  1. For what it's worth, I know very little concerning VA disabilities and the complexities of a successful legitimate claim. I'm just muddling my way through my claim, with the expert help from some of you.

    However, do not underestimate this administration's efforts at exposing folks that are taking advantage of the system. It keeps money in the government coiffures and perhaps acts as a deterrent for others; thus unclogging the system.

    I might be looking under the bed for boogeymen, but look at the unprecedented number of IRS investigators that have been hired in the last 8 years.

    Regardless, I should think you have no worries if you have a righteous claim.

    As to your Dr's SISOC, marginal at best. No indication that he actually reviewed your 2002 SMR DX of SA.

    SC SA DX'd needing Cpap or Bipap is rated at 50%, even if you don't use the Machine, which would not be wise. If you also have a DX requiring supplemental 02 while sleeping due to P02's dropping below 90%, that does support a possible Chronic Resp Failure claim.

    Check out the 38 CFR 4, SA Rating for 100%. You'll notice that there are 3 or 4 DX "OR'S" listed, any (1) of which could get you a bump to SA 100%.

    That worked for me, this past 12/15. It took a VA Quality Review of a 07/15 increase Denial Decision, but the Sr Rater agreed with my position regarding my SA Request for an increase to 100%. Every thing regarding my 02 use and meeting another (2) of the 100% requirement was in my VMC records. The original Rater just didn't understand the significance of the "OR's" and the 02 Use. Got 100% Retro'd back to 01/14 with SMC S (1).

    Gastone, thanks a lot for your comments and especially your recommendations. I'll check out 38 CFR 4, but I'm not O2, although I use the CPAP exclusively. It has really helped.

    Yea, I'm only cautiously optimistic concerning the EFT stuff. There was one number off on my routing#.

    I disagree with your assessment of my Dr.'s SISOC, however. The 1st para deals with my current sleep study. The entire 2nd para speaks to the sleep study in my SMR. Did I get that acronym right? I'm still scratching my head as to what SISOC means.

    im not surprised that Uncle Sam is hiring more investigators. There is a significant upswing in fraudulent claims.

  4. So, I woke up to encouraging news from e-benefits. It still says gathering dust, but it's asking for  two things from me:

    One is to update my Finacial institution immediately. We can only pay EFT or pre-paid Credit Card.

    The second was to update some form that deals with my dependants. 

    It looks like something is happening. I will post redacted copies when I get to my desktop later today. I also owe a copy of my Dr's nexus letter.

    I hope some of this helps other legitimate claim veterans.

    Gastone, this is helpful comment that I'm taking the liberty of reposting.

    Can anyone offer a brief explanation of how to donate? I'm sure it's here somewhere, but sometimes I find the site a bit "busy" and difficult to navigate for someone that is techno-challenged...like me.

  6. Update:

    I went on E-benefits today to download a Form 21-4138, Statement in Support of Claim that my Dr. filled out supporting my claim. She provided a clear nexus of exacerbated medical condition that started with my active duty sleep study and DX of OSA to my current one, seperated by 14 years. I will print a redacted copy when I get home to my computer.

    Additionally, to my delight, I found my Estimated Date moved up 3 months to 8/21/16-10/17/16.

    Comments anyone?

    The other day I talked with a veteran who didn't even know it was possible to file a disability claim because they were told the VA only handled GI Bill.

    In the service, many acquired the "tough it out" mentality despite injuries. They got out and continued to live under that philosophy, but their injuries caught up to them and didn't have adequate health care. By then, damage is done and it might be too late to turn things around.

    Back before the Internet and before the VCAA of 2000, many of us were told to just visit our local VA rep after getting out, but in reality the representation may have been pretty awful. Unlike today, all resources were pretty much locked up in an ivory tower back then.

    And then there are VSO's who helped veterans file their claims. The veteran comes back later with another issue and is told not to file anything else because it "might slow down" their pending claims.

     

    Personally, I was out of the military for 13 years when I found Hadit. I had no idea what a secondary claim was until I learned it here. If I knew it was possible to file a secondary claim, I would have done it years earlier, got treatment, and not feel like I am falling apart.

    Ditto!  I could have been compensated for many years, I think.

    In fact, I thought that some folks were just taking advantage of the system. It's still my personal feeling that I will only claim a disability for something that happened to me as a result of my service. If I feel I would have contracted the problem whether I was in the service or not...well, I'm not sure I will file a claim. 

    By no means am I passing judgement, however. I served 27 good years and spent very little time in sick bay.

  8. First of all, welcome to the site!

    Yea, I'm only slightly concerned. There is a clear nexus to service connectivity. But, you can always bolster your husband's claim. My VSO asked me if my Tricare PCM would write a short paragraph in my file stating that my current condition is more than likely a continuation of the active duty DX. It doesn't hurt to try. I suggest you do the same. 

    There are some terrific folks here that will chime in with real help. You will learn very fast who to listen to...Berta cough Berta cough Berta.
