I think my numbers clearly shows a hearing loss back then. -
I think my tests showed clear hearing loss!

Going way back in my C-file and on one of their pages (that did not come to me in 83) is this break down: SMR shows normal audiogram on preinduction PE. Mine clearly states a hearing loss in the 4000hz range at 55! SMR is silent for complaint of hearing loss. Again a play on words my SMR clearly shows an occasion of treatment for otitis media and also for a wax build up. I mean back then we just went in had it treated and back out there door! AND THEN: SMR shows normal hearing on separation PE. On this one where the vet fills out and checks symptoms I checked hearing loss, again clear as day! And in the dr.'s notes he wrote "hearing loss unilateral high frequency and also it looks like connective loss-media. Not sure what that means? Please let me know what you guys think. I am probably going to prepare a NOD based on these. I am not a back guy but that is what it seems like. A 40% evaluation is assigned from xx/xx/2009, the date facts were found. (this line says it will go back to 09 so if you did not have 40% at that time you will be getting some retro is the way I read it.

Great for you ROVER! I have been looking to move down south where a little warmer but wife will not move to FL I considered NC but from what I remember They weren't very vet friendly! I wonder if this is just an attempt to delay and just totally disregard your little mistakes or if it is the case were the VA does not feel correcting them would change anything in your file. I would run these by my lawyer and ask his/her advise I mean you are paying him and hopefully he knows what he is doing. If by chance he finds one that in fact could change your rating or be a CUE and more monies involved then run with it. If not why bother?

Sounds to me like you best asked your lawyer. Anytime you file for rehab they qualify you for rehab or not for rehab. There really is no in between. If they said no and suggested IL then that will help your IU claim. But it appears you went to college and finished so rehab is of the mind that you are on the road to recovery. This all going to be based on your lawyer being able to pull a rabbit out of a hat? In other words you maybe screwed for the IU but your lawyer to get you a higher %. If right now you are just feeling down and want to give up then that could increase your rating. I would like to suggest you go to a vet center and let it all out and see if they can help you either way good luck to you and thank you for your service! Stillhere

No. Permanent is based on that the condition you have is stagnant and will never get better. It other words permanent. I have a heart condition that is rated 100% because as we all know it will never get better. IU is based on the fact that you have enough of disabilities the type that can keep you from holding down a job and making a substantial monies tp support yourself and family. Some folks feel that you can work and just not make a substantial amount but VA will keep a close eye on you and can recall you if they feel you are making to much. IU can be P/T but I know I have pretty much confused you now. After you get your documents we will be better able to help you or you can do a search of the site for IU and a whole bunch will come up. There is even a whole section based on it and is a good read. Give it a shot. Go to forums and scroll down till you see the section with PTSD, Agent orange and there will be one for Individual Unemployable. Well if the VA grants 100% if it is not a mental condition you can continue to work. If you are granted IU and you are currently working then you will have to stop right away or they may build a case against you and have it set aside. I never filed for IU and worked even after I was granted 100%+SMC but it was to much for me and I stopped. Best thing I personally ever did! Even now sometimes I get the itching to maybe do something, but it goes away pretty quick. Wait till you get your letter and post back. Stillhere

The VA is supposed to use the reading that will give the vet the best monetary award for the overall test. The speech % if it is the worst or the pure-tone. The VA takes the %'s and uses the table to figure the total. Hope this helps! Stillhere

A lot of this is going be time sensitive. I mean if you get it long before your meeting then I might ship/send it before. But if you don't get it in time I would take it with you. I am pretty sure at a meeting like this either you or your representative will be asked if you have anything to add? But always,always remember to keep a copy of everything so either way you are covered! Stillhere -
Got my award for hearing lose and tinnitus back in July "12 and did not like the EED they gave me so filed in Sept.12 for a recon. Now today it is saying in ebennies pending final approval for notification! This can not be good for me? I guess I will have to go the CUE route now to get what I want and should have had. John999 said that a recon would not work so I guess I will have to do the lawyer thing and go from there. Damn shame though my SMR's from Vietnam show clear as day that they screwed up and did not award me back in 83-4 and if I had known what I know and have learned through Hadit I would have been awarded! So what do I do now find me a lawyer to review my filed and see if they will take my case? "Nothing worth fighting for is ever EASY"! Stillhere

I personally have a hard time visualizing a toxic scenario on board an American ship but I will give you that you know more than me. Never been on one but I have never heard any of my 3 brothers talk about it before and 1 served in Nam a on board Marine. Sounds to me like you all are going to have to get congress to agree on what it really was like. Guess I will have to do some research and let me say first hand I am sorry you had to serve in those conditions. I am a Army/Marine guy through I wanted to be on the ground or good earth whenever something might happen but I do like to fly but I am glad when I get there. My conditions were up and down and I guess it was toxic because of the AO and the spraying and stuff. But like I said to busy to remember any barrels or stripes or where the come from but I guess they did have to come from somewhere? Stillhere -
ptsd Sleep Apnea Claim And Appeal Denied

Mojo you kind of have to remember some help more than others and just flow with it. That said sleep apnea is not a presume so we have to go at them with paper work to get it granted. I personally feel also that because it is rated so high (50) with a cpap that the VA almost has to be in your bed room. I hope you have a copy of your C-file and medical records because if you don't your behind a rock and a hard place. Take your C-file and good through it page by page! I know how it is with PTSD and it ain't fun but you have to do it. Let your mind wander a bit for say yea I remember when I was sick with that, and the first sg made me do that. But any how you get what I mean. And like Berta said any buddy letters your wife if you were married during or before. After that send in the 9 form and see how it goes it will be a long wait. One other point if I may, it now seems that quite a few of our Navy brothers want to be consider the same as us by serving during the war and I applaud those that did, But there comes a time when you have to look at yourself and say "I should have joined the ARMY"! -

I can remember quite a bit of things that went own while I was in Nam, more at night! But I'll be damned if I remember any barrels per say. Orange green or blue stripped. Whoever can do that I turn a deaf ear (my right one)to and consider the source. I was in the central highlands on rt.1 and made many trips down to Da Nang airport and there about and still can't visualize a barrel with a stripe! Maybe I was just to busy? I do remember a little mamma son but that is another story! I can also see areas around us that were sprayed and seeing it being done! Stillhere -

But Berta don't you feel that these types of claims by veterans that only saw Vietnam on the news reels! Is part of the wasted time that bogs our VA down? Someone once said and I wish I could remember who " if all veteran's claims were well grounded there would not be a backlog"! It is having to deal with these throw something on the wall and see what sticks claims that are just ridiculous! -

You know I did give some thought to my doing their work for them but decided not to. My thinking in not doing that is that just maybe the individual doing the review will actually take the time and actually read it! Not only where my numbers good or should I say bad enough for a rating but I also had mention of otitius media on all my exam and that should have been awarded at the very least?!! This claim and their finally making it SC in from 2005 but their approval almost mirrors the same denial in 1983. The point has never been if I suffer from hearing loss but wether it should be SC?! I am hoping this will do the trick if not I hoping this will move faster than the last one that took 7 years!! Stillhere
