Navy4life reacted to Buck52 in DRO Hearing 3/21/2016
Your welcome jimmer,
Navy4life I wish you the best with your claim and you hear something soon.
Let me know when you get your decision, and if they send you a transcript.
I had an informal hearing and they sent me a copy of everything that was said at my hearing with my decision..but that was about 14 years ago.

Navy4life got a reaction from HorizontalMike in DRO Hearing 3/21/2016
I just had my DRO review hearing on 2/26/16. It was short and to the point. I made TWO binders that were identical for my presentation. Each binder had the exact evidence/documents as the other one did. When I got to my hearing the DRO hearing officer who was supposed to hear my case was out so I got another hearing officer. I was told by my DAV rep he was short and to the point. I went into the meeting and he asked if I wanted "formal" or "informal". I chose "informal". That will be your decision and only you can decide which way you go. I went "informal" which mean't the hearing was not recorded but keep in mind anytime you want to go "formal" you can and the recording starts.
We chatted for about 30-45 minutes and I showed him all my new evidence, my IMO letter, and I pointed out the errors from the original medical opinion. He took all of it into consideration. He kept the binder I provided as a "working copy" for himself.
He told me it would be about 60 days before a decision would be made.
The DRO is there to give a "fresh look" - the latin word "de novo" means from new. The DRO is supposed to look at the entire case as if it is the first time.
Good luck!

Vync;
That is exactly what the DRO hearing office told me, that the prior rater had to go with what they had and since the medical opinion was what they had it was unfortunate. To me that sounded like the DRO hearing officer saw the errors with the medical opinion from my first claim.

Flores 97, Buck52, Navy4life, and Vync, Thank you for providing me a wealth of information, concerning my DRO meeting next Monday. I am in the process of organizing my information, going over the nexus letters, DBQ and medical journals. You gave me a good insight on what to expect at the hearing. The C & P doctor told me he was going to deny my claims, but then told me I had a really good chance of winning on appeal. Go figure. Thanks again, for the information, even tho the hearing is a week away, I am not going to wait until the list minute. to be organized.

Will do! I hope you hear some good news very soon!

So you went the "increase route" correct? Sounds like it is moving along. What is your current status on Ebennies? Does it show "INC" next to the contention under "pending disabilities"???

Navy4life reacted to DevilDog12 in Some clarification needed!!
I was in PFD but back to GOE. But, Im sure it is because of the C&P's. Hopefully hear something soon, but not holding my breath

Navy4life reacted to DevilDog12 in Some clarification needed!!
Wow....happy to hear about your increase to 100%! Awesome news! Still waiting on my decision. Had my C&P's a month ago. VA just received them on 3/7, so I will probably be waiting another few months. Hope that's not the case, but I'm just being realistic.

Navy4life reacted to Gastone in Some clarification needed!!
Don't be so sure, that a VA Rater can't deny your increase, just because of your Evidence of Record.
See my above 2/29 post, Denied SA increase 2014 FDC & 2015 SA increase FDC. Received Official VA Decision to continue my SA @ 50% 11/11/15 from 2015 FDC. Time to NOD, right?
Wrong, seems there's "Phantom Raters" at the VA. Unbeknownst to me, (1) of these "PRs" was eyeballing my recent Decision. Reversed the 11/11/15 Decision Letter, granted SA increase to 100% Scheduler with SMC S (1), from 2015 FDC.
My E-Ben site was updated 01/03/16 showing the "NEW" 100% SC and I received the Retro mid 01/16. Just received the Official Award Letter 03/08/16, the NEW Award was made 01/03/16. Same Day Service with E-Ben, I would never of believed it possible, go figure.
The 2014 & 2015 FDC's for increase were identical. Had I filed a NOD on the 2014 Decision, requesting a DRO Hearing, well my 06/14 DRO took 4.24 yrs; need I say more.

Yeah, I am going to. I don't see how they can deny me with all my records and VA notes from doctors, but it's the VA, so who knows. If they do, then another NOD will be filed
-
Navy4life reacted to DevilDog12 in Some clarification needed!!
Thanks! I don't really understand it all, I just hope for the increase. And Im sure I would get retro back to October 2015, correct? That is when increase was filed.

I so need a selfie of me on it. I have to fly tomorrow again. Airport security is so not fun! But I understand their job is to protect us.
I'm hoping 3/8/16 I get off of it!!!!

Navy4life got a reaction from green in IRIS Response
I agree GREEN! I have been waiting since November 2014 and finally had my DRO hearing a week and a half ago and the wait now for the decision is killing me. Trying to occupy my life with other things than worrying about the "what if's" - still it's hard not to wonder...

Navy4life reacted to Andyman73 in Feet and Ankle ratings - how are they rated/calculated
Does the bilateral factor come into play when figuring for the total 40% rating per side, or is that not considered until after ratings are calculated?
For me I have 30% bilateral pes cavus/with plantar fasciitis. And 10% for L ankle. I was recently denied secondary for R ankle, for some b.s. reason of pain being related to foot issue, no matter the reduced ROM.

Navy4life got a reaction from Andyman73 in IRIS Response
Sorry to hear that. I got a response within days. I would contact your local congressman office and send a pretty stern email about the situation asking for his or her help. It worked for me when I asked for help regarding my C-File.

Navy4life got a reaction from flores97 in Went to PFD today
Well big SHOUT out to Buck! I received my C&P exams from the BVA at the VA Hospital just now. All I had to do was request them and they gave them to me!
BAD NEWS - the PTSD & Eating Disorder C&P exam is NOT good! Looks like I am going to be reduced to 10% and the C&P exam for left ankle doesn't look good either.
What gets me is the doctor doing my C&P for PTSD stated I had BDD (Body Dysmorphic Disorder) but the C&P exams states I have "characteristics" but don't meet full criteria to warrant a diagnoses.
I will post them in the C&P forum later but pretty bummed
So if they decide to reduce me will I be sent a separate letter or will that be on the Award Letter as a recommendation for reduction?
-
Navy4life got a reaction from flores97 in Went to PFD today
Green;
Thanks! The issues I have is I was unable to see my C&P exams but I was able to get "bits and pieces" of it from a VBA rep on the phone. Oh well nothing I can do now right?? LOL

Navy4life got a reaction from flores97 in Went to PFD today
So I filed my FDC claim on 1/12/16 - had C&P exams on 2/4/16 and today I am in Preparation for Decision. I went from GOE to PFD in a matter of a week. My timeline changed too.
