearing and was awarded higher rating and lucky for me the DRO awarded me the TDIU P/T without any furture exams..I was 48 at the time...that's been 14 years ago! I Had VA Rating Specialist at my hearing also So so might want to request one, & like broncovet mention check the ratings criteria and compare what you have. I Trully think you get a lot better results confronting the VA verse by mail.. The Hearing was the best think I ever did. hadit help me 14 years ago! great bunch of people here at hadit! But a lot of regulations has changed since then, let these great folks here at hadit help you! If you don't have a ''Federal Benefits booklet # P 94663 pick ya one up at any Vet Center I believe the 100% rating for TDIU with spouse currently 3,017,60 as 0f 2014 But I'm not totally sure what you may get because there's SMP awards also!   11. Coastie 72 I forgot to mention this to you,.. you may already know? But every time you send VA something snail mail ( us postal) be sure and ''certified with return receipt'' Always Buddy!
  12. oic cosatie72, you may want go to the VAMC where you had this/these test and go to the medical records room and request them! And remember phone calls is not good as evidence you need probative evidence to support your claim...mostly reports from Dr's > VA or Private. The reports will let you know what all the VA Dr said..They make reports on everything even what you tell them and sometimes D'r just add/say what they want most of the time, this can be good or bad? Tell your Dr everything that happen to you mostly the things you mention above, ect,,ect,, you may want to get statements from family /friends telling bout your behavior /condition ect,, ect,, just nortrize them before you send them in ! ..This is why it's important to keep track sorta speak....and if the Dr, says your have mental problems and all your exams are in your favor , that be good just wait until you have all these test completed & then get your reports and also you may want to go get an IMO ( Independent Medical Opinion) if in your favor I'd ask the private Dr to write you a little letter stating In his/her evaluation its likey to as not caused from his prior service while performing his military dutys ..something along those lines just let that Doc know your trying for a higher evaualtion but not the VA Docs that's what comp & pen is for ...Get all the medical evidence you possibly can. if you feel like getting an increase then file but make sure the exams are favorable to you first. Sounds like you have a good start my friend (for higher evaluation) Be ready to hear from your VARO after you file a claim for increase they probably set you up for a COMP &PEN probably with MS if they can't come to a decision? Like John mention just let it all hang out with MS Just Hang in there buddy.
  13. jbasser or John 999 I think one you mention sending in an employment questionnaire every year? to let them know your not working...I use to send it in every year after I got my TDIU P/T with no future exams...I got a letter From My VARO bout four years ago and they said I don't have to send in the questionnaire ..So I stopped sending them that's been about 4 years ago or so I been getting TDIU now for about 14 years. Now here is what kinda worrys me I turn Retirement Age this year so I filed for my SS Retirement (on the years I did work prior to my sc disability's so I never had the full aledge years the SS requires...My wife happen to land a good paying job about 5 years ago and makes A Heffty income...they take out her own taxes ect,,ect,, Well what worry's me is the SSA told me in a letter if our combined income is over 32.000.00 year then I have to pay tax on my SS Retirement. (my wife makes that alone) & I realize my VA Comp is non taxable. I just hope the VA don't see I pay taxes and think I'm working??..I know how the VA can mess up things for the Veteran..do either of you guys know what will happen? I maybe worrying for nothing..but you guys seem to be the ones to ask about stuff like this . As Fellow disable veteran I slute you guys... Thank you both for helping our Veteran's.
  14. Why would you want VA to cancel your TDIU? In the first place? I am missing something here? Are you trying to get 100% rating with your TDIU?& still work?...Um your rated at 90% but there paying you at 100% TDIU and told you that will not change....It will change if you continue to work. that's what everyone is telling you...be glad to get what the VA gives you. The person you mention that works as a county commissioner getting TDIU ...is luckly the VA ain't caught on to him. If you work like everyone has mention that's a good way to lose it...VA checks with SSD if you pay FICA taxes...then they know your working obviously... TDIU to me is a previlage that you earn from medical problems occured while in the service & that keeps you from working. & if your getting 20% for tinnitus your the first veteran I know that gets that 20 %? US vets that get it deserve it.(not saying you don't) I just hate to see a veteran lose what the VA gives him /her after we all struggle to get what we can get ...I Know I'm very blessed to get it.. I don't know what in the world I would have did without it. it came in handy for this family.

Oh yeah ol'e Waylon RIP, Coastie72 you went for your exams few days ago or to your Dr...how did that go? and are you currently 10% for your tinnitus? carlie mention that that (tinnitus) can be secondary to a mental condition...if you have PTSD or some other mental disorder the Docs should tell you that...that's your reasons your having night mares and not sleeping and just having a hard time with life itself...if you can get SC for this file for in increase....I know you would rather not have tinnitus me either but we don't really have a cholce so why not get compensated for all your sufferin my friend!
  16. Note Mikemmlj T bird posted that about what you been looking for above! Is the 20 year rule in effect as to when you won your award ? or does it go back to retro? like if you won your award in 2003 but was retro back to 2002..does the 20 year rule apply? to the 2003 or 2002? or when? and does it make a difference if your 100%... or 90% drawing 100%TDIU? What about the 5 year rule? and he 10 year rule?...I never seen a 15 year rule. After 20 years then your safe? unless you go back to work and report your income to the SSA...correct? Thanks Everyone!

COASTIE 72 You may try to contact the news media or the news paper in that area they should be able to help you with this and go back to those dates and the police Dept should help you unless the case has not be solved? but for you I think they could help you on the dates you recoverd the body and they should have your name as in the rescue team....The USCG should have some evidence on this? If not then you can go the' presumption'' way and tell your story,
  18. Just Vet to Vet here! My reason I want them to increase tinnitus...some veterans are not hard of hearing but have tinnitus and it gets to where it effects the hearing & other mental disability's like coastie 72...usually a if a vet gets a hearing test from the VA if the test warrants the hearing is ok or not bad enough to warrant comp but can still get it SC (that don't make a lick of sense to me?).. & the vet tells them about ringing in the ears its sluffed off and the vet gives up...I've witness that to happen...I suppose if the vet ever got hard of hearing the service connection would help. but when the vet gets turn down they usually never go back..I understand why simply because to me a vet can be hard of hearing and it not show with the test or the vet has a hard time with word discrimination. we don't live in a bubble world! In my opinion if someone has tinnitus then that's a hearing disorder and 10% is not enough comp for the vet especially if he can produce evidence he got it while in the service...having servere tinnitus is getting to be a problem for vets that can't even get the 10%..if they get it then like someone mention they can file a secondary claim for depression & maybe that's what coastie 72 needs to do? just saying...Vet to Vet!
  19. Hugh, Have you ever had a DRO Hearing before? if your having hard time financially ? 2 years is a long long time to wait, ask your RO to expidite this,! I requested DRO hearing and went alone just me and my spouse while at the RO I did get a VSO he was not much help , just told us what to expect be nice and be thankful ect,,ect,, but I had all my ducks in a row and some favorable IMO's...Rehab letters in my favor ..ect,,ect,, They called us in this room a long table with microphones at each chair with recording devics's...ect,,ect,, It was a little nerve wrecking..but after I got over the surroundings...the DRO & Rating Specialist walked in , introduced themselves. DRO ask me how they can help me today, I said thank you sir for allowing me to be here and present my evidence and to dispute this said VA Dr Thank you for your time, then I told them what happen to me with the VA Dr, They had some of my evidence but I took new evidence and presented them along with a letter stating why I think I warrant the increase and why I disagreed with the VAMC Dr that tried to mess up my claim to reduce me back to 0%, basicly that's what my claim was all about. Luckly for me the DRO was in my favor and disagreed with the VA Dr...I won my claim that day and they expedited everything rated me 100% TDIU P/T. I think its good that veterans can request a DRO hearing you can see them face to face and they can see your disability is real..and you don't have to be worrying if they lose anything its all right there on the table.   20. coastie, I get my records in the basement of the VAMC I go to,...just ask information desk where the Records Office is....go there and if you only want the records from your last exams Just tell them to go back to those dates, other wise you may get years of your records..you sign for them there free...sometimes they may tell you they will send them to you in the mail but you can request you really need them while your there they can print them out. & Coastie 72 that's evidence carlie has mention...you also may want to get IMO...a Diagnosis from a Dr is basicly evidence! and of course to help you cope with health problems your having...its just that you need to say these problems was from your service days & got worse or ask a Dr to say its likely to as not that your disability's are from your years in service...they truly can't say its the very cause but they can word it ''likely to as not'' or something along those lines....not sure the VA docs will help you on that but an IMO Doc will...a good understanding Dr will.

Oh yeah I know what ya mean carlie...I just wish someone would push the issue and rate tinnitus to 50% at least! or find a way to mask it. mine seems to be getting worse its about to drive me insane & not only for me but for all my fellow veterans that have to live with it 365 Burt Did you file a claim for compensation increase? or was it just your regular visit to your primary Doc? sometimes the VA Dr's will submit your claim and sometimes they don't...its mostly up to the vet to file for increase...but you can get a VSO or member here in hadit to help you ...it sounds like to me you ''hadit'' you may get a letter letting you know your set up for a comp & pen? I'm not sure but if you did file for increase yep you should get a letter for your C & P appointment & Never ask a VA Doc if he/she thinks you qualify for comp.....altho when you submit a claim For increase they want to check you out pretty good...I'd spend a little cash and go get a couple of IMO's (Indenpendent Medical Opinion) especially if there in your favor. I understand what you mean about trusting the Dr's but you still need to do some research on a few things you may question ( internet is a big help)....and when you get your appointments with the VA Dr's make each minute count...try to write yourself some notes the day before about the things you want or need to remember to ask your Dr about your health/meds ect,,ect,,......and when you finish with your appointment its a good Ideal to go get copy's of your medical records...because I have found after you leave the appointment the Dr's will write in their report different things than what they tell you.....so its a good thing to stay on top of things! ....>Not all Dr's but some of them!!!   22. your spouse received 10% disability when discharged in 1975 from the army & then was rated 100% while serving active duty? for loss of reproductive organ or after he was discharged? ...you sure the 100% was not serverance pay? Does he get a 100% disability check each month from the Veterans Admin? I don't understand your question.....unless your meaning he was not compensated for his 10% dating back to 1975? you need to go back to 1975 and look at all his medical records and service records, like Mrs Berta mention check the c-file. Not sure about the cue on his DD-214.... if he only served 3 years and his DD-214 Says he served 10 years active duty...I believe that can be corrected....I'm not sure what you are asking ? What is it you need help with?

Coastie 72, if your having problems working file for TDIU it maybe a long battle but these folks here at hadit can help you win your claim, with all your medical problems you need to try to get them service connected....and when your medical problems prevents you from working...file a claim...even if you have a claim in process file one for TDIU...I think you will get it. with tdiu compensation and SSDi that's a pretty heffy income buddy

I have severe profound hearing loss I can't hear anything unless its a loud boom I can't her people talking if I hear I can't understand a word they say its very frustrating & depressing...I am getting to where I can't hear anything but that stinking tinnitus...so I been thinking about taking sign language class, I can't always read lips if that person is to far away but I read lips and have the last 30 years or longer..I've tried everything under the sun for help and mask my tinnitus its only gotten worse and the VA don't seem to care from what I've ask them about mine...so I just get depressed and wonder how long I got left in this old world and think I'd probably be better off if it weren't from my darling grandkids and my kids I think I would not want to live with this crap in my head. my spouse usually goes with me to the Dr and one time she didn't I been having prostate problems my prostate keeps swellen up anyway I miss understood the Dr and when I got my meds I didn't take them right he had wrote the prescription out to take 3 a day I had three bottles of the meds I thought they were all the same so for months I was just taking one med of the three..its just another problem people with hard hearing have to cope with...other than my spouse read the instructions on the bottle...eh! sorry just had to vent some!
